A person commits the offense of littering if he/she throws or
places or causes to be thrown or placed any glass, glass bottles,
wire, nails, tacks, hedge, cans, garbage, trash, refuse or rubbish
of any kind, nature or description on the right-of-way of any public
road or State highway or on or in any of the waters in this City or
on the banks of any stream or on any land or water owned, operated
or leased by the State, any board, department, agency or commission
thereof or on any land or water owned, operated or leased by the Federal
Government or the City, or on any private real property owned by another
without his/her consent.
Whoever willfully or maliciously poisons, defiles or in any
way corrupts the water of a well, spring, brook or reservoir used
for domestic or municipal purposes, or whoever willfully or maliciously
diverts, dams up and holds back from its natural course and flow any
spring, brook or other water supply for domestic or municipal purposes,
after said water supply shall have once been taken for use by any
person or persons, corporation, Town or City for their use, shall
be adjudged guilty of an ordinance violation and punished by a fine
not less than fifty dollars ($50.00) nor more than five hundred dollars
($500.00), or by imprisonment in the City or County Jail not exceeding
ninety (90) days, or by both such fine and imprisonment, and shall
be liable to the party injured for three (3) times the actual damage
sustained, to be recovered by suit at law.

A. Fireworks
authorized for sale in the State of Missouri will be permitted to
be sold by any merchant having a regular merchant's license and upon
payment of a fifteen dollar ($15.00) special fireworks license fee.
The application for a fireworks license shall be made at the office
of the City Collector. The application shall be presented to the City
Council at the next regular Council meeting to be considered for approval.
Upon the approval and issuance of the special fireworks license, the
applicant shall be authorized to conduct the sale of fireworks and
fireworks displays only on the premises of the applicant starting
June twenty-eighth (28th) and ending at Midnight of July fourth (4th)
of the particular year for which the license is issued.
B. It
shall be unlawful for any person to willfully fire or explode or cause
to be fired or exploded any fireworks within the City limits of the
City of Chaffee, Missouri, when such fireworks may be considered a
"stick rocket" as defined hereinbelow.

For the purposes of this Section, a "stick rocket" shall include the following:

1. "Skyrocket" which is a device containing a wooden
stick for guidance and stability and rises into the air upon ignition.
2. "Bottle rocket" which is a device similar to a skyrocket
in design but smaller with a wooden stick attached for guidance and
stability and rises into the air upon ignition.
3. "Missile type rocket" which is a device similar
to a skyrocket in size, composition, and effect that uses fins rather
than a stick for guidance and stability.

For all fireworks other than a "stick rocket" as described above,
it shall be unlawful for any person to fire or explode or cause to
be fired or exploded such fireworks:
|
a. Upon any street, alley, sidewalk, commons or public property; or
b. Upon any private property except that the same may be lawful on private
property between the hours of 9:00 A.M. and 9:00 P.M. beginning June
twenty-eighth (28th) and continuing through July third (3rd) and between
9:00 A.M. and 12:00 Midnight on July fourth (4th) of each year.

No fireworks shall be discharged or displayed after July fourth
(4th).

C. Civic
or non-profit organizations may be granted a special fireworks license
for the sale and display for sale of fireworks upon payment of the
fifteen dollar ($15.00) special fireworks license fee without the
requirement of having a regular merchant's license, provided however,
that the applicant being a civic or non-profit organization shall
apply to the City Council for the same stating the name of the organization,
the place of display and sale, and further provided that said application
be approved by the City Council. Upon approval, said civic or non-profit
organization shall comply with all provisions of this Section.
The City Council may make certain reasonable safety requirements
regarding the place and the manner in which such fireworks may be
sold and any special license issued under this Section shall be subject
to compliance with those conditions.
D. Notwithstanding
any other provision of this Section to the contrary, the City Council
may issue a permit for a special organized public fireworks exhibition
subject to such limitations and requirements as the City Council may
deem appropriate.
The City Council shall consider each application for a public
fireworks exhibition permit based upon all safety precautions that
may be necessary to protect the public from injury or property damage
and all matters relating to location, time, manner of discharge, the
skill and qualification of persons conducting the discharge and the
person or entity responsible for any and all damage or injury that
may occur as a result of such activity.
When said application is favorably acted upon by the City Council
and approved by the Mayor, a permit is to be issued by the City Clerk
in writing stating the name of the person organization sponsoring
the exposition, the place of the exposition and the date. The permit
shall state the time of the exposition, which in all cases must be
limited to a period of three (3) hours.
Each applicant for a permit for a public fireworks exhibition
shall complete an application form providing the following:
1. Full and complete name of person or organization sponsoring the public
fireworks exhibition;
2. Location where the fireworks exhibition will be conducted and specifically
where the fireworks will be discharged;
3. General description of the types of fireworks to be displayed;
4. Length of time anticipated from the first (1st) fireworks discharge
until the final fireworks discharge;
5. Names, addresses, ages and qualifications of all persons who will
be involved in supervising and discharging fireworks during the exhibition;
6. Name and address of party responsible in the event of injury to persons
or damage to property as a result of the fireworks exhibition.
