A Planning and Zoning Commission for the City of Manchester is hereby established.

A. 
The Commission shall consist of not more than eight (8) members, including:
1. 
The Mayor, if the Mayor chooses to be a member; provided that the Mayor:
a. 
Shall choose within sixty (60) days of the certification of the election results by St. Louis County Board of Elections for the election in which the Mayor was elected or re-elected; and
b. 
If the Mayor chooses to be a member, they shall serve as a Commission member for the duration of the Mayor's term; or
c. 
If the Mayor chooses not to be or fails to choose within the time period allotted, the Mayor shall not serve on the Commission for the duration of the Mayor's term; and
2. 
A member of the Board of Aldermen selected by the Board of Aldermen, if the Board chooses to have a member serve on the Commission; and
3. 
Six (6) residents of the City of Manchester ("citizen members").
The citizen members shall be appointed by the Mayor and approved by a majority of the members of the Board of Aldermen present at the meeting at which the appointment is proposed. The citizen members of the Commission shall hold no other elective or appointive office of the City of Manchester. The term of each of the citizen members shall be for four (4) years, except that the terms of the citizen members first appointed shall be for varying periods so that succeeding terms will be staggered. Any vacancy in a membership shall be filled for the unexpired term by appointment as aforesaid. The Board of Aldermen may remove any citizen member for cause stated in writing and after public hearing.
B. 
The policy of the City is that at least two (2) citizen members shall be appointed from each ward of the City. In the event that the citizen composition of the Commission shall deviate from this policy, the Mayor and Board of Aldermen shall remedy such deviation at the earliest opportunity consistent with this Article, but a failure to strictly adhere to the policy will not affect the validity of any actions taken by the Commission.
C. 
The Aldermanic member shall serve as a liaison between the Commission and the Board of Aldermen.
D. 
All members of the Commission shall be voting members.
The Commission shall elect its Chairman and Secretary from among the citizen members. The term of Chairman and Secretary shall be for one (1) year with eligibility for reelection. The Commission shall hold regular meetings and special meetings as they provided by rule, and shall adopt rules for the transaction of business and keep a record of its proceedings. These records shall be public records. The Commission shall appoint the employees and staff necessary for its work, and may contract with City planners and other professional persons for the services that it requires. The expenditures of the Commission, exclusive of grants and gifts, shall be within the amounts appropriated for the purpose by Board of Aldermen.

All citizen members of the Commission shall serve without compensation. Any Commission member shall be reimbursed for actual expenses incurred in the performance of his/her duties as a member of the Commission after submission of a detailed expense report and after approval of reimbursement by the Mayor and Board of Aldermen.

The Commission shall hold regular meetings and special meetings at appropriate times determined by the members of the Commission and shall keep an accurate record of their proceedings which records shall be made public records. All meetings of the Commission, except for quorum requirements which shall be governed by Section 400.060, shall be conducted according to the rules adopted by it but, in the absence of such rules, then Robert's Rules of Order shall apply, unless the Commission determines that a variance from such rules is desirable. Rules of conducting a meeting at variance with Robert's Rules of Order may only be adopted or varied with the consent of a majority of the members appointed to the Commission. The Commission shall appoint the employees and staff necessary for its work and may contract with City planners and other professional persons for the services that it requires, subject to the prior approval of such appointments and contracts by the Board of Aldermen.

A quorum of any meeting of the Commission shall consist of one (1) more than half of the total membership of the Commission. For example, a quorum is five (5) members if the Mayor and an Alderman choose to be a member; four (4) members if only the Mayor or an Alderman (but not both) choose to be a member; and, four (4) members if the Mayor chooses not to be a member and the Board chooses not to elect a member. If a quorum is not present at a properly called meeting of the Commission, the meeting shall be adjourned.

