The Town Board of the Town of Hartford, Washington County, New
York, does hereby ordain and enact the Town of Hartford Site Plan
Review Law pursuant to the authority and provisions of § 10
of the Municipal Home Rule Law and § 274-a of the Town Law.
This chapter shall be known as the "Town of Hartford Site Plan
Review Law." The Town of Hartford is hereinafter referred to as the
"Town."
A.
The overall purpose of the site plan review is to plan for the design
of commercial, multifamily and industrial development when it occurs
on a single parcel of land. This is in contrast to subdivision review,
which is to plan for development that comes about as a result of a
single parcel of land being split into two or more parcels of land.
Through site plan review, it is the intent of this chapter to promote
the health, safety and general welfare of the Town. This includes
promoting agriculture and conserving and protecting agricultural resources.
Additionally, through site plan review, the Town Board hopes to maintain
a clean, attractive environment. Such an environment is hereby declared
to be very important to the health and safety of the Town's inhabitants
and essential to the optimum development of the Town's economy.
B.
It is also the intent of this chapter to ensure the conservation
of the natural and man-related resources of the Town. Toward that
end, this chapter provides a means for the Town to:
(1)
Conserve its agricultural resources and promote the Town's agricultural
economy;
(2)
Preserve water and air quality;
(3)
Minimize traffic congestion and intrusive development impacts on
nearby properties;
(4)
Ensure access for emergency vehicles (police, fire protection and
ambulance service);
(5)
Provide adequate water supply and sanitary means for sewage and solid
waste disposal;
(6)
To ensure the ability of Town growth resulting from the proposed
use without undue adverse effect on the Town and its citizens and
taxpayers and the protection of health safety and welfare of the Town
and its citizens;
(7)
To ensure the protection of open space, natural resources and preserve
rural characteristics of the Town; and
(8)
To ensure overall conservation, protection, development and use of
the unique scenic, aesthetic, wildlife, recreational, historic, ecological
and natural resources of the Town.
The Planning Board of the Town (hereinafter the "Planning Board")
is hereby authorized to review and approve, approve with conditions
or disapprove site plans for land uses within the Town pursuant to
§ 274-a of the Town Law in accordance with the criteria
and procedures set forth below.
