1. 
The Borough hereby creates an office to be known as the "Code Enforcement Office." The Code Enforcement Office shall have the responsibility for administering the enforcement of the provisions of this chapter and administering the inspection and enforcement provisions of all Borough ordinances unless specifically prohibited in the ordinance itself or by state law. Such ordinances shall include, but are not limited to, the following:
A. 
The Subdivision Regulations [Chapter 22] of the Borough, as amended and supplemented.
B. 
The Zoning Ordinance [Chapter 27] of the Borough, as amended and supplemented.
C. 
The Sidewalk, Curb and Driveway Regulations [Chapter 21] of the Borough, as amended and supplemented.
D. 
The Building Code [Part 2] of the Borough, as amended and supplemented.
E. 
The Plumbing Code [Part 3] of the Borough, as amended and supplemented.
F. 
The Floodplain Management Regulations [Chapter 8] of the Borough, as amended and supplemented.
G. 
The Sanitary Sewer System [Chapter 18] of the Borough, as amended and supplemented.
H. 
The Water Ordinance [Chapter 26] of the Borough, as amended and supplemented.
I. 
The Fire Prevention Ordinance [Chapter 7] of the Borough, as amended and supplemented.
2. 
Such ordinances, codes and/or regulations shall be enforced, together with any amendments, supplements, substitutions and revisions hereafter adopted.

The Council of the Borough shall appoint by resolution a Code Enforcement Officer who shall be in charge of the Code Enforcement Office and who shall serve in that capacity at the will of the Council of the Borough of Hamburg. The Code Enforcement Officer shall supervise such other employees, assistants and inspectors which shall be necessary for the administration and execution of the responsibilities of the Code Enforcement Office as, from time to time, appointed, approved and/or authorized by the Council of the Borough.

The Code Enforcement Officer shall be responsible for the fulfillment of the duties and responsibilities of the Code Enforcement Officer. The duties of the Code Enforcement Officer shall include the receipt of applications, the issuance of permits, notices, certificates and orders, the making of inspections other than such inspections under the Electrical Code of the Borough to be made by a person or entity other than the Code Enforcement Officer, to determine conformance with applicable codes, regulations and ordinances hereinabove described in this Part, the keeping of records, the issuance of periodic reports to the Council of the Borough, the recommendation of amendments and supplements to the various codes, regulations and ordinances described hereinabove and such other activities which may, from time to time, be designated by the Council of the Borough.

An official record shall be kept of all business and activities of the Code Enforcement Office, and, to the extent required by law, all such records shall be open to the public for inspection at all appropriate times; provided, however, that the aforesaid shall not apply to any records or information which is not required by law to be made available by law; and provided, further, that the aforesaid shall not apply to any evidence or information obtained in the course of any inspection or investigation which shall be considered privileged information and shall be kept confidential.

In the discharge of his duties, the Code Enforcement Officer or his authorized representative, upon showing proper identification when requested, is hereby authorized to enter and inspect at any reasonable hour, which shall be deemed to be 7:00 a.m. to 10:00 p.m. prevailing time, any building, structure or premises in the Borough of Hamburg for the purpose of enforcing the duties and responsibilities of the Code Enforcement Office pertaining to any of the codes, regulations and ordinances hereinabove described in this Part. The Code Enforcement Officer and the owner, operator, occupant or any other person in charge of any such building, structure or premises, subject to the provisions of this section, may agree to an inspection by appointment at a mutually convenient time.

Nothing in this Part shall be deemed to limit, supersede or otherwise interfere with the duties and responsibilities of the Police Department of the Borough and the members of the Police Department as such duties and responsibilities may, from time to time, be provided by statute, ordinance, rules, regulations or otherwise provided by law.

The Code Enforcement Officer is hereby authorized and empowered to institute summary proceedings by citation, civil enforcement proceedings or any other proceeding as may be authorized by applicable codes, regulations or ordinances hereinabove described or as otherwise may be authorized by law. He shall also have the authority and power to request, obtain and serve search warrants and subpoenas as may be authorized by any of the codes, regulations and ordinances hereinabove described or as otherwise may be authorized by law.

The Borough Council does hereby amend any and all ordinances of the Borough affected by the passage of this Part. To this extent, each ordinance so affected shall be deemed to include by reference thereto the provisions of this Part to specifically provide for the office of Code Enforcement Officer and the enforcement of the terms of each such ordinance by the Code Enforcement Officer.
