A. 
Definitions. The following definitions shall be used in the interpretation and enforcement of this Section:
ACCOMPANIED BY AN ADULT
The act of walking with persons engaged in trick or treating as they proceed from door to door. For the purposes of this Section, trick or treaters shall be considered to be in the company of an adult if they remain within thirty-five (35) feet of an adult.
HALLOWEEN
The thirty-first (31st) day during the month of October in each year shall be designated as Halloween.
TRICK OR TREATING
The practice of door-to-door solicitation of candy or other food items on the evening of Halloween.
B. 
Time Established For Trick Or Treating. Trick or treating shall be permitted within the City of Ste. Genevieve between the hours of 6:00 P.M. and 8:30 P.M. on Halloween.
C. 
Age Limit. Trick or treating on Halloween shall be limited to those persons who are sixteen (16) years of age or under.
D. 
Accompanied By An Adult. All person under the age of fourteen (14) who are engaged in trick or treating shall be accompanied by a parent or other responsible adult of at least twenty-one (21) years of age.
E. 
Other Restrictions. It shall be unlawful for any person or persons to engage in trick or treating at any residence where a light is not burning therein.

A. 
Definitions. The following definitions shall apply to this Article:
FIREWORKS
Includes any combustible or explosive composition or any substance or combination of substances or article prepared for the purpose of producing a visible or an audible effect by combustion, explosion, deflagration or detonation and shall include blank cartridges, toy pistols, toy cannons, toy canes or toy guns in which explosives are used, the type of unmanned balloons which require fire underneath to propel the same, spud guns, firecrackers, torpedoes, skyrockets, Roman candles, Daygo bombs, sparklers or other device containing any explosive substance, except that the term "fireworks" shall not include model rockets and model rocket engines designed, sold and used for the purpose of propelling recoverable aero models and shall not include toy pistols, toy canes, toy guns or other devices in which paper and/or plastic caps manufactured in accordance with the United States Department of Transportation regulations for packing and shipping of toy paper and/or plastic caps are used and toy paper and/or plastic caps manufactured as provided therein, the sale and use of which shall be permitted at all times. Each package containing toy paper and/or plastic caps offered for retail sale shall be labeled to indicate the maximum explosive content per cap.
PERSONS
Includes individuals, firms, partnerships or corporations.
SALE OR DISPLAY
Includes exhibition, possession with intent to give away or sell or offer for sale within the City any squib, rocket, cracker, torpedo, grenade, gun, revolver, pistol, cap or cartridge or other combustible firecrackers or fireworks of any kind.
USE
Includes to set off or otherwise cause to explode or discharge or burn any firecrackers, torpedo, rocket or other fireworks or explosives of inflammable material or discharge them or throw them from land, water, air or roadway into any area of the City. This prohibition includes any substance, compound, mixture or article that in conjunction with any other substance or compound would be dangerous from any of the foregoing standpoints. This provision shall also mean and include casting, throwing, lighting or firing any squib, rocket, cracker, torpedo, grenade, gun, revolver, pistols, cap or cartridge or other combustible firecrackers or fireworks of any kind.
B. 
Prohibitions. Except as herein provided, it shall be unlawful for any person to sell or offer for sale, display or use fireworks within the City limits.
C. 
Penalty. Any person who fails to comply with or violates this Article shall be deemed guilty of a misdemeanor and shall be subjected to a fine and/or imprisonment as stated in Section 100.260 of the Code of Ordinances. Any fireworks seized or confiscated as a result of a violation of this Article may be disposed of by the City's Chief of Police.
D. 
Exemption. This Article shall not apply to:
1. 
The sale of any fireworks by wholesalers to each other or to the sale of any fireworks at wholesale to merchants conducting business without the City or to the sale by wholesalers to persons holding a valid permit for public demonstrations as provided herein, or
2. 
The sale, storage or use of railroad track torpedoes or other signaling devices used by railroad employees in the performance of their duties or to the sale, storage or use of flashlight composition by photographers or dealers in photographic supplies or to prevent any public demonstration or display of fireworks of any kind if conducted under proper Police supervision after application for a permit being made and issued by the Chief of Police for such demonstration.

A. 
The following shall apply to management and operation of the Ste. Genevieve City Cemetery (existing non-conforming permanent improvements shall be exempt):
1. 
Burial.
a. 
Only human remains may be interred in the cemetery.
b. 
Burial of human remains must be in a concrete vault or equivalent.
c. 
The remains of no more than two (2) bodies may be buried in a single lot.
d. 
If two (2) adult bodies are to be buried on a single lot, the grave must be dug no less than eight (8) feet in depth for the first (1st) burial. The owner of the lot shall let the City Clerk know that it was dug to eight (8) feet deep on the first (1st) burial. The City Clerk shall identify such on the map of the cemetery.
e. 
The grave for the burial of a single adult on a lot must be dug at least four and one-half (4.5) feet deep. The cremated remains of a second (2nd) individual may be buried above the original vault according to the rules for a cremated remains burial.
f. 
The grave for a child grave must be dug at least three (3) feet deep. If the child was buried before the adult, the party requesting a later adult burial in a double deep lot must request a written permission for disinterment from the City Clerk. The party requesting the second (2nd) burial is responsible for all costs for the disinterment, digging the grave to the required depth, and the interment of both vaults.
g. 
Cremated remains are to be buried in an approved container the grave dug at least three (3) feet deep. Scattering of ashes in the cemetery is prohibited.
h. 
