A. 
Without inspection and maintenance of siltation/erosion control measures, erosion and siltation control measures will not remain effective for long periods of time. Without proper training of inspection staff and effective records of results of inspections, it is difficult to determine what maintenance is required.
B. 
The Inspector Needs To Fully Understand The SWPPP. The SWPPP is more than just words and symbols on a piece of paper; it is a blueprint for contractors to follow. The inspector must know the implementation schedules, know where and when BMPs are to be installed, know what BMPs are to be maintained or eliminated and fully understand the limitations of BMPs.
C. 
The contractor needs to be informed by their inspector or an independent inspector, if used, of any non-compliance or violation issues. It is recommended that the inspector meet at least weekly with the contractor(s) to avoid problems that might lead to non-compliance issues. Also, the inspector must be cognizant of his/her responsibilities relative to identifying where modifications to the SWPPP are needed and recognize when it is necessary to involve owners, designers and regulatory personnel in modifications to the SWPPP or concerns about the operation of the SWPPP. Open and regular communication with all companies and agencies is essential.
D. 
The inspector also needs to be aware of appropriate contacts regarding maintenance of BMPs or other concerns. At some points of the project, the developer's land development personnel may be the sole contact, at other stages of construction, it may be necessary to communicate with personnel responsible for building construction.
E. 
General inspection guidelines follow to provide some additional guidance to the inspector. These guidelines are provided as a tool for the inspector's use and do not attempt to address all items that can be included on a specific SWPPP. The importance of reporting the results of inspections and follow up with appropriate personnel cannot be stressed enough.

A. 
The inspector is responsible for:
1. 
Inspecting the site to ensure proper installation, operation and maintenance of BMPs;
2. 
Performing inspections weekly and within twenty-four (24) hours during the workweek and forty-eight (48) hours on weekends of rainfall in excess of five tenths (0.5) inches;
3. 
Determining the overall effectiveness of the SWPPP;
4. 
Determining the need for additional control measures;
5. 
Promptly notifying the permittee responsible for operation and maintenance of BMPs of the deficiencies found during an inspection;
6. 
Notifying the permittee promptly of any situation requiring immediate action;
7. 
Noting corrective actions taken; and
8. 
Notify permittee to report any non-compliance, off-site discharge to the County.
B. 
The inspector should have detailed knowledge about the site specific SWPPP, particularly:
1. 
The location and type of control measures;
2. 
The construction requirements for the control measures;
3. 
Spill prevention and cleanup measures; and
4. 
Inspection and maintenance record keeping requirements.
C. 
The inspector should determine the following from the inspection:
1. 
The effectiveness of each BMP;
2. 
The maintenance that needs to be performed on the BMP; and
3. 
The need for revisions to the SWPPP.
D. 
General items to inspect:
1. 
BMPs installed in timely fashion;
2. 
BMPs installed/performing correctly;
3. 
Any damage to BMP noted;
4. 
Has maintenance been performed;
5. 
Is the BMP still effective;
6. 
Phasing being followed;
7. 
Note areas where grading activities have started/stopped;
8. 
Areas stabilized within fourteen (14) days of work being halted;
9. 
Removal of BMPs that are no longer required; and
10. 
Evaluate need for revision to SWPPP.
E. 
Areas To Inspect:

A. 
Power to vary or modify the standards; contained in this Chapter, in accordance with exceptional conditions stated in Subsection (B) below.
1. 
The Public Works Director ("Director") shall have the power to vary or modify the standards contained in Section 505.500(A)(1) in accordance with exceptional conditions stated in Subsection (B) below;
2. 
The Planning and Zoning Commission ("Commission") shall have the power to vary or modify the standards contained in this Chapter, with the exception of standards outlined in Section 505.950(A)(1) detailed in accordance with exceptional conditions stated in Subsection (B) below.
B. 
To be granted a variance, an applicant must show the following:
1. 
The variance requested arises from a condition which is unique and peculiar to the property in question and is not created by an action or actions of the property owner or applicant.
2. 
Where, by reason of exceptional narrowness, shallowness, shape or topography or other extraordinary or exceptional situation or condition of a specific piece of property, the strict application of the provisions of the regulations complained of will constitute peculiar and exceptional difficulties to or exceptional and demonstrable undue hardship upon the owner of the property, as an unreasonable deprivation of use as distinguished from the mere grant of a privilege.
3. 
The variance requested will not cause substantial detriment to the public health, safety, morals and general welfare of the community nor will it cause damage to other property in the area.
4. 
The granting of the variance will not substantially impair the intent, purpose and integrity of the zone plan as embodied in the UDO.
C. 
In granting a variance, the Commission or Director:
1. 
May impose such conditions, safeguards and restrictions or require improvements upon the premises benefited by the variance as may be necessary to reduce or minimize any potentially injurious effect of the variance upon other property in the neighborhood and to carry out the general purpose and intent of these regulations.
2. 
Shall require the variance, where appropriate, to be recorded with the County Recorder of Deeds by the Planning Division and any costs of recording be paid by the applicant to be effective.
3. 
May require the applicant to guarantee the installation of required improvements. The guarantee shall be secured by an instrument acceptable to the County in an amount that shall be based on a general estimate of cost for the required improvements as determined by the Director and shall be enforceable by or payable to the County in the sum equal to the cost of constructing the required improvements. In place of a security instrument, the Board may set the effective date for the variance as subsequent to completion of the conditions, safeguards and restrictions.
4. 
In lieu of the secured guarantee or delayed effective date, the Commission or Public Works Director may specify a time limit for completion of the required improvements and in the event the improvements are not completed within the specified time, the Commission may, at a regularly scheduled meeting and after notice to applicant, revoke the approval of the variance.
5. 
Shall issue an order stating the findings of fact and conclusions of law for reaching the decision.

Any person, official or agency who is aggrieved by a final decision at the Planning and Zoning Commission with respect to this Chapter 505, and who desires to appeal the decision, shall file the appeal in the Circuit Court within thirty (30) days after the decision is made. When an order is adopted memorializing the decision, the appellant has thirty (30) days from the date the order is adopted to final an appeal.
