The Board of Supervisors of Fairview Township, York County, Pennsylvania, hereby signifies its intention and desire to join a joint authority known as the "Susquehanna Area Regional Airport Authority," with the cities of York and Harrisburg and the counties of Dauphin and York, pursuant to the provisions of the Act of Assembly approved May 2, 1945, P.L. 382, as amended and supplemented, known as the "Municipality Authorities Act of 1945" (the "Act").[1]

The Supervisors and the Secretary are authorized and directed to execute, on behalf of this Township, an application with the Secretary of the Commonwealth in substantially the following form:
APPLICATION TO BECOME A MEMBER OF AN EXISTING AUTHORITY
TO THE SECRETARY OF THE COMMONWEALTH OF PENNSYLVANIA:
In compliance with requirements of the Act of Assembly approved May 2, 1945, P.L. 382, as amended and supplemented, known as the "Municipality Authorities Act of 1945," and pursuant to appropriate legislation duly enacted by the municipal authorities of the City of Harrisburg, Dauphin County, Pennsylvania, and the City of York, York County, Pennsylvania, the County of Cumberland, Pennsylvania, the County of Dauphin, Pennsylvania, and the County of York, Pennsylvania, expressing the intention and desire of the municipal authorities of said municipalities to allow Fairview Township, York County, Pennsylvania, to join a joint authority under the provisions of said Act, said municipality certifies:

The name of the Authority is "Susquehanna Area Regional Airport Authority."
2.
The Authority was incorporated on September 8, 1997, under provisions of the Act of Assembly approved May 2, 1945, P.L. 382, as amended and supplemented, known as the "Municipality Authorities Act of 1945," to engage in acquiring, holding, constructing, financing, improving, maintaining and operating, owning and leasing, either in the capacity of lessor or lessee, all of the assets constituting Harrisburg International Airport and the Capital City Airport. The Authority shall have no power to pledge the credit or taxing power of the Township of Fairview and other member municipalities, as herein defined, or the Commonwealth of Pennsylvania or any political subdivision thereof; nor shall bonds issued by the Authority be deemed to be obligations of the Township of Fairview and the other member municipalities, the Commonwealth of Pennsylvania or any political subdivision thereof, nor shall the Township of Fairview and the other joining municipalities, the Commonwealth of Pennsylvania or any political subdivision thereof be liable for the payment of premium, if any, or interest on the bonds; nor shall members, officers or employees of the Authority personally be liable on the Authority obligations.

No other authority has been organized under provisions of the Act or under provisions of the Act of Assembly approved June 28, 1935, P.L. 463, as amended and supplemented, and is in existence in or for the joining municipality, except that:

The Municipal Authority of the Township of Fairview, York County, heretofore organized the following Authority which is in existence in and for the Township of Fairview:

Fairview Township Authority.

The naming of the joining municipality is:

5.
The names of the municipal authorities of said joining municipalities are: [Here following the names of the municipal authorities of said joining municipality].

The members of the Board of the Authority shall be 15 in number and shall be apportioned as follows:

The name, address and term of office of the first member of the Board of the Authority of the joining municipality is: [Here followed the name, address and term of office of the first member of the Board of Authority of the joining municipality].

While serving as a member of the Board of Directors, and for five years subsequent to the expiration of such member's term, no individual shall become employed by or enter into any business relationship regarding any matter which is the subject of Authority's business in general and the operations of either or both of the airports, in particular. It is specifically intended that the provisions shall include any Director, any business in which the Director retains an equitable interest, such as a corporation, partnership or unincorporated association, as well as any and all similar businesses in which any immediate member of a Director's family may have an interest.
The appropriate officers of the Township of Fairview are authorized and directed to cause notice of the substance of this article, including the substance of the foregoing application and of the proposed filing of such application to be published as required by the Act.
Appropriate officers of the Township of Fairview are authorized and directed to file such application and the necessary proofs of publication with the Secretary of the Commonwealth of Pennsylvania and to do all other things necessary to effect the incorporation of such Authority, including payment of the required filing fees.
