As used in this chapter, the following terms shall have the
meanings indicated:
Leaving a dog, cat or other animal in the City and not providing
food, water or shelter. This shall include not redeeming a dog, cat
or other animal at an animal shelter or kennel.
Normal and prudent attention to the needs of an animal or
fowl, including that care which is normally necessary to maintain
good health for the specific species of animal or fowl.
Wholesome food suitable for the species provided at suitable
intervals in a sanitary manner in quantities sufficient to maintain
good health in an animal or fowl considering its age and condition.
The provision to each healthy animal or fowl of all immunizations
and preventative care required to maintain good health; space adequate
to allow the animal or fowl rest and exercise sufficient to maintain
good health; grooming as required so that they are free from dangerous
matting which affects their health, and the provision to each sick,
diseased, or injured animal or fowl of necessary veterinary care or
humane death.
A structurally sound, properly ventilated, safe, sanitary
and weatherproof shelter suitable for the species, condition and age
of the animal or fowl which provides access to shade from direct sunlight
and regress from exposure to inclement weather conditions. The area
where animals or fowl are kept must be kept free from unsanitary conditions,
vermin-harboring debris, rodents, refuse, or any dangerous protuberance
which can provide an opportunity for injury or a danger to the health
of the animal or fowl.
A continual access to or access at suitable intervals to
a supply of clean, fresh, potable water provided in a sanitary manner
suitable for the species, condition and age of the animal or fowl
in sufficient amounts to maintain good health in the animal or fowl.
Such water will be provided in a secure manner so that the container
cannot be overturned.
Any mammal, reptile, fowl, or bird, either male or female.
An agent designated by the Mayor or Chief of Police to enforce
or assist in the enforcement of this Chapter.
A dog, cat, or other animal shall be deemed to be at large
when off the property of the owner and not under restraint.
For the purpose of licensing of the dog, a dog of either
sex if over the age of four (4) months.
Any species of animal selectively bred by human beings through
several generations for the qualities required for the animals to
successfully live with human beings. This includes, but is not limited
to, dogs, cats, rabbits, rodents, reptiles, birds, fish, and other
animals which are commonly found in pet stores, were bred in captivity,
and have never lived in the wild.
When bitten by, or fought with, or has come in close contact
with a dog or other animal shown to be infected with the rabies virus
as determined by standard laboratory testing.
Care of an animal to include, but not be limited to, adequate
heat, ventilation and sanitary shelter, wholesome food and water,
consistent with the normal requirements and feeding habits of the
animal's size, species and breed.
Domestic animals of types customarily raised or kept on farms,
including horses and other equine; cattle and other bovine; goats,
sheep and other ovine; swine; llamas and other camelids; ostriches,
emus and cassowaries; including miniature, dwarf or pygmy variations
of all the foregoing.
The person having the right of property or custody of a dog,
cat, or animal or who keeps or harbors a dog, cat, or animal or knowingly
permits a dog, cat or animal to remain on or about any premises occupied
by that person.
This term does not include domestic, non-farm animals as
defined in this section. Domestic fowl, such as turkeys, chickens,
ducks, peacocks, or geese and other birds commonly found on farms
and not commonly kept in a primary residential structure, including
peafowl. This definition does not include ostriches, emus, or cassowaries
which are considered to be livestock.
A dog is under restraint if it is within a fully enclosed
or fenced area or under the handheld leash of the owner or agent of
the owner, or on a leash confining such dog to the yard of its owner.
A female dog certified by a licensed veterinarian to have
been spayed.
If any dog attacks or attempts to attack any other dog or
other animal while such dog is at large, or chases or otherwise attempts
to catch a person, then such dog shall be conclusively presumed to
be a vicious dog and to have vicious propensities and tendencies.