In all the interments, the top of the vault or container shall be at least twelve (12) inches from the surface of the ground.
i. 
At the time of burial of a second (2nd) person on a single lot, the party requesting the second (2nd) burial must pay a ground disturbance fee at the rate published by the City prior to the interment.
j. 
Disinterment for any reason including the burial of a second (2nd) person's remains on a single lot according to the preceding burial rules without written permission from the City Clerk of the City of Ste. Genevieve is prohibited.
k. 
Pauper burial. If the estate of person to be buried in the City cemetery is unable to pay for the grave space and burial and shall satisfy the Mayor or City Administrator that the person is in fact unable to pay the same, the Mayor or City Administrator shall issue an order, in writing, authorizing the burial of said corpse in the cemetery at a place to be designated by the City Clerk. The City shall be the sole determiner regarding the method of burial.
2. 
Monuments.
a. 
Headstone monuments must be made of a permanent material and be placed by a professional monument company. Headstone monuments may be flat, angled, or upright. The company installing the monument must obtain approval from the City Clerk for the monument design and location prior to placing the monument.
b. 
The headstone monument must be centered on the lot and the back of the upright monument on the line of monuments for that row. The raised portion of any headstone monument including foundation must be at least six (6) inches minimum from either side of a single lot. An upright headstone monument must be at least four (4) inches high from the top surface of the foundation. A flat headstone monument must be no more than one (1) inch above ground level at any point. The front to back thickness of the raised portion of any headstone monument including the base must be sixteen (16) inches or less.
c. 
When a headstone monument serves two (2) or more single lots, a single headstone monument may be located centered on the two (2) lots and be no more than five (5) feet wide and sixteen (16) inches thick.
d. 
All headstone monuments on a single lot are to have a concrete foundation at least fourteen (14) inches deep. Foundations for headstone monuments that are centered over two (2) single lots are to have concrete foundations at least eighteen (18) inches deep. The foundation is to be level with the ground or if on sloping, the foundation is to be level with the ground on the uphill side. The foundation is to be sufficiently wide to support the headstone monument but the width may not be more than twenty-four (24) inches wide.
e. 
Nor more than one (1) footstone marker is allowed on a single lot. Footstone markers are to be no more than one (1) inch higher than the plane of the ground at any point and must be placed on a concrete foundation at least fourteen (14) inches in depth. The east edge of the footstone marker to be located on a line thirty (30) inches from the foot of the lot and centered left to right. Individual footstone markers may be no larger than twenty (20) inches wide and thirty-two (32) inches long including the visible part of the foundation.
f. 
Veterans' memorial plaques may also be permanently attached to the back side of the headstone monument.
g. 
If any monument headstone or footstone marker or its inscription is determined by the City to be offensive, the City shall have the right to deny placement of the offending item or if placed without approval, require the offensive item be replaced or altered at the patron's expense. Should the patron not comply, the City retains the right to remove the item.
h. 
Temporary markers are allowed up to a maximum of one (1) year after which they will be removed by the City without notice.
i. 
While the City will take all reasonable precautions to protect and maintain the gravesites within the cemetery from loss or damage, it is not responsible or liable for loss or damage beyond its control, such as that caused by natural elements, thieves, vandals and civil disorder.
3. 
Decorations.
a. 
Decorations are only allowed on the headstone monument and must be permanently attached to the monument except that flowers may be securely attached to the top of the headstone monument with appropriate wiring or placed in a vase or vases permanently secured to the headstone monument. Flowers are to be maintained and removed when they become faded and unsightly.
b. 
Funeral flowers may remain on the grave for a maximum of three (3) days after burial. After this time period, the City may remove the funeral flowers without notice.
c. 
Flags may only be placed on or beside a headstone monument between one (1) week prior to and two (2) weeks after Memorial Day, July fourth (4th), and Veterans Day. All flags not on or beside a headstone will be removed. Flags may be no larger than eighteen (18) inches by twelve (12) inches. All flags that are faded or torn or which contain offensive language or symbols, in the opinion of the City, will be removed by the City.
d. 
Grave blankets are allowed after November first (1st) but must be removed by March first (1st).
e. 
One (1) "eternal" or "memorial" type light is permitted per headstone monument. Only battery or solar operated styles that do not flash are allowed. The light must be securely mounted to the tombstone and be secured in such a manner that it cannot blow or fall off.
f. 
No plantings, glass or ceramic holders, balloons, private benches, shepherd's crooks, gravel or rocks around a monument, lot corner markers, lot edging or non-permanently attached items are allowed.
g. 
The City reserves the right to remove and dispose of flowers that have become unsightly or become detached from a monument without notice or compensation. The City also reserves the right to remove all non-conforming materials including an eternal or memorial light if it becomes a maintenance issue or exceeds the number allowed without notice or compensation.
4. 
Hours of operation and general rules.
a. 
The City Clerk must be notified between Monday and Friday from 8:00 A.M. to 5:00 P.M. at least twenty-four (24) hours prior to the burial ceremony or the placing of a monument.
b. 
The hours of operation will be dawn to dusk, year-round.
c. 
Behaviors that do not respect the solemnity of the cemetery are prohibited.
d. 
A dog must be on a leash at all times while on the premises and feces must be bagged and removed from the cemetery.
e. 
It is unlawful for any person maliciously to remove the earth from any grave or lot, or maliciously remove, injure, break, deface or damage any monument, tombstone or other fixture belonging to any grave, lot, fence, tree, shrub, flower, decoration in the cemetery.
