Certain documents, one (1) copy of which is on file in the office of the City Clerk of the City of Higginsville, Missouri, being marked and designated as International Private Sewage Disposal Code, 2021 Edition, including Appendix Chapters A and B, as published by the International Code Council be and is hereby adopted as the Private Sewage Disposal Code of the City of Higginsville for regulating and governing the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of individual sewage disposal systems as herein provided in the City of Higginsville and providing for the issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, penalties, conditions and terms of such International Private Sewage Disposal Code, 2021 Edition, published by the International Code Council, on file in the office of the City Clerk, are hereby referred to, adopted and made a part hereof as if fully set out in this Article.

That ordinances or parts of ordinances in conflict herewith are hereby repealed.

A. 
The code adopted by Section 510.420 is hereby amended by substituting the following Sections or portions of Sections for those Sections or portions of Sections with corresponding number of the International Private Sewage Disposal Code, 2021 Edition, or where there is no corresponding Section in the code the following Sections shall be enacted as additions to the code.
1. 
Section 101.1. Insert: "City of Higginsville."
2. 
Delete Section 103 in its entirety. Refer to Section 103 of the International Building Code, 2021 Edition.
3. 
Delete in its entirety Section 104.7. Refer to Section 104.7 in the International Building Code, 2021 Edition.
4. 
Section 106.4.2 Fee Schedule. Change to read: "The fees referred to in this Section shall be as indicated in Section 109.2 of the International Building Code, 2021 Edition."
5. 
Section 106.4.3., Item number 2, insert "90," and in item number 3, insert "90."
6. 
Delete Section 112 In its entirety. Refer to Section 113 of the International Building Code, 2021 Edition.

Delete Section 113 in its entirety. Refer to Appendix B of the International Building Code, 2021 Edition.

Delete Section 114.4 in its entirety, and add new Section 114.4 as follows:
Section 114.4: Violation Penalties. Persons who shall be found guilty of violating a provision of this code, or failing to comply with any of the requirements thereof, or who erect, install, alter or repair any structure in violation of the approved construction documents or directive of the Code Official, or of a permit or certificate issued under the provisions of this code, shall be punishable by a fine of not more than five hundred dollars ($500.00) or by imprisonment not exceeding ninety (90) days, or both such fine and imprisonment. Each day that a violation continues after due notice has been served, shall be deemed a separate offense.

Delete Section 115.4 in its entirety, and add new Section 115.4 as follows:
Section 115.4: Unlawful Continuance. Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less than fifty dollars ($50.00), nor more than five hundred dollars ($500.00), or by imprisonment not exceeding ninety (90) days, or by both such fine and imprisonment. Each day that a violation continues after due notice has been served, shall be deemed a separate offense.
10. 
Section 405.2.5. Insert: "March 1," "November 30," and "November 30."
11. 
Section 405.2.6. Insert: "June 1 to June 1 of the following year" in two (2) locations.
