A. 
The inspection of food service establishments; the issuance, suspension and revocation of permits to operate food service establishments; the prohibiting of the sale of unsound or mislabeled food or drink; and the enforcement of this Chapter shall be regulated in accordance with the 1976 Edition of the Food and Drug Administration "Food Service Sanitation Ordinance", three (3) certified copies of which shall be on file in the office of the City Clerk; provided that the words "municipality of Festus" in the ordinance shall be understood to refer to the City of Festus, Missouri.

The following language of the United States Food and Drug Administration Food Service Sanitation Ordinance is not so adopted and is expressly deleted: Delete 1-102 (h) "not", 1-102 (i) "retail food stores, the location of food vending machines and supply vehicles", 10-204 (2) "Within fifteen (15) days after the inspection, the holder of the permit, license or certificate shall submit a written report to the regulatory authority stating that the 4 or 5 point weighted violations have been corrected. A follow-up inspection shall be conducted to confirm correction".

A. 
There is hereby created the office of Health Officer. The Mayor, with the approval of the City Council, shall appoint a qualified person as the Health Officer. Such Health Officer shall hold this office for an indefinite period from the date of his/her appointment or until his/her successor is appointed and approved.
B. 
The Health Officer shall have the powers, authorities, duties and responsibilities of the "regulatory authority" as set forth in the 1976 Edition of the Food and Drug Administration "Food Service Sanitation Ordinance" as provided hereafter and shall specifically have the power and authority to denominate and enlist the County Health Department, its agents and sanitarians as his/her agent to make those inspections required by the Food Service Sanitation Ordinance.
