No person shall grade or cause to be graded any property whereby the grading is performed in conjunction with the development of a subdivision or resubdivision or in conjunction with building a new structure unless such person shall have received a permit therefore from the Building Commissioner and Zoning Administrator.

Before the Building Commissioner and Zoning Administrator shall issue a permit under this Article, the person desiring to effect such grading shall make application in writing, setting out the location and configuration of the proposed grading and stating approximately when the same shall be commenced. In the discretion of the Building Commissioner and Zoning Administrator or as required by other provisions of this Code, a topographic survey map or plat shall be prepared and supplied with the application for a permit.

Before any permit is issued under this Article, there shall be paid to the City Clerk a permit fee in a sum equal to four percent (4%) of the estimated cost of such grading.

Inspections under this Article shall be made by the Building Commissioner and Zoning Administrator or his/her designee and a record of each such inspection shall be entered and maintained in the office of the Building Commissioner and Zoning Administrator.

The provisions of this Article relating to issuance of a permit prior to commencement of work of any grading shall not apply in case of emergency where public safety or health is endangered, and such work may proceed immediately. Appropriate permits may be applied for as soon as practicable after the work is initiated.

It shall be the duty of the Building Commissioner and Zoning Administrator to keep a full complete account in a book for that purpose of all permits issued showing the date of issue, party to whom issued, location, money collected on account thereof, which money shall be paid directly to the City Clerk when and as received and shall become a part of the General Revenue Fund. The Building Commissioner and Zoning Administrator shall make a report to the Board of Aldermen showing the number of permits issued and of the amounts paid to the City Clerk.
