A commercial non-conforming use, as defined in these Zoning Regulations, in the "C-1" Commercial District of the City of Manchester, which is required by the Missouri Department of Transportation to relocate because of, and only because of, the widening/relocation of Highway 141 (Woods Mill Road) and its related roadway improvements, shall be permitted to retain its commercial non-conforming use status at some other commercial location within the City of Manchester provided the use shall first be determined by the Planning and Zoning Commission of the City, in its sole judgment, to be identical to the prior commercial non-conforming use (i.e., the use after relocation would be identical to the use prior to relocation) and, further, that said use will satisfy the requirements of Section 405.540 of Article X. Should such use either fail to be identical to the prior commercial non-conforming use or fail to satisfy the requirements of said Section 405.540 of Article X, as determined by the Planning and Zoning Commission of the City, in its sole judgment, such use shall lose its non-conforming use status at such time as it no longer satisfies the requirements of Section 405.160 of Article IV of these Zoning Regulations relating to non-conforming uses.
