A. 
It shall be unlawful for any person, persons, partnership or corporation to dig up, tear up or otherwise alter or destroy the surface of any of the streets, roads or thoroughfares within the corporate limits of the City of Edmundson, St. Louis County, without first having obtained from the City Clerk a permit hereinafter described.
B. 
The City Clerk with the consent of the Board of Aldermen is hereby authorized to issue permits allowing a person, or persons, partnerships, or corporations to dig up or tear up the surface of any street, road or thoroughfare within the corporate limits of said City, provided however, that said work is deemed necessary in connection with plumbing, pipe work, gas lines, sewage work, or any other excavation pertaining to utilities, but not limited thereto, with the proper reconstruction of said street, road, or thoroughfare to serve the general welfare of the inhabitants of said City, and providing further, that all applicants for such permits shall deposit with the City Clerk an amount or performance bond which is satisfactory to the Board of Aldermen in order to guarantee that such applicant shall satisfactorily replace and renew the surface of the street, road or thoroughfare upon which said applicant intends to do the work. All applicants for such permit shall, before such permit is granted, state in writing before the City Clerk and shall agree and consent that in the event the renewing or resurfacing of the street, road or thoroughfare is not satisfactory to the Board of Aldermen, the said Board shall and is permitted to authorize the repairing, renewing or resurfacing and the cost of the same shall be paid by and out of the deposit or bond proceeds, before described. The amount of the deposit or performance bond shall be set by the Board of Aldermen taking into consideration the extent and nature of the work and the cost to bring the street, road or thoroughfare back into the condition before the work.
C. 
The said permit shall be issued only for a single work order, and shall not extend or include other work. The permit or license fee shall be set in an amount that will reimburse the City for its expense in reviewing the proposed work and inspecting the premises during the course of the work and at the completion of the work to insure that the work does not in any way result in damage to the street, roadway or thoroughfare.
