A. 
The Police Department shall have the following Police Officers and Police Cadets:
1. 
The Police Department shall have a Chief of Police who shall serve for a term of one (1) year. The Chief of Police shall be responsible for planning, supervising, coordinating, organizing and personally directing the work of the Police Department.
2. 
The Police Department shall have such numbers of Captains as the City Council shall approve from time to time, each of whom shall serve for a term of one (1) year.
3. 
The Police Department shall have such numbers of Lieutenants as the City Council shall approve from time to time, each of whom shall serve for a term of one (1) year.
4. 
The Police Department shall have such numbers of Sergeants as the City Council shall approve from time to time, each of whom shall serve for a term of one (1) year.
5. 
The Police Department shall have such numbers of Patrol Officers as the City Council shall approve from time to time, each of whom shall serve for a term of one (1) year.
6. 
The Police Department shall have such numbers of Special Police Officers as the City Council shall approve from time to time who shall serve for such time as the City Council shall establish.
7. 
The Police Department shall have such numbers of Police Cadets as the City Council shall approve from time to time who shall serve for such time as the City Council shall establish.

A. 
Before entering their duties, each Police Officer shall take an oath administered by the City Clerk that they will uphold the Constitutions of the United States and the State of Missouri and the ordinances of the City, and that they will faithfully demean themselves in the performance of their duties.
B. 
Police Officers shall be conservators of the peace, and shall be active and vigilant in the preservation of good order within the City.
C. 
Every Police Officer shall have powers at all times to make or order an arrest with proper process for any offense against the ordinances of the City or laws of the State of Missouri, and to keep the offender in the City Holding Facility or other proper place to prevent his/her escape until a trial can be had before the proper officer, unless such offender shall give a good and sufficient bond for his/her appearance for trial, and shall also have power to make arrests without process in all cases in which any offense against the ordinances of the City or the laws of the State of Missouri shall be committed in his/her presence. Every Police Officer is also empowered to serve and execute all warrants, subpoenas, writs or other process issued by the Municipal Judge of the City at any place within the limits of the County within which the City is located. Every Police Officer shall have the power to make or order an arrest in areas leased or owned by the City outside of the boundaries of the City.

A. 
The Chief of Police shall, in the discharge of his/her duties, be subject to the orders of the Mayor only.
B. 
Captains shall, in the discharge of their duties, be subject to the orders of the Mayor and the Chief of Police only.
C. 
Lieutenants shall, in the discharge of their duties, be subject to the orders of the Mayor, the Chief of Police and the Captains only.
D. 
Sergeants shall, in the discharge of their duties, be subject to the orders of the Mayor, Chief of Police, the Captains and the Lieutenants only.
E. 
Patrol Officers and Special Patrol Officers shall, in the discharge of their duties, be subject to the orders of the Mayor, the Chief of Police, the Captains, the Lieutenants and the Sergeants only.
F. 
Police Cadets shall, in the discharge of their duties, be subject to the orders of the Mayor, the City Administrator, the Chief of Police, the Captains, the Lieutenants and the Sergeants only.
G. 
In the case of absence from the City or other temporary inability of the Chief of Police to act, the Captains shall serve as Acting Chief. In the case of death, resignation or permanent inability of the Chief of Police to act, the Mayor, with the consent of a majority of the members elected to the City Council, shall appoint an Acting Chief.

A. 
The Mayor, with the consent of a majority of the members elected to the City Council, shall appoint or promote a Chief of Police solely from a list of eligibles submitted to the Mayor by a committee appointed by the Mayor.
B. 
The Mayor, with the consent of a majority of the members elected to the City Council, shall appoint or promote Captains solely from a list of eligibles submitted to the Mayor by the Chief of Police.
C. 
The Mayor, with the consent of a majority of the members elected to the City Council, shall appoint or promote Lieutenants solely from a list of eligibles submitted to the Mayor by the Chief of Police.
D. 
The Mayor, with the consent of a majority of the members elected to the City Council, shall appoint all Sergeants solely from a list of eligibles submitted to the Mayor by the Chief of Police.
E. 
The Mayor, with the consent of a majority of the members elected to the City Council, shall appoint all Patrol Officers and Police Cadets solely from a list of eligibles submitted to the Mayor by the Chief of Police.
F. 
All Patrol Officers and Police Cadets initially appointed to a position in the Police Department shall be appointed for a six (6) month probationary period. The probationary period shall be regarded as an integral part of the examination process and shall be utilized for closely observing the Patrol Officer's or Police Cadet's work. Upon expiration of the probationary period the Chief of Police shall within fifteen (15) days review the Patrol Officer's or Police Cadet's work and submit a recommendation to the City Council stating whether or not the Patrol Officer or Police Cadet should be appointed to the remainder of a one (1) year term. The City Council by a majority vote of the members elected shall thereafter, within thirty (30) days of receiving the recommendation of the Chief of Police, vote on whether to appoint the Patrol Officer or Police Cadet to the remainder of a one (1) year term. The employment of Patrol Officers and Police Cadets who do not receive approval by the City Council shall immediately terminate after the vote by the City Council. The decision of the City Council not to approve a Patrol Officer or Police Cadet upon expiration of the probationary period shall be final.
G. 
The Chief of Police may, with the consent of the Mayor, assign Patrol Officers to special duties, such as, but not limited to, detective, canine officer, D.A.R.E. officers, COPPS and traffic enforcement.

