A. 
There is hereby adopted a second amended map of controlled parking areas for the Downtown Business District called "Amended Map Number 2 of Controlled Parking Areas, Downtown Business District, City of Bolivar, Missouri," which may be referred to as the second amended map of controlled parking areas and which shall be kept on file by the City Clerk of the City of Bolivar, Missouri, and identified by his/her signature or initials. Such map and all notations, references and other information shown thereon are hereby made a part of this Chapter by reference and shall have the same force and effect as if the map and all notations, references and other information shown therein were fully set forth or described herein at length. All blocks have been numbered on said map in accordance with the original plat of the Town, now City of Bolivar, Missouri, and each parking space within each block has been designated with a number.
B. 
There is hereby adopted a second amended map of controlled parking areas for the Downtown Business District called "Amending Amended Map No. 2 of Controlled Parking Areas, Downtown Business District, City of Bolivar, Missouri," which may be referred to as the second amended map of controlled parking areas and which shall be kept on file by the City Clerk of the City of Bolivar, Missouri, and identified by his/her signature or initials. Such map and all notations, references and other information shown thereon are hereby made a part of this Chapter by reference and shall have the same force and effect as if the map and all notations, references and other information shown therein were fully set forth or described herein at length. All blocks have been numbered on said map in accordance with the original plat of the Town, now City, of Bolivar, Missouri, and each parking space within each block has been designated with a number.

Spaces 10 and 11 in Block 20 are hereby changed from zone 2 to zone 4.
2. 
Spaces 7, 8, 9 and 13 in Block 32 are hereby changed from zone 1 to zone 13.
3. 
Space 12 in Block 32 is hereby changed from zone 1 to zone 8.
4. 
A new parking space numbered 18 shall be inserted on the south side of Block 7 immediately west of space 17 and is hereby designated as a zone 13 space.
5. 
Space 9 in Block 7 is hereby changed from zone 4 to zone 8.
6. 
A new space lying east of space 10 in Block 7 is hereby created to be known as space 9A and is hereby designated as a zone 4 space.
7. 
The southern most parking space on the west side of Block 7 is hereby numbered 19 and is designated as zone 2.
8. 
One (1) new space to be known as space 38 is hereby inserted west of space 32 in Block 14 and said space is hereby designated as zone 4.
9. 
Space 18 in Block 8 is hereby changed from zone 15 to zone 13.
10. 
Space 24 in Block 8 is hereby changed from zone 4 to zone 2.
11. 
Space 23 in Block 8 is hereby changed from zone 13 to zone 2.
12. 
Space 32 of Block 18 is hereby changed from zone 4 to zone 13.

Space 38 of Block 18 is hereby changed from zone 13 to zone 2.

Space 6 Block 20 is hereby changed from zone 4, two (2) hour parking, to zone 13, handicapped parking.

Parking zones to accommodate either parallel or angle parking as shown and established on the second map of controlled parking areas are hereby adopted. The spaces shown thereon are drawn to the scale designated and the size, location and angle (if appropriate) of such spaces are hereby adopted as designated on said second amended map.

No person shall park a motor vehicle in any controlled parking area except in compliance with the provisions of this Chapter; nor in any area designated as a no parking zone; nor except entirely within an area designated as a parking zone or for a period of time in excess of the limitations hereby imposed. However, nothing contained herein shall be construed as any other Code Sections pertaining to the removal of any vehicle left continuously and unattended upon any street for a period of more than forty-eight (48) hours and the provisions of said Section are hereby extended and adopted by reference as to vehicles left continuously and unattended in any designated parking area of the second map of controlled parking areas hereby adopted.

For the purpose of this Chapter, the movement of a vehicle from a parking space followed within a period of five (5) minutes or less by the movement of the same vehicle into the same parking space shall not be deemed as a vacation of the space and the vehicle shall be considered as occupying that space as if no movement had been made.

