All motor vehicles and other personal property impounded by the City Police Department and unredeemed by the owner thereof for a period of thirty (30) days shall thereafter be subject to sale by the City Police Chief to the highest bidder for each at public auction; and the proceeds of said sale shall be applied first to all removal and storage charges accumulated against each article which shall be deposited with the City Collector and the balance of said sum, if any, shall be deposited with the City Collector and shall be kept in a separate fund for a period of six (6) months from the date of receipt. If at the end of said six (6) month period the former owner of said property has not made satisfactory proof of claim as provided in this Article, the balance of the proceeds of sale shall be credited to the General Fund of the City.

A. 
To Be Published. The City Police Chief shall cause to be published in a newspaper of general circulation within the City a notice of sale of abandoned vehicles and other unredeemed properties.
B. 
Contents. The notice of sale shall state:
1. 
The sale is of abandoned property and other unredeemed property in the possession of the City;
2. 
A description of the vehicle including the type, make and motor serial number and a brief description of all other unredeemed property;
3. 
The terms of the sale; and
4. 
The date, time and place of sale.
C. 
Times Of Publication. The notice of sale shall be published at least two (2) times. The first (1st) publication shall be made not less than fifteen (15) days prior to the date of the proposed sale and the second (2nd) shall be made not more than seven (7) days prior to the date of the proposed sale.

A vehicle or other unredeemed property subject to the provisions of this Article shall be sold to the highest and best bidder. At the time of payment of the purchase price, the Chief of Police shall execute a certificate of sale in duplicate, the original of which shall be given to the purchaser and the copy thereof to be filed with the City Collector. Should the sale for any reason be invalid, the City's liability shall be limited to the return of the purchase price.

A. 
Prior To Sale. The owner of any abandoned vehicle or other unredeemed property may redeem the vehicle or property at any time prior to the sale or destruction thereof upon the proof of ownership and payment of all removal and storage charge if any.
B. 
After Sale. After the sale of the abandoned or unredeemed property, the owner may make a claim for the proceeds of the sale, less all costs of storage, removal and cost of sale, upon furnishing City proof of ownership of the vehicle or property sold.

The Chief of Police shall conduct a sale of abandoned and other unredeemed properties at least once a year.

Any automobile, vessel, vehicle or item deemed abandoned, unclaimed or under these ordinances and being covered by insurance, where applicable, may be used by the Chief of Police or any agent or employee under his/her supervision for any law enforcement activities by the City or any law enforcement body working with the City or any law enforcement body of which the City is a member.

A. 
Deposit Of Found Property. All found property, excluding property that has been impounded or seized and held in the custody of a court, that is delivered to the Harrisonville Police Department, shall be properly marked or catalogued to show its source and date of receipt. Upon delivery to the Police Department, the finder shall be given a receipt with instructions on how to claim the property if the rightful owner does not come forward to claim the property within thirty (30) days. Neither the Police Department nor the City accepts ownership, custody or control of the property.
If, at the expiration of the initial thirty (30) day period, the rightful owner of the property has not claimed the found property, the property shall be returned to the finder. The finder shall have an additional thirty (30) days from the expiration of the initial thirty (30) day period to claim the found property. A finder that claims property pursuant to this Section shall comply with the provisions of Section 447.040, RSMo., to take legal ownership of the property.
B. 
Disposition Of Found Property. In the event neither the rightful owner nor the finder of the property claim the property pursuant to Section 220.265(A), the Police Department can dispose of the property in a manner deemed appropriate by the Police Chief. This shall include, but is not limited to, disposition by sale, destruction, return or donation. On the second (2nd) Saturday of each month, the Police Department shall post a list of all found property which has remained unclaimed for more than two (2) months and the owner of which is unknown, at City Hall or the Police Department. If the found property remains unclaimed for ten (10) days after posting of notice, the Police Chief will dispose of the property in a manner consistent with this Section. All proceeds from the disposition of any unclaimed property shall become a part of the General Revenue Fund of the City.
