Floor assemblies for new single-family and two-family dwellings not otherwise required in the International Residential Code, 2009 Edition, to be fire resistance rated, shall be provided with a one-half-inch gypsum wallboard member with a rough tape, five-eighths-inch wood structural panel member or equivalent on the underside of the floor framing member with seams protected. There shall be no unprotected opening or penetrations in the membrane.
Floor assemblies located directly over a space protected by an automatic sprinkler system in accordance with NFPA 13D or other approved equivalent sprinkler system.
Floor assemblies located directly over a crawl space not intended for storage or fuel-fired appliances.
Portions of the floor assemblies can be unprotected when complying with fire blocking in accordance with Section R302.11.1 of the International Residential Code, 2009 Edition, and shall be installed along the perimeter of the unprotected portion to separate the unprotected portion from the remainder of the floor assembly.
Wood floor assemblies using solid sawn lumber or dimensional lumber equal to or greater than two-inch-by-ten-inch nominal dimension.
Penalty. Any person violating the provisions of this Article shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in an amount not exceeding one thousand dollars ($1,000.00) or be imprisoned in the City or County Jail for a period not to exceed ninety (90) days, or both such fine and imprisonment. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