It shall be unlawful for any person to attempt to deceive a parking officer by erasing tire markings by hand, by movement of the vehicle or otherwise, when such tire markings are placed thereon by an officer of the City to indicate the length of time that a vehicle has been parked in a particular space. Evidence of movement of a vehicle from and to the same space within a period of five (5) minutes shall presumptively be an attempt to deceive a parking officer in violation of this Section.

A. 
The following time limitations are hereby imposed in each parking zone as established on the map of controlled parking area heretofore described:
1. 
In any zone designated on said map with the No. 1, there shall be no time limitation for parking of motor vehicles.
2. 
In any zone designated on said map with the No. 2, the time limitation shall be fifteen (15) minutes for the parking of motor vehicles between the hours of 8:00 A.M. to 5:00 P.M. There shall be no time limitation at other hours.
3. 
In any zone designated on said map with the No. 3, the time limitation shall be thirty (30) minutes for the parking of motor vehicles between the hours of 8:00 A.M. to 5:00 P.M. There shall be no time limitation at other hours.
4. 
In any zone designated on said map with the No. 4, the time limitation shall be two (2) hours for the parking of motor vehicles between the hours of 8:00 A.M. to 5:00 P.M. There shall be no time limitation at other hours.
5. 
In any zone designated on said map with No. 5, there shall be a time limitation of two (2) hours from 8:00 A.M. to 5:00 P.M. on weekdays; 8:00 A.M. to 12:00 Noon Saturdays and Sundays; and no parking at any other time.
6. 
In any zone designated on said map with the No. 6, there shall be no parking except by the Polk County Sheriff, his/her Deputies or employees while on duty or by the courthouse custodian while on duty.
7. 
In any zone designated on said map with the No. 7, there shall be no parking except by taxis who have previously been authorized by the Board of Aldermen of the City of Bolivar to occupy said spaces.
8. 
In any zone designated on said map with the No. 8, there shall be no parking at any time.
9. 
In any zone designated on said map with the No. 9, there shall be a time limitation of four (4) hour parking from 8:00 A.M. until 5:00 P.M. There shall be no time limitation at other hours.
10. 
The zones designated on said map as zone 10, private parking, public parking permitted and 11, private parking, restricted by owner, are references only and enforcement of parking thereon shall be covered by other ordinances of the City as they now exist or as they may be amended from time to time.
11. 
In any zone designated by the No. 12, there shall be no parking at any time between the hours of 9:30 P.M. and 5:00 A.M. except by special parking permits issued by the Police Chief of the City of Bolivar, Missouri, or a duty officer under the following circumstances:
a. 
For participants in civic or festive occasions that are scheduled past the hour of 9:30 P.M.;
b. 
For participants in business, commercial or civic functions where parking in zone 12 is reasonably required to accommodate the anticipated motor vehicles and such function is expected to last past the hour of 9:30 P.M.;
c. 
To transients with trailers, mobile homes, campers and like vehicles that require parking space overnight.
During the hours, there shall be no time limitations.
12. 
In any zone designated by the No. 13, there shall be no parking at any time except by vehicles which display a distinguishing license plate or placard issued by the Missouri Director of Revenue, pursuant to the provisions of Sections 301.071, RSMo., as amended, and 301.142, RSMo., as amended, or as either of those Sections may hereafter be amended from time to time, to "disabled veterans" and the "physically disabled" as those terms are defined in said Sections. Between the hours of 8:00 A.M. and 5:00 P.M., parking in zone 13 spaces by authorized persons shall be limited to a maximum of two (2) hours. At other hours, there shall be no time limitation. Each space designated as a space 13 shall be so indicated by blue paint on the curb or edge of the paved portion of the street adjacent to the space and by a sign upon which shall be inscribed the international symbol of accessibility and the words "Handicapped Parking" in white on a blue background.
13. 
In any zone designated by the No. 14, there shall be no parking at any time between the hours of 8:00 P.M. and 6:00 A.M.
14. 
In any zone designated on said map with the No. 15, the time limitation shall be fifteen (15) minutes for the parking of motor vehicles between the hours of 5:00 P.M. and 12:00 Midnight.

