(a) 
The following rules and regulations shall govern all Municipal park lands in the City. On such lands, no person shall:
(1) 
Cut, injure, deface, remove or disturb any tree, shrub, building, fence, bench or other structure, apparatus or property; pick, cut or remove any shrub, bush or flower; or mark or write upon any building, fence, bench or other structure;
(2) 
Make or kindle an open fire, except in picnic stoves provided for that purpose;
(3) 
Shoot bows and arrows without a permit;
(4) 
Sell, offer or solicit for sale any goods or merchandise without a permit;
(5) 
Play baseball or softball, except at diamonds expressly set aside for this activity;
(6) 
Remain, stay or loiter in a park between the hours of 11:00 p.m. and 5:00 a.m. of the following day, except as allowed by a permit issued pursuant to Section 1064.02 for events sponsored by charitable, civic or governmental organizations;
(7) 
Post, paste or affix any placard, notice or sign within any park without a permit;
(8) 
Operate, within the boundaries of any City parks, any off-the-road motor-driven vehicle, including, by way of example, but not by way of limitation, any motorbike, motorcycle, dune-mobile, snowmobile, all-terrain vehicle, amphibious vehicle or similar motorized device, except that vehicles licensed for operation on public highways may be operated on any paved roads within any park.

All permits for all parks, except Waterworks Park, shall be issued in writing by the City Manager, or his or her authorized deputy, and shall be granted only if the issuance thereof shall not impair the public safety or welfare in said parks. All permits concerning Waterworks Park shall be issued in writing by the Director of the Board of Public Utilities or his or her deputy.

The City Engineer and his or her designated representative, and/or the City Manager and his or her designated representative, and/or the Director of Police and Fire Services and his or her designated representative, are hereby designated as the authorized City officials to issue Municipal civil infraction citations (directing alleged violators to appear in court) or Municipal civil infraction violation notices (directing alleged violators to appear at the City of Coldwater Municipal Ordinance Violations Bureau) as provided in Chapter 211 of the Administration Code.

A person who violates any provision of this chapter is responsible for a Municipal civil infraction and shall be subject to the payment of a civil fine of not less than $50, plus costs and other sanctions, for each infraction. A second offense, within a period of 90 days, shall be subject to a civil fine of not less than $100, plus costs and other sanctions, for each infraction. Third and subsequent offenses, within 90 days, shall be subject to a civil fine of $250, plus costs and other sanctions, for each infraction.
