Editor's Note: This ordinance also provided for the repeal
of former Ch. 387, Fees, adopted 8-11-2004 by Ord. No. BOH 04-02,
as amended.
The following fees are hereby established and shall be paid
by the licensee or permittee before the issuance of a license or permit.
A.
For retail food handling establishments, including liquor stores,
delicatessen stores, meat markets (whether or not the establishments
are also the manufacturers), and mercantile licenses: a fee of $125
annually.
C.
For bakeries: a fee of $160 annually.
D.
For food caterers: a fee of $160 annually.
E.
For vending machines dispensing any food: a fee of $50 for the first
machine and $25 for each additional machine, owned by the same licensee,
annually.
F.
For vending trucks dispensing any food: a fee of $95 for each truck
annually.
G.
For confectionery stores dealing in packaged candy, ice cream and
similar products: a fee of $100 annually.
H.
For proprietary nursing homes: a fee of $400 annually.
I.
For nursery schools: a fee of $200 annually.
J.
For pet shops: a fee of $125 annually.
L.
For supermarkets, a self-service retail establishment with the total
area being measured from wall to wall in the interior measuring over
5,000 square feet: a fee of $525 annually.
N.
For temporary retail food licenses for special events taking place
once per week occurring on consecutive weeks:
O.
For the issuance of a burial permit: the statutory fee of $5.
P.
For the issuance of a certified transcript of a vital record for
any marriage, civil union, domestic partnership, birth or death: a
fee of $25 per transcript; each additional transcript issued at the
same time to the same person for the same record: a fee of $2 each.
Q.
For the issuance of a marriage license: a fee of $28.
R.
For the issuance of a domestic partnership: a fee of $28.
T.
For tanning salons: a fee of $200 annually.
U.
For permanent
cosmetics, including but not limited to microblading and camouflage:
a fee of $200 annually.

A.
All licenses shall be issued before the calendar year commencing
January 1 and shall be obtained or renewed not later than January
15 in any calendar year.
B.
A late charge of 50% will be added to the license fee if not renewed
by February 15 of that same year.
C.
When a licensee requires the issuance of an interim, conditional
or temporary license, the Board of Health shall be entitled to charge
a processing fee of $100 for each such issuance.
D.
When a licensee requires additional inspections due to a conditionally satisfactory Chapter 24 inspection rating, payment shall be in accordance with the following schedule:

When a licensee requires additional inspections due to a unsatisfactory Chapter 24 inspection rating, payment shall be in accordance with the following schedule:

Applicants for licenses or permits shall furnish any and all information
required by the Board. Any false or misleading information shall constitute
sufficient cause to refuse to issue a license or for revocation of
a license already issued.
Conducting any business or performing any work which shall require
a license or permit without first obtaining such license or permit
shall constitute a violation of this chapter. A single transaction
shall constitute "doing business" hereunder.
Any person, firm or corporation violating or failing to comply
with any of the provisions of this chapter shall be liable for a penalty
of not less than $25 nor more than $500 for each offense.
The provisions of any ordinance or any part of any ordinance
inconsistent herewith are hereby expressly repealed as to such inconsistency.
In addition, the following ordinances or sections of ordinances are
hereby expressly repealed:
A.
An ordinance entitled, "An Ordinance Establishing Certain Fees to
be Charged By The Board of Health of The Borough of Westwood," passed
August 11, 2004.
The Board may, subject to law, waive or reduce the license fee
or permit fee herein established in any particular case or class of
cases where the imposition of said fee would work a hardship or injustice
considering the costs of administration, regulation and inspection.
