Except upon obtaining a permit as provided herein, it shall be unlawful for any individual to interact in any way with any municipal solid waste placed for collection by an entity contracted for the collection of such municipal solid waste, other than the person placing such municipal solid waste for collection, a member of such person's household, or an agent or employee of any entity contracted by such resident or a member of his household.
To obtain a permit required by § 149-33 above, the person desiring the permit shall make an application to the Township in writing and therein set forth his name, age, residence, and make, model and license plate number of any vehicle such person may be using for permitted activities. The Township shall issue no more than seven permits at any one time. After seven permits are outstanding, the Township shall create a wait list for any additional applicants.
Upon request by the Township Manager, any Township police officer, the Township Code Official or the Township Zoning Officer to the Board of Commissioners, a permittee may suffer revocation of a permit issued hereunder for any action the Board may deem not to be in the best interest of the health, safety or welfare of any resident or property within the Township. Upon request by any Township police officer, the Township Code Official, the Township Zoning Officer, or on his own initiative, the Township Manager may suspend any permit issued hereunder until the next regularly scheduled Board of Commissioners legislative meeting.
All permits issued hereunder shall expire on December 31 of their year of issuance. Permittees holding expiring permits shall have priority to receive a permit for the succeeding year, provided that they apply for a renewal of their permits on or before December 15. Thereafter, permits shall be issued on a first-come-first-served basis.
The fee for any permit issued hereunder shall be $50 per year.
A. 
All fees shall be paid for the use of Nether Providence Township.
B. 
Permits shall be issued free of any charge to charitable organizations. Charitable information will be required.
Each permittee shall cause his permit to be placed inside on the dashboard driver's side of any vehicle used in any permitted activity. Any person undertaking any permitted activity without a vehicle shall keep his permit on his person.
Under no circumstances shall a permittee enter onto any private property without authorization of the resident residing at such property.
Permitted activities shall be restricted to the hours of 10:00 a.m. through 4:30 p.m., Monday through Friday.
Any person violating the terms of this article shall be guilty of a summary offense. Each contact with refuse shall be a separate violation. Each offense shall be punishable by a fine not to exceed $1,000 and imprisonment to the extent permitted by law for the violation of summary offenses.