A. 
No Police Officer or Police Cadet or applicant seeking such position shall be appointed, promoted, demoted, favored or discriminated against because of his/her age, sex, race, political or religious affiliations.
B. 
No person shall willfully or corruptly make any false statement, certificate, mark or report in regard to any examination, certification or appointment held or given under the provisions of this Chapter, or in any manner commit, or attempt to commit, any fraud preventing the impartial execution of the provisions of this Chapter, or any rules and regulations made thereunder.
C. 
No person shall use, or threaten to use, any influence, persuasion or coercion to compel any Police Officer or Police Cadet to violate any provision of this Chapter.
D. 
No person shall use, or promise to use, directly or indirectly, any official authority or influence to secure for any person an appointment to a position in the Police Department or any increase in pay, promotion or other advantage in the Police Department.
E. 
No person seeking appointment to, or promotion in, the Police Department shall, either directly or indirectly, give, render or pay any money, service or other valuable thing to any person, for or on account of, or in connection with his/her examination, appointment, proposed appointment, promotion or proposed promotion.
F. 
No member of the Police Department shall continue in such position after becoming a candidate for election to any City office.
G. 
Any Police Officer or Police Cadet who violates any provision of this Section shall forfeit his/her position in the Police Department.

The Chief of Police shall be ex officio Sergeant-At-Arms of the City Council, shall attend its meetings, preserve order in the Council Chamber and execute the Council's orders, notices and mandates.

A. 
It shall be the duty of Police Officers to file or make complaints before the City Attorney against all persons whom they have reason to believe are violating the ordinances of the City and report facts to same.
B. 
Every Police Officer and Police Cadet shall at all times hold himself/herself in readiness, on or off duty, to execute all lawful orders, rules and regulations made or prescribed by the Mayor and the Chief of Police.

A. 
Each Police Officer and Police Cadet shall be paid a uniform cleaning and maintenance allowance reimbursement of up to fifty dollars ($50.00) per month with receipt.
B. 
Each Police Officer and Police Cadet not designated as a plain-clothes Police Officer by the Chief of Police, while on duty, shall wear a uniform, badge and other equipment supplied by the City of Washington, Missouri, as described by Police Department policy or directed by the Chief of Police.

A. 
The Chief of Police shall be a qualified voter of the State of Missouri, and, have a Bachelor of Science or equivalent degree in criminal jurisprudence or equivalent field from an accredited college or university, or at least fifteen (15) years continuous service in a supervisory role in law enforcement. The Chief of Police shall also be eligible for State of Missouri Police Officers Standards and Training Commission certification.

B. 
All other Police Officers and Police Cadets shall be qualified voters of the State of Missouri and shall possess such other educational experience as the City Council may require from time to time.

A. 
The Mayor may, with the consent of a majority of the members elected to the City Council, remove from office for misbehavior any Police Officer or Police Cadet.
B. 
The City Council may, by a two-thirds (2/3) vote of the members elected to the City Council, remove any Police Officer or Police Cadet independently of the Mayor's approval or recommendation.
C. 
Any Police Officer or Police Cadet sought to be removed from office shall be notified of the reason for his/her removal by the City Clerk prior to the vote of removal. The Police Officer or Police Cadet shall not be entitled to a hearing before the City Council or to present witnesses but shall, upon his/her request, be entitled to address the City Council prior to the vote to remove him/her from office.

A. 
The Mayor may temporarily suspend, without pay, any Police Officer or Police Cadet for misbehavior for a period of not to exceed thirty (30) days on any one-year period of appointment. The reason for the suspension shall be stated in writing and given to the affected Police Officer or Police Cadet and the City Council.
B. 
The Mayor may, with the consent of a majority of the members elected to the City Council, temporarily suspend, without pay, any Police Officer or Police Cadet for misbehavior for a period to exceed thirty (30) calendar days on any one-year period of appointment. The reason for the suspension shall be stated in writing and given to the affected Police Officer or Police Cadet.
C. 
The Mayor may, with the consent of a majority of the members elected to the City Council, demote any Police Officer for misbehavior. The reason for the demotion shall be stated in writing and given to the affected Police Officer.
D. 
No Police Officer or Police Cadet suspended or demoted as provided herein shall be granted any hearing with the Mayor or City Council prior to the final decision to suspend or demote the Police Officer or Police Cadet.
E. 
Any suspension, demotion, or removal from office of any Police Officer or Police Cadet shall be final and no appeal shall be permitted from that decision before any board, commission, agency, tribunal or court.

A. 
There is hereby created a Special Police Force consisting of Special Patrol Officers.
1. 
The Mayor, with the consent of a majority of the members elected to the City Council, shall have the power to appoint to Special Police Officers from a list of eligibles submitted to the Mayor by the Chief of Police.
2. 
Special Patrol Officers may be called into active duty by the Mayor or Chief of Police to aid the Police Department in maintaining order within the City.
3. 
All Special Patrol Officers shall perform all assignments in uniform, except as directed by the Chief of Police.
4. 
All Special Patrol Officers shall attend training sessions as directed by the Chief of Police.
5. 
Special Patrol Officers shall be compensated in a manner established by the City Council. No Special Patrol Officer may accept any compensation or remuneration from any private individual, group or organization. Notwithstanding anything contained herein to the contrary, private individuals, groups or organizations may compensate the City for services provided by Special Patrol Officers pursuant to a contract with the City approved by the Mayor and City Council.
6. 
Special Patrol Officers shall wear uniforms, badge and other equipment supplied by the City. Special Patrol Officers shall wear insignia designating their status as Special Patrol Officers.
