A. 
The Board of Aldermen hereby establishes a User's Permit, effective January 1, 1988, to fish, operate a boat with motor, subject to the rules and regulations contained in Sections 240.030 through 240.140, as follows:
1. 
Over sixteen (16) years of age:
Day permit
$1.50
Season permit
$7.50
If sixty-five (65) years of age or older, no permit is required.
*Persons fifteen (15) years of age and younger are prohibited from fishing, unless accompanied by a permit holder or a person 65 years of age or older.
2. 
The City Clerk may authorize the issuance of permits, on forms that are inventoried and tracked by the City Clerk, to outside vendors for sale to the public. Any vendor so authorized may retain twenty-five cents ($0.25) from the approved permit fee for their services in issuance of the permit. The balance of the permit fee collected shall be returned to the City Clerk by the vendor at least quarterly, before the end of the months of March, June, September, and December. The vendor shall, at the same time that they remit collected permit fees, account to the City Clerk for the permit forms issued to them that remain unsold.

The property of the City located in Sections four (4) and nine (9) of Township Forty-nine (49), Range Twenty-five (25) in Lafayette County, used by the City as a reservoir and for other purposes shall, for the purposes of this Article, be considered the City Lakes property.

The City shall have the power to enforce the provisions of Sections 240.030 through 240.140 under the City Police powers and may prosecute violations of such Sections in the Municipal Court for the City. All permits related to the use of the City Lake property shall be revoked upon a conviction of the holder thereof in violation of any of the provisions of this Article.

A User's Permit shall be issued by the City Clerk, and such other persons as the City Clerk may designate, and the City Clerk and all other persons so authorized by him/her shall issue the permits and charge a fee as outlined in Section 240.030. Provided however, that senior citizens sixty-five (65) years of age or over shall not be required to apply for or possess a User's Permit.

No person shall trespass upon the City Lakes without a valid user's permit. It shall be unlawful to be or remain on the City Lake property between 12:00 midnight and 4:00 a.m. without a permit authorized by the Board of Aldermen. All persons entering the City Lake grounds shall obey all orders of the City of Higginsville.

A. 
Speeding or racing of boats is not permitted, and boats shall not be driven at sufficient speed as to create waves high enough to endanger lives of other boaters or to interfere with fishing along shore lines.
B. 
Motor-driven boats must have suitable life preservers for each passenger.
C. 
Overloading of boats is not allowed, and persons operating boats must do so in a safe, prudent manner. Unsafe boats are not allowed on the lake. The person or persons operating a boat must be sure the boat is safe.
D. 
Only an electric trolling motor may be used to propel a boat on the north lake.

A. 
All persons over sixteen (16) years of age must obtain a permit to fish and shall pay the fee established and set forth in Section 240.030. A State fishing permit is required when required by the State laws. Persons under sixteen (16) years of age are prohibited from fishing, unless accompanied by a permit holder.
B. 
Bass limits are two (2) per day; the minimum size which may be taken in the City lake is fifteen (15) inches. Channel catfish limit shall be four (4) per day. Walleye minimum size is fourteen (14) inches, being the same limit as under the State law. Northern minimum size is thirty (30) inches, being the same limit as under State law. For other fish, the legal limits and sizes shall be the same as the State laws specify.
C. 
The only method of fishing allowed shall be by the use of three (3) hand poles, including rod and reel.
D. 
No person or persons shall be allowed to enter the water, except when water-proof material is used so the body does not come into contact with water.

A. 
It shall be unlawful to carry or use a gun on the grounds or City lake except during permitted waterfowl designated season.
B. 
Frog hunting season and the limit shall be the same as established by State laws. Any person or persons frog hunting shall be required to have a fishing permit to hunt frogs.

No livestock shall be grazed or permitted upon the City Lakes property. No dumping or throwing of trash on the ground or lake waters shall be permitted.

All dogs must be leashed, and no dogs shall be permitted to run at large upon the City Lakes property or to enter the lake waters, and the owners shall be held responsible for their dogs.

Intoxication and use of profane language are prohibited, and persons committing acts of vandalism, destruction of property and indecent behavior shall be subject to fine and may be ejected from the premises, temporarily or permanently.

The City reserves the right to temporarily or permanently close all or any parts of the grounds or lakes to fishing or boating, or both, at any time.

A. 
It shall be unlawful for any person to hunt waterfowl on the City Lake property, except as hereinafter provided.
B. 
No person shall hunt waterfowl on said premises except from waterfowl blinds, and no waterfowl blind shall be erected except at locations designated by the City of Higginsville. The permit fee for the erection of waterfowl blinds shall be one hundred dollars ($100.00) for each blind per season and shall be paid prior to the waterfowl blind drawing.
C. 
Fifty dollars ($50.00) of the blind permit fee shall be refunded to the blind permit holder if the blind, anchors for decoys, wire, etc., is removed from the lake property within fifteen (15) days after the designated season. If the lake is frozen at that time, said removal time is extended through the end of February. The City shall destroy all blinds not so removed and shall retain in such cases the blind permit fee. Before any person shall be entitled to a return of said blind permit fee, a representative of the City must certify that the blind, decoys, anchors, etc., have been removed from the lake property.
Each participant drawing for a waterfowl blind shall be a resident of the City and shall be of legal age. All participants whose names are drawn are required to select a blind and must erect an acceptable waterfowl blind one (1) week prior to the designated season. Failure to comply with this requirement will result in forfeiture of the refundable waterfowl blind permit fee. All participants selecting a waterfowl blind shall file with the City of Higginsville at the time of the drawing a list of hunters who will utilize the blind. The permit holder, with approval of the City, may add hunters to this list, but the list shall have a maximum of ten (15) names. The permit holder shall be responsible for properly erecting the waterfowl blind, placement of the decoys, and assuring all hunters have proper and required permits. Failure to comply will result in forfeiture of the refundable waterfowl blind permit fee and forfeiture of the right to participate in future waterfowl blind drawings.
D. 
Waterfowl hunting will be permitted from one-half (1/2) hour prior to sunrise until noon each day during the designated season. Licensed fishermen will be permitted to fish from noon to lake closure.
E. 
All participants hunting waterfowl on lake property shall register with the City Clerk, shall pay a non-refundable permit fee of ten dollars ($10.00) per person, and shall be on the permit holder's list of hunters. Anyone age fifteen (15) and younger may hunt with a permit but must be in the immediate presence of a licensed adult hunter age eighteen (18) or older that has a valid license and permit. Each waterfowl permit issued shall be valid for one (1) waterfowl season and shall expire annually at the end of duck and Canada goose hunting season, as regulated by the Missouri Department of Conservation.
F. 
The City Clerk shall set the date for the waterfowl blind drawing and shall conduct the same, and said date shall be the time that registration fees shall be paid and blind permit holder's list shall be filed. The City reserves the right to temporarily or permanently close all or parts of the lake for any reason whatsoever.
G. 
It shall be unlawful for any person to hunt waterfowl on the north City Lake.

No dock, post or other erection of any kind shall be constructed, erected or placed in or upon the Lake waters or surrounding lands of the City Lakes, without special permission of the City. Any person receiving such special permission shall not construct, place or erect any post or other erection except as is provided in such special permission.
