A City Attorney/Prosecuting Attorney shall be appointed for the City of Greendale by the Mayor with the consent of a majority of the members elected to the Board of Alderpersons.

The City Attorney/Prosecuting Attorney shall, unless otherwise directed by the Board of Alderpersons, have responsibility for all litigation of which the City is a party; represent the City in all legal matters and proceedings in which the City is a party or interested in or which the City Officers are parties in their official capacity; advise the Mayor, Board of Alderpersons and any member thereof, City Clerk and any committee, department head or other City Official, subject to reasonable limitations established by the Mayor or Board of Alderpersons, as to legal questions affecting the City's interests; approve as to legal form such ordinances, contracts, deeds, bonds and other documents to be signed in the name of the City or made to or with the City of Greendale as are submitted to him/her; attend Board meetings as the Mayor, Board of Alderpersons and any member thereof or City Clerk may direct. He/she shall further attend all regular and special meetings of the Board of Alderpersons unless otherwise directed and perform the duties of Prosecuting Attorney at all Municipal Court sessions.

The appointee shall be at least thirty (30) years of age and be licensed to practice law in the State of Missouri.

The City Attorney/Prosecuting Attorney may be removed from office at will by the Mayor with the consent of a majority of the members elected to the Board of Alderpersons or by two-thirds (2/3) vote of all members elected to the Board of Alderpersons independently of the Mayor's approval or recommendation. The City Attorney/Prosecuting Attorney may resign at any time as City Attorney for the City of Greendale upon at least sixty (60) days' written notice to the Mayor and Board of Alderpersons.
