The City Attorney and the Prosecuting Attorney shall be appointed by the Mayor, with the approval of the majority of the members of the Board of Aldermen, and shall serve in such capacities with the approval of the Mayor and the majority of the Board of Aldermen. The City Attorney and the Prosecuting Attorney shall have been admitted to practice before the highest court of the State.

A. 
It shall be his/her duty to advise the Board of Aldermen and the Mayor and other City Officers on all legal matters pertaining to the affairs of the City, and he/she shall be required to attend all meetings of the Board of Aldermen.
B. 
It shall also be the duty of the City Attorney to prosecute and defend all suits at law or at equity, that may be brought by or against the City.

It shall be the duty of the Prosecuting Attorney to prosecute in the Municipal Court of the City and on behalf of the City, all violations of the provisions of this Code. He/she shall advise the Police Judge of the law involved in the case and may urge upon the court, on behalf of the City, the action he/she seeks to have the court take in the matter. The Prosecuting Attorney shall handle all appeals from the Municipal Court to the Circuit Court of St. Louis County, Missouri.

The Mayor, with the approval of the majority of the Board of Aldermen, may contract specially with the City Attorney for special compensation in addition to the salary of such City Attorney for special services on behalf of the City. The determination by the Mayor and a majority of the Board of Aldermen shall be conclusive on the question of whether such services are special.

The Mayor, with the approval of a majority of the Board of Aldermen, may by ordinance, employ special counsel to assist the City Attorney in special cases, or to serve the City in case of a vacancy in the office of City Attorney. The Mayor and a majority of the Board of Aldermen shall, in the case of such employment of additional counsel, contract with such additional counsel for remuneration for service rendered or to be rendered by such special counsel.
