A. 
The cemetery owned by the City of Appleton City shall be laid out in lots on the plan on file with the City Clerk or Collector, and shall be in width and length as shown by the plat of said cemetery, and said lots shall be subject to sale and purchase at four hundred dollars ($400.00) per lot or one hundred twenty-five dollars ($125.00) per plot.
B. 
The cemetery lots shall be conveyed by certificate, signed by the Mayor, countersigned by the Clerk or Collector, under the Seal of the City, specifying that the purchaser to whom same is issued is the owner of the lot described therein, by numbers as laid down upon the plat of the cemetery on file in the office of the City Clerk for the purpose of interment, and such certificate shall vest in the purchaser, his/her heirs, or assigns, a right in fee simple to such lots for the sole purpose of interment under the regulations of the Board of Aldermen. Provided that any person unable to purchase a lot may inter, free of cost, in such place as may have been provided by the Board of Aldermen for the interment of paupers, and as may be directed by the cemetery supervisor.
C. 
A plat of the cemetery shall be procured for the use of the City, and all lots shall be designated by numbers, and the names of the persons owning the same shall thereafter be written with ink on the lots as they appear on said plat. Such plat shall at all times be kept in the office of the City Clerk or Collector, and the entries herein provided for shall be made by him/her.
D. 
It shall be the duty of the City Clerk or City Collector to provide at the expense of the City a register for cemetery plots, and opposite each plot the owner's name shall be entered and also any transfer of the same. Recording of such certificate of purchase by the County Recorder of Deeds is the responsibility of the purchaser of such plot and is recommended.

The cemetery shall at all times be under the control of the Mayor and Board of Aldermen, and a cemetery supervisor shall be appointed by the Mayor with the approval of the Board of Aldermen in May of each year, and his/her term of office shall be for one (1) year, or until his/her successor has been appointed and qualified. It shall be his/her duty to see that burials are made on the proper lots, and to keep a correct entry of all burials and of each lot sold, in his/her record book, and everything necessary to keep a full and complete history of the cemetery.

All graves therein shall be dug by the cemetery supervisor, or some person authorized by him/her, and the graves shall be thirty-eight (38) inches deep for a mausoleum and four and one-half (4½) feet deep for a vault or box. All persons buried in the Appleton City cemetery must be placed in a two (2) piece concrete box or better, excluding those persons who are cremated who must be placed in individual urns, however, two (2) urns may be placed in the same plot. A permanent marker must be placed upon the grave.

A. 
For the purpose of this Section, "monument" shall mean any grave stone or marker of a permanent nature intended to mark and memorialize a burial grave.
1. 
Permits. No monument, monument foundation or other object of a permanent nature shall be installed or constructed in Appleton City cemetery until a permit is obtained from the Appleton City Collector. Any monument or foundation placed without a permit shall be removed at the owner's expense. Monument permit fees shall be fifty dollars ($50.00).
2. 
Inspections. The City of Appleton City shall inspect foundations and monuments to verify conformance with cemetery regulations.
3. 
Monument regulations.
a. 
Monuments shall have concrete foundations thirty-six (36) inches deep or concrete foundations twelve (12) inches deep with piers thirty-six (36) inches deep. The number of piers required shall be determined by the City of Appleton City.
b. 
Monuments placed on individual graves shall not exceed twenty-two (22) inches in width.
c. 
Foundations shall not encroach upon adjoining graves. Exceptions may be by the City of Appleton City if the graves are owned by the same party.
d. 
Neither foundation nor monuments shall encroach upon cemetery property such as walkways and driveways.
e. 
A bench is not considered a monument and shall not be placed in the Appleton City cemetery.
f. 
Concrete mausoleums or concrete ledger tops will be prohibited, as over a period of time tops deteriorate and chip off. Those lots that need to match existing tops or have already paid for concrete tops will be permitted but we will not be responsible for damage to tops.
g. 
Concrete shall be mixed at a ratio of three (3) parts three-fourths (¾) inch rock, two (2) parts sand and one (1) part Portland cement mix. For one (1) yard of cement use two thousand (2,000) pound sand and five (5) Portland cement and twenty-eight (28) to thirty (30) gallons water.
4. 
Ornamentation of graves.
a. 
Any grave decorations or mementos found to interfere with the maintenance or upkeep will be removed by the Cemetery Association, exceptions will be permanent vases that are attached to the stone or foundation and everything on the stone until it has deteriorated (Cemetery Association will determine deterioration).

b. 
No one shall plant any flowers, shrubs, bushes or trees in the Appleton City cemetery.
c. 
All vases and urns used to place flowers in are to be made of a shatter-proof material. All glass items are strictly prohibited.
5. 
Decorative rock, wood chips, landscape timber, borders, flagpoles, solar lights, shepherd hooks, and wind chimes will be prohibited and will be removed at the owner's expense. Any foundation, monument, planting or glass vase-urn placed in violation of these regulations shall be removed or corrected at the owner's expense.

6. 
No dogs, except human assistance animals, shall be permitted in any cemetery.

The cemetery supervisor may, as occasion may require, designate lots in the cemetery marked in the plat as "potter's field" for the use of persons desiring to bury corpses and not owning any lots in said cemetery. The City shall so arrange the ground that one (1) or more parts of lots may be sold to any persons so desiring and that such parts of lots shall be in one (1) continuous group or space of ground, separate from the other lots.

No persons shall bury any corpse on any lot not his/her own without written permission of the cemetery supervisor.

The Appleton City Cemetery Association, which was incorporated in 1920, shall see to the care and maintenance of the cemetery grounds (which includes the entire Appleton City cemetery, including graves and driveways, mowed at least twice a year). For this service, the City shall donate twelve hundred dollars ($1,200.00) per year to help the association.

All City cemetery funds, or the equal thereof, shall be expended under the direction of the Mayor and Board of Aldermen, and it shall be their duty to cause all necessary improvements to be made.

The Board of Aldermen may from time to time, as it shall be deemed necessary, purchase additional grounds to be used for the purpose of interment, and it shall be governed by and under the same rules and regulations as that already owned by the City.

No person, without special permission from the Mayor or supervisor of the Appleton City cemetery, shall enter said cemetery between the hours of 8:00 P.M. and 5:00 A.M. of any day.

No person shall break or otherwise injure or deface any gate, fence, building or other property of the Appleton City cemetery, or injure or molest in any manner or remove any property of any kind belonging to any person and located in said cemetery.

All visitors are expected to respect the solemnity and beauty of the cemetery and strictly observe the rules established by the City for the purpose of securing quiet and good order at all times within the cemetery.

Any person violating any of the provisions of this Chapter shall be deemed guilty of an ordinance violation, and upon conviction shall be punished by a fine of not less than ten dollars ($10.00) nor more than five hundred dollars ($500.00).
