The following words, when used in this Chapter, shall have the
meanings set out herein:
Any living member of the animal kingdom, excluding man.
Any of the following dogs or animals:
Any dog or animal, whether or not running at large and whether
or not unrestrained, that without provocation has bitten any person
not a trespasser causing serious physical injury to that person.
Any unrestrained dog or animal, whether or not running at large,
that without provocation has attempted to bite any person not a trespasser
which would cause serious physical injury to that person.
Any unrestrained dog or animal, whether or not running at large,
that without provocation has placed any person not a trespasser in
apprehension of immediate serious physical injury.
Any dog that has killed or bitten without provocation another
dog, cat or other domestic animal without provocation.
Any pit bull dog.
All animals of the canine or feline species, both male and
female.
Any person having a right of property in a dog or cat, or
who keeps or harbors a dog or cat, or who has it in his/her care,
or acts as its custodian, or who knowingly permits a dog or cat to
remain on or about any premises owned or occupied by him/her.
Any person, firm, association, partnership or corporation
which owns, harbors, shelters, keeps, controls, manages, possesses
or has any ownership interest in any animal. An occupant of any premises
on which an animal remains or customarily returns is a person responsible
for it under this Chapter. If a person under the age of seventeen
(17) years owns an animal subject to the provisions of this Chapter,
the head of the household of which such person under the age of seventeen
(17) years is a member shall be the person responsible for the animal
under this Chapter. There may be more than one (1) person responsible
for an animal.
Allowing a dog or cat to be off the private premises of the
owner or keeper, or his/her agent or servant, and not on a leash or
confined to the arms, motor vehicle, trailer or other conveyance of
the owner or keeper, his/her agent or servant.
Physical injury that creates a substantial risk of death
or that causes serious disfigurement or protracted loss or impairment
of the function of any part of the body.
A person upon the premises of the owner or keeper of the
dog in question without license or privilege to be upon said premises.
Shall mean
When a dog is attached to a leash held by a person that is capable
of and is in fact controlling the dog in question;
When an animal is within a vehicle from which the animal cannot
escape while the vehicle is being driven, parked or stopped; or
When an animal is on the real property of a person responsible
for the animal and within a secure structure from which it cannot
escape.
A dog is under restraint while in heat or estrus within the
meaning of this paragraph if:
For any animal other than a dog, cat or livestock, "under restraint"
shall mean in a cage from which it cannot escape.
Any dog running at large or a dog on the premises of its
owner or keeper but not confined to said premises by a leash, fence,
structure or other means that would prevent the dog from leaving such
premises. The City of Greendale will allow the electronic containment
system commonly known as the Invisible Fence® to be used as a
restraint system for animals. The Invisible Fence® may be used
as secondary restraint in addition to a visible primary enclosure.
This system is permitted on any lot or paved area so long as it does
not extend beyond the front building line and if all maintenance requirements
to keep the Invisible Fence® in good working condition are met.
On occasion, depending on location, sign(s) may be necessary to indicate
that the animal on the property is restrained by an Invisible Fence®.
Sign(s) will be determined by the Health Director and shall be no
smaller than six (6) inches by eight (8) inches but no more than four
(4) square feet.
Any live non-human primate (monkeys, chimpanzees, apes, gorillas
and lemurs), kinkajou, coatamuni, raccoon, fox, skunk, poisonous reptiles,
venomous snakes, constrictor reptiles, crocodilian reptiles including
alligators, crocodiles and caimans, bear, wolf, wolf hybrids, coyote,
coyote hybrids (coydogs), cougar, leopard, jaguar, tiger, lion, lynx,
bobcat, ocelot, or any crossbreeds of the above. Wild animals does
not include insects, fish, avian species, or other reptiles, mammals
or animals not listed above.