If a violator of the restrictions on stopping, standing or parking under this Title do not appear in response to a traffic citation affixed to such motor vehicle within the specified time of citation, the Clerk of the Municipal Court shall send to the owner of the motor vehicle to which traffic citation was affixed a notice by mail informing him/her of the violation and warning him/her that in the event such notice is disregarded for a period of five (5) days, a warrant of arrest will be issued.

There shall be a rebuttable presumption that the person or persons in whose name(s) a motor vehicle parked in violation of this Chapter is registered committed the violation, but in the event that charges are filed against multiple owners of a motor vehicle, only one (1) of the owners may be convicted and costs assessed against only one (1) of the owners. If the vehicle which is involved in the violation is registered in the name of a rental or leasing company and the vehicle was rented or leased to another person at the time of the violation, the rental or leasing company may rebut the presumption by providing the Police Department or City Attorney with a copy of the rental or lease agreement in effect at the time of the violation. The City Attorney shall not bring any legal proceedings against the rental or leasing company under this Section unless prior written notice that the violation has been given to the leasing company by registered mail at the address appearing on the registration and the rental or leasing company has failed to provide the rental or lease agreement copy within fifteen (15) days of receipt of such notice. Any lessee shown on a copy of the rental or lease agreement during the period of time when the violation occurred shall be rebuttably presumed to be the person who committed the violation.

The Chief of Police and all City Policemen are hereby authorized to remove and tow away or have removed and towed any vehicles parked in a parking zone designated 5, 6, 7 and 8 in violation of the provisions of this Chapter and any vehicle so towed shall be returned to the owner or other person entitled to the possession thereof only after payment of charges incurred for the towing and storage of such vehicle. This Section shall not be construed as repealing, amending or limiting other ordinances of the City of Bolivar pertaining to the towing of illegally parked motor vehicles.

In any parking zone designated 2, 3, 4 or 9, each fifteen-minute, thirty-minute, two-hour or four-hour period additional, respectively, that a vehicle remains parked in violation of the provisions of this Chapter be a separate violation thereof.

Anything contained herein to the contrary notwithstanding, no truck with a manufacturer's rating of one (1) ton or more shall be parked in any parking zone designated on the map of controlled parking areas at anytime except for those parking zones located within an area designated at a City parking lot and shall not park within such lots if the parking thereof shall interfere with the usual traffic movement within said parking lot or shall take up or prevent the parking within more than two (2) parking zones.

All references in Sections 370.031 through 370.080 to parking zones, to the map of controlled parking areas or similar references shall be deemed a reference to the Amended Map Number 2, Controlled Parking Areas, City of Bolivar, Missouri.

A. 
Whenever any motor vehicle without a driver is found parked or stopped in violation of any of the restrictions imposed by this Chapter, the officer finding such vehicle shall take its registration number and may take any other information displayed on the vehicle which may identify its user, and shall conspicuously affix to such vehicle a traffic citation, on a form provided by the City, for the driver or registered owner to answer the charge against them during the hours and at a place specified in the citation.
B. 
Upon conviction of a violation of the restrictions imposed by this Chapter, the violator will be punished pursuant to the following fine schedule:
1. 
For the violator's first, second, third, fourth, and fifth violation occurring in a given calendar year, a fine of ten dollars ($10.00) for each such violation; and
2. 
For the violator's sixth, seventh, eighth, ninth, and tenth violation occurring in a given calendar year, a fine of twelve dollars ($12.00) for each such violation; and
3. 
For the violator's eleventh, twelfth, thirteenth, fourteenth, and fifteenth violation occurring in a given calendar year, a fine of fifteen dollars ($15.00) for each such violation; and
4. 
For the violator's sixteenth and each subsequent violation occurring in a given calendar year, a fine of twenty dollars ($20.00) for each such violation.