A. 
The Commission shall have the following functions, duties and powers:
1. 
To prepare and recommend a City plan for the physical development of the City of Manchester. The City plan shall show the Commission's recommendations for the physical development and uses of land, and may include, among other things, the general location, character and extent of streets and other public ways, grounds, places and spaces; the general location and extent of public utilities and terminals, whether publicly or privately owned; the acceptance, widening, removal, extension, relocation, narrowing, vacation, abandonment, or change of use of any of the foregoing; the general character, extent and layout of the replanning of blighted districts and slum areas. The plan shall be made with the general purpose of guiding and accomplishing a coordinated development of the City of Manchester which will, in accordance with existing and future needs, best promote the general welfare, as well as efficiency and economy in the process of development. The City plan shall be adopted in accordance with the provisions of Section 89.360 of the Revised Statutes of Missouri, as now amended or shall hereafter be revised or amended.
2. 
To prepare a zoning plan for the City of Manchester which shall conform to the provisions of Sections 89.010 through 89.250 of the Revised Statutes of Missouri, as now amended or shall hereafter be revised or amended, and which shall include recommendations to the Board of Aldermen relating to, among other things:
a. 
The height, number of stories and size of buildings and other structures within the City of Manchester.
b. 
The percentage of lots that may be occupied within the City of Manchester.
c. 
The size of yards, courts and other open spaces within the City of Manchester.
d. 
The density of population within the City of Manchester.
e. 
The preservation of features of historical significance within the City of Manchester.
f. 
Location and use of buildings, structures and land for trade, industry, residence or other purposes within the City of Manchester.
g. 
The division of the City of Manchester into districts and the regulation of erection, construction, reconstruction, alterations of use of building structures or land therein.
3. 
To make reports and recommendations relating to the plan and development of the City of Manchester to the Mayor, the Board of Aldermen, other public officials and agencies, public utility companies, civic, educational, professional, and other organizations and citizens.
4. 
To recommend to the Mayor and Board of Aldermen programs for public improvements and the financing thereof.
5. 
To prepare and recommend that the Board of Aldermen adopt regulations governing the subdivision of land within the City of Manchester and approve or disapprove any plats submitted to the Commission in connection therewith. The approval of a plat by the Commission does not constitute or affect an acceptance by the City of Manchester or public of the dedication to public use of any street or other ground shown upon a plat. The regulations, in addition to the requirements provided by law for the approval of plats, may provide, among other things, requirements for the coordinated development of the municipality; for the coordination of streets within subdivisions with other existing or planned streets or with other features of the City plan or official map of the City of Manchester; for adequate open traffic, recreation, light and air; and for a distribution of population and traffic.
6. 
To submit minutes of its meetings, at least monthly, to the Mayor and the Board of Aldermen concerning its activities, investigations, transactions and recommendations and make such other reports relative thereto as may be deemed proper or as requested by the Mayor and Board of Aldermen. Such minutes and reports shall be forwarded to the Mayor and Board of Aldermen for presentation and review at a regular meeting of the Board of Aldermen. The Commission may make an annual report, if requested, to the Mayor and Board of Aldermen which summarizes its activities during the preceding year and outlines the activities and recommendations which it believes appropriate for the ensuing year. Any annual report shall be submitted to the Mayor and Board of Aldermen at least thirty (30) days after notice requesting such report from the Mayor; said request shall be timed to coordinate with the annual budgeting procedure of the City.
7. 
To perform such other functions conferred on the Commission by the Statutes of the State of Missouri, other ordinances of the City of Manchester, the Board of Aldermen as it may from time to time require, and as will promote municipal planning.

All officials of the City of Manchester shall, upon request, furnish to the Commission, within a reasonable time, all available information it requires for its work.

The recommendations of the Commission shall not be binding on the Board of Aldermen but shall be deemed as advisory in nature only. Unless votes at any Commission meeting are unanimous, the Secretary of the meeting shall record all votes individually.

The Board of Aldermen shall annually fix a sum to be used by the Commission for operating expenses, and such funds shall be under the management and jurisdiction of the Chairman of the Commission; however, no member of the Commission shall, at any time, incur expenses or obligate the City for any amount in excess of the appropriation made by the Board of Aldermen for operating expenses as provided in this Section. All such funds shall be subject to any regulations imposed by the Board of Aldermen and all expenses reimbursed shall be verifiable with expense records in a form approved by the Board.
