A certain document, three (3) copies of which are on file in the office of the City Clerk of the City of Salem, Missouri, being marked and designated as the International Building Code, 2012 Edition, including Appendix Chapters C, F, H, I, and K, as published by the International Code Council, be and is hereby adopted as the Building Code of the City of Salem, in the State of Missouri, for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code on file in the office of the City of Salem, Missouri, are hereby referred to, adopted, and made a part hereof, as if fully set out in this legislation, with the additions, insertions, deletions and changes, if any, prescribed in Subsection (B) of this Section.
B. 
The following sections are hereby revised:
1. 
Section 101.1. Insert: City of Salem, Missouri, in place of (Name of Jurisdiction).
2. 
Section 105.1.1 and 105.1.2. Delete.
3. 
Section 105.2.
Subsection 2: Delete "7 feet" and replace with "3 feet."
Subsection 4: Delete.
Subsection 6: Delete.
Subsection 9: Delete and replace with "Prefabricated swimming pools accessory to a Group R-3 occupancy that are installed entirely above ground."
4. 
Section 107.1. Delete a portion of the paragraph limited to the following statement "where required by the statutes of the jurisdiction in which the project is to be constructed" and replace with "when required by the building inspector."
5. 
Section 110.3.7. Shall be amended to include "Where required by the Building Official" at the beginning of the Section.

Section 113. Delete the entire provision and replace with the following:
All appeals of orders, decisions or determinations made by the Building Official relative to the application of this code, all appeals shall be heard and governed by the provisions of Section 520.960 of this Code.

A certain document, three (3) copies of which are on file in the office of the Building Inspector of the City of Salem, Missouri, being marked and designated as the International Residential Code, 2012 Edition, including Appendix Chapters A, B, C, F, G, H, J, N, P, Q, as published by the International Code Council, be and is hereby adopted as the Residential Code of the City of Salem, in the State of Missouri for regulating and governing the construction, alteration, movement, enlargement, replacement, repair, equipment, location, removal and demolition of detached one- and two-family dwellings and multiple single-family dwellings (townhouses) not more than three (3) stories in height with separate means of egress as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Residential Code on file in the office of the City of Salem, Missouri, are hereby referred to, adopted, and made a part hereof, as if fully set out in this Section, with the additions, insertions, deletions and changes, if any, prescribed in Subsection (B) of this Section.

A. 
The City of Salem, Missouri, shall adopt the following rate schedule for the issuance of permits and collection of fees pertaining to the adoption of the 2012 International Building Codes, International Plumbing Codes, International Mechanical Codes, International Residential Codes and International Fuel Gas Codes.

Commercial Plan Review Fee
A commercial plan review fee is required in addition to the building permit fee. The plan review fee is 65% of the building permit fee. The sum of the fees is the total dollar amount required for permit issuance.

This deposit shall be refunded after final inspection has been approved under a valid and current permit. Should the permit expire or final inspection not be obtained and approved within this timeframe, the deposit shall be forfeited.
Permits/Inspections are Required
When construction has commenced without a permit, the permit fee shall be twice the original amount to cover the additional inspections and the time necessary to insure compliance with the code. When construction has begun under the authorization of a permit, but the permit holder has failed to obtain the required inspection, and the construction has passed the stage in which the inspection can be reasonably done, then an additional 25% of the original permit fee ($25 minimum) will be charged.
*Applicable flat rate permits will be at an additional cost.
