All City elections shall be conducted and held in conformance with the provisions of Chapter 115, RSMo.

A. 
A municipal election of the qualified voters of this City shall be held on the first Tuesday after the first Monday in April of each year. At such elections, the following officials shall be elected:
1. 
On the municipal election date in odd-numbered years, a municipal election of the qualified voters of the City of Edmundson shall be held for the purpose of electing a Mayor who shall hold his/her office for a term of two (2) years and until his/her successor is elected and qualified.
2. 
On the municipal election date in odd-numbered years, a municipal election of the qualified voters of the City of Edmundson shall be held for the purpose of electing one (1) Alderman from each ward who shall hold his/her office for a term of two (2) years and until his/her successor is elected and qualified.
3. 
On the municipal election date in even-numbered years, a municipal election of the qualified voters of the City of Edmundson shall be held for the purpose of electing one (1) Alderman from each ward who shall hold his/her office for a term of two (2) years and until his/her successor is elected and qualified.
B. 
Exception. Notwithstanding the provisions of Subsection (A) of this Section, no municipal election will be held for an office if the number of candidates who have filed for the particular office is equal to the number of positions in that office to be filled by the election, provided that the voters have approved such process within the previous six (6) calendar years. The candidates shall assume the responsibilities of their offices at the same time and in the same manner as if they had been elected. In the event that the number of candidates filing for a particular office exceeds the number of positions to be filled at such election but a sufficient number of candidates withdraw from such contest for that office so that the number of candidates remaining after the filing deadline is equal to the number of positions to be filled, the municipal election shall be held, and the election authority shall conduct the election as scheduled.

A. 
The City of Edmundson shall be authorized to adopt an election procedure whereby no election will be held for an office if the number of candidates who have filed for the particular office is equal to the number of positions in that office to be filled by the election.
B. 
Such election procedure shall be in effect for the municipal election in 2024 and for six (6) years thereafter.

Any person who desires to become a candidate for an elective City office at the general City election shall file with the City Clerk, not prior to the hour of 8:00 A.M. on the sixteenth (16th) Tuesday prior to, nor later than 5:00 P.M. on the eleventh (11th) Tuesday prior to the next City municipal election, a written declaration of his/her intent to become a candidate at said election. The City Clerk shall keep a permanent record of the names of the candidates, the offices for which they seek election, and the date of their filing, and their names shall appear on the ballots in that order.
No person shall be a candidate for municipal office unless such person complies with the provisions of Section 115.346, RSMo., regarding payment of municipal taxes or user fees.

The City Clerk shall, on or before the sixteenth (16th) Tuesday prior to any election at which City offices are to be filled by said election, notify the general public of the opening filing date, the office or offices to be filled, the proper place for filing, and the closing filing date of the election. Such notification may be accomplished by legal notice published in at least one (1) newspaper of general circulation in the City.

A. 
Section 115.124, RSMo, provides that, upon voter approval in Cities with a population of one thousand (1,000) or fewer people and upon proper notice, no election shall held for an office if the number of candidates who have filed for the particular office is equal to the number of positions in that office to be filled by the election and the candidates shall assume the responsibilities of their offices at the same time and in the same manner as if they had been elected.
B. 
On April 5, 2016, a majority of the Edmundson electorate voted in favor of the election procedure set out in Subsection (A), which shall therefore be in effect for the municipal election in 2017 and for six (6) years thereafter.

A. 
Pursuant to voter approval on April 5, 2016, the Board of Aldermen hereby establishes and mandates the following procedure to apply to any municipal election at which City Officials are to be elected and which is held in the year in which voter approval was obtained or in the following six calendar years (2017, 2018, 2019, 2020, 2021 and 2022):
1. 
Notwithstanding any ordinance to the contrary, no municipal election will be held for an office if the number of candidates who have filed for the particular office is equal to the number of positions in that office to be filled by the election. The candidates shall assume the responsibilities of their offices at the same time and in the same manner as if they had been elected.
2. 
In the event that the number of candidates filing for a particular office exceeds the number of positions to be filled at such election but a sufficient number of candidates withdraw from such contest for that office so that the number of candidates remaining after the filing deadline is equal to the number of positions to be filled, the municipal election shall be held, and the election authority shall conduct the election as scheduled.
3. 
In such event, the City or the Board of Election Commissioners shall, in lieu of other required election notices, publish a notice that contains the names of the candidates that shall assume the responsibilities of office in at least one newspaper of general circulation as defined in Section 493.050, RSMo., in the City by the first of the month in which the election would have occurred, had it been contested.

A. 
In City elections, the City Clerk shall notify the Board of Election Commissioners of St. Louis County prior to 5:00 P.M. on the 10th Tuesday prior to any City election except as noted in Section 115.125.1, RSMo.
B. 
The City Clerk's notification shall contain the following information.
1. 
If no election is to be held pursuant to Subsection (B) of Section 105.020 of this Code and Section 115.124, RSMo., the notification shall contain the names of the candidates that shall assume the responsibilities of office under those sections and a request that the Board of Election Commissioners publish such notice in at least one newspaper of general circulation as defined in Section 493.050, RSMo., in the City by the first of the month in which the election would have occurred, had it been contested.
2. 
If an election is to be held, the notification shall specify that the Board of Aldermen is calling the election, the purpose of the election, the date of the election, and shall include a certified copy of the legal notice to be published, including the sample ballot.
C. 
The notice and any other information required by this Section may, with the prior notification to the election authority receiving the notice, be accepted by facsimile transmission prior to 5:00 P.M. on the 10th Tuesday prior to the election, provided that the original copy of the notice and a certified copy of the legal notice to be published shall be received in the office of the election authority within three (3) business days from the date of the facsimile transmission.

After said election, the City Clerk shall receive from the Board of Election Commissioners the certification of the returns and give to those candidates having the highest or higher number of votes certifications of election; thereafter, the Board of Aldermen, at a meeting not more than twenty (20) days from the date of said election or at the regularly scheduled meeting in May, whichever is later, shall complete all of its old business and then the newly elected members and/or the Mayor shall be sworn into office.
