For purposes of this Article, the following terms shall have
the meaning as indicated below:
An incinerator which complies with all current regulations
of the City and State air pollution control agencies.
Materials banned from disposal in a solid waste disposal
area under the provisions of the Missouri State Statutes: Currently
includes major appliances, waste motor oil, lead-acid batteries, unprocessed
waste tires and (beginning January 1, 1992) yard waste and (beginning
January 1, 1994) household hazardous waste in amounts to be determined
by the Missouri Department of Natural Resources.
Non-putrescible solid wastes, consisting of combustible and/or
non-combustible waste materials from dwelling units, commercial, industrial,
institutional or agricultural establishments, which are either too
large or too heavy to be safely and conveniently loaded in solid waste
transportation vehicles by solid waste collectors with the equipment
available therefore. Bulky items would include, but not be limited
to, appliances, furniture, tires, large auto parts, trees, branches,
stumps.
Place designated by the City where residents may drop off
recyclables for recycling.
The City of Harrisonville, Missouri.
A dwelling unit located within a medium-density apartment
complex of more than one (1) building meeting the requirements of
the Harrisonville zoning ordinance and within an area zoned "R-4"
(Medium-Density Residential District).
Removal and transportation of solid waste and recyclables
from its place of storage to its place of processing or disposal.
All solid waste except those items defined as bulk rubbish,
infectious waste, solid waste and special waste under this Section.
Yard waste such as grass clippings, leaves, vines, hedge
and shrub (including rose bushes) trimmings, tree trimmings and tree
limbs less than one (1) inch in diameter and no longer than four (4)
feet in length and/or other such organic materials from the yard.
A controlled process of microbial degradation of organic
material into a stable, nuisance free humas-like product.
Location adjacent to and not more than five (5) feet from
any street.
For the purpose of disposal in a permitted solid waste disposal
area, a waste tire is a tire cut in half circumferentially or cut
into at least four (4) equal parts with no part being larger than
approximately one-quarter (¼) of the original tire's size.
Waste materials from the construction or destruction of residential,
industrial or commercial structures.
The City Administrator of the City of Harrisonville or his/her
authorized representative.
To be provided.
Any room or group of rooms located within a structure and
forming a single habitable unit with facilities which are used or
are intended to be used for living, sleeping, cooking and eating.
Putrescible animal or vegetable wastes resulting from the
handling, preparation, cooking, serving or consumption of food.
Any waste or combination of wastes which, because of its
quantity, concentration or physical, chemical or infectious characteristics,
may pose a threat to the health of humans or the environment. Examples
include pesticides, acids, caustics, infectious wastes, flammable
or explosive materials, oils and solvents and similar chemicals and
materials and the containers and materials that have been contaminated
with hazardous waste.
Hazardous waste according to the above definition in small
amounts as determined by regulations of the Missouri Department of
Natural Resources setting the maximum amount of various substances
that are permitted under this classification.
A battery designed to contain lead and sulfuric acid with
a nominal voltage of at least six (6) volts and of the type intended
for use in motor vehicles and watercraft.
Clothes washers and dryers, water heaters, trash compactors,
dishwashers, conventional ovens, ranges, stoves, woodstoves, air conditioners,
refrigerators and freezers.
A housing facility containing more than one (1) dwelling
unit under one (1) roof.
Any person who, alone, jointly or severally with others,
shall be in actual possession of any dwelling unit or of any other
improved real property, either as owner or as a tenant.
Any individual, partnership, corporation, association, institution,
City, County, other political subdivision, authority, State agency
or institution, or Federal agency or institution.
All one-family to four-family dwellings located in the City.
Incinerating, composting, baling, shredding, salvaging, compacting
and other processes whereby solid waste characteristics are modified
or solid waste quantity is reduced.
Those materials which have been diverted or removed from
the solid waste stream for sale, use, reuse or recycling, whether
or not they require subsequent separation and processing.
The separation and reuse of materials which might otherwise
be disposed of as solid waste.
A process by which recyclable and recoverable material is
removed from the waste stream to the greatest extent possible, as
determined by the department and pursuant to department standards,
for reuse or remanufacture.
Any formed or molded container made of polymeric organic
compounds and additives, intended for single use, having a relatively
inflexible, finite shape with a capacity of between eight (8) ounces
and five (5) gallons and (beginning January 1, 1992) labeled with
a plastic resin code.
A solid waste disposal area which accepts commercial and
residential solid waste.
For the purpose of disposal in a permitted solid waste disposal
area, it means a tire that has been reduced to parts no larger than
these in the definition of a cut tire.
Garbage, refuse and other discarded materials including,
but not limited to, solid and semi-solid waste materials resulting
from industrial, commercial, agricultural, governmental and domestic
activities but does not include hazardous waste as defined in Sections
260.360 to 260.432, RSMo., (see "banned article"), recovered materials,
overburden, rock, tailings, matte, slag or other waste material resulting
from mining, milling or smelting.
Receptacle used by any person to store solid waste during
the interval between solid waste collections.
Any area used for the disposal of solid waste from more than
one (1) residential premises or one (1) or more commercial, industrial,
manufacturing, recreational or government operations.
The entire process of managing solid waste in a manner which
minimizes the generation and subsequent disposal of solid waste, including
waste reduction, source separation, collection, storage, transportation,
recycling, resource recovery, volume minimization, processing, market
development, and disposal of solid wastes.
Any facility where solid wastes are salvaged and processed,
including:
Items which, by their very nature, can cause health problems
or injury to individuals including, but not limited to, solvents,
insecticides, cleaning agents, heavy metals, prescription drugs, explosives,
incendiaries, motor oils, refrigerants, infectious waste and any materials
prohibited by the City's Fire Code.
Keeping, maintaining or storage of solid waste from the time
of its production until the time of its collection.
The transporting of solid waste from the place of collection
or processing to a solid waste processing facility or solid waste
disposal area.
Limbs between one (1) inch and six (6) inches in diameter.
A tire that is no longer suitable for its original intended
purpose because of wear, damage or defect.
Leaves, grass clippings, yard and garden vegetation and Christmas
trees. The term does not include stumps, roots or shrubs with intact
root balls.

The City shall undertake the responsibility to provide a solid
waste management system for all residential dwelling units within
the City, with the exception that all multi-family properties with
more than two (2) Dwelling Units and all Trailer Park Dwelling Units
will be served at the discretion of the Utilities and Code Enforcement
Departments, and utility trash collection fees adjusted accordingly.

The City shall provide for a solid waste management system by
contracting with an independent contractor, person or firm. All work
will be done in accordance with the contract documents, general provisions
and collection specifications as prepared by the City Administrator
and approved by the Board of Aldermen.

The owner or occupant of any housing unit consisting of four
(4) dwelling units or less are encouraged to separate recyclable materials
from all other solid waste and place such recyclable materials at
curbside for collection. Proper material preparation shall be the
responsibility of the owner or occupant. It shall be the responsibility
of the recyclable collector to provide suitable containers for recyclable
materials other than yard wastes to each household served.

It shall be unlawful for persons, firms or corporations not
licensed by the City and not under contract with the owner or resident
to remove any item including, but not limited to, newspapers, aluminum
or tin cans, glass or plastic placed in or adjacent to curbside recycling
containers.

The City is hereby authorized to fix, levy and collect a monthly
service charge per dwelling unit for solid waste management services
from the occupant or owner of every residential dwelling unit in the
City, excepting clustered multiple-family and trailer park dwelling
units. Said monthly service charge shall be added as a separate charge
to the utility bill of each occupant or owner. For those bills that
include utility charges for more than one (1) dwelling unit, the charge
for solid waste services shall be the monthly service charge multiplied
by the number of dwelling units included on the utility bill. For
each dwelling unit not served by City utilities, a bill will be issued
to the occupant of each dwelling unit for the monthly service charge.
The applicability of this Article to any particular dwelling unit
shall be determined by the City Administrator. Said monthly service
charge shall be as determined by the Board of Aldermen in an amount
appropriate and necessary to pay the expenses required to operate
and maintain such services.

A.
Containers. The occupant of every dwelling unit producing solid waste
within the corporate limits of the City shall provide adequate and
sufficient approved disposable or non-disposable containers for the
storage of all solid waste, except bulky rubbish, and maintain such
solid waste containers in good repair and the area surrounding them
in a clean, neat and sanitary condition at all times. Containers shall
be leakproof and waterproof. Containers which are to be manually lifted
shall not exceed fifty-five (55) gallons in capacity, except that
fifty-five (55) gallon metal or fiber barrels are not approved containers.
Non-disposable solid waste containers which are not approved as outlined
above will be collected, together with their contents, and disposed
of. The weight of any individual container and contents shall not
exceed sixty-five (65) pounds. Waste containers shall be placed at
the curb line or at the roadway, but the householder shall not place
or allow said garbage or rubbish or solid waste container or bulky
rubbish to be placed there prior to 5:00 P.M. on the day preceding
the collection of same and shall not leave such solid waste container
or bulky rubbish there after 9:00 P.M. on the day of collection.
Except for the aforementioned times, all solid waste containers
and bulky rubbish not kept or stored in inside dwelling units, garages
or accessory building structures and kept or stored outside in front
yards or side yards shall be a maximum of two (2) feet from the front
walls or side walls of the dwelling unit, garage, or accessory building
structure.
All bulky rubbish, except for trees, branches, or stumps, shall
be collected and/or removed within one (1) day of being kept or stored
outside. Trees, branches, or stumps shall be collected and/or removed
within seven (7) days.
B.
Tree Limbs. Tree limbs shall be trimmed, cut and securely tied in
bundles less than four (4) feet in length and two (2) feet in thickness.

A.
It
shall be unlawful for any person to:
1.
Deposit residential solid waste in any solid waste container other
than his/her own;
2.
Fail to have residential solid waste collected as provided in this
Article;
3.
Interfere in any manner with solid waste collection equipment or
with the solid waste collectors in the lawful performance of their
duties;
4.
Burn solid waste; or
5.
Violate any other provision of this Article.

The system of services established by the provisions of this
Article is designed as an integral part of the City's program of health
and sanitation. The City may enforce collection of the residential
solid waste monthly service charge by bringing proper legal action
against the occupant or owner of any dwelling unit to recover any
sums due for said services plus a reasonable attorney's fee to be
fixed by the court plus the cost of such action.
