For the purposes of this Title, the following definitions shall
have the meanings respectively ascribed to them by this Section, except
as otherwise provided:
A narrow public lane or thoroughfare through the middle of
a block giving access to the rear of lots or buildings.
A motor vehicle primarily for the transportation of a driver
and eight (8) or more passengers but not including shuttle buses.
A motor vehicle designed or regularly used for carrying freight
and merchandise, or more than eight (8) passengers but not including
vanpools or shuttle buses.
That part of a roadway at an intersection included within the
connections of the lateral lines of the sidewalks on opposing sides
of the highway measured from the curbs, or in the absence of curbs
from the edges of the traversable roadway;
Any portion of a roadway at an intersection or elsewhere distinctly
indicated for pedestrian crossing by lines or other markings on the
surface.
The lateral boundaries of that portion of the street designated
for the use of vehicles, whether marked with curbstones or not.
Every person who drives or is in actual physical control
of a vehicle.
A vehicle of any of the following types:
A vehicle operated by the State Highway Patrol, the State Water
Patrol, the Missouri Capitol Police, a Conservation Agent or a State
Park Ranger, those vehicles operated by enforcement personnel of the
State Highways and Transportation Commission, Police or Fire Department,
Sheriff, Constable or Deputy Sheriff, Federal Law Enforcement Officer
authorized to carry firearms and to make arrests for violations of
the laws of the United States, Traffic Officer or Coroner or by a
privately owned emergency vehicle company;
A vehicle operated as an ambulance or operated commercially
for the purpose of transporting emergency medical supplies or organs;
Any vehicle qualifying as an emergency vehicle pursuant to Section
307.175, RSMo.;
Any wrecker or tow truck or a vehicle owned and operated by
a public utility or public service corporation while performing emergency
service;
Any vehicle transporting equipment designed to extricate human
beings from the wreckage of a motor vehicle;
Any vehicle designated to perform emergency functions for a
civil defense or emergency management agency established pursuant
to the provisions of Chapter 44, RSMo.;
Any vehicle operated by an authorized employee of the Department
of Corrections who, as part of the employee's official duties, is
responding to a riot, disturbance, hostage incident, escape or other
critical situation where there is the threat of serious physical injury
or death, responding to mutual-aid call from another criminal justice
agency, or in accompanying an ambulance which is transporting an offender
to a medical facility;
Any vehicle designated to perform hazardous substance emergency
functions established pursuant to the provisions of Sections 260.500
to 260.550, RSMo.
Any vehicle owned by the State Highways and Transportation Commission
and operated by an authorized employee of the Department of Transportation
that is marked as a Department of Transportation emergency response
or motorist assistance vehicle.
The entire width between the boundary lines of every way
publicly maintained when any part thereof is open to the use of the
public for purposes of vehicular travel.
A street or highway which has been paved with gravel, macadam,
concrete, brick or asphalt, or improved in any manner by adding material
or substance so as to present a surface other than the original earth
surface.
The area embraced within the prolongation or connection of the
lateral curb lines, or, if none, then the lateral boundary lines of
the roadways of two (2) highways which join one another at, or approximately
at, right angles, or the area within which vehicles traveling upon
different highways joining at any other angle may come in conflict;
Where a highway includes two (2) roadways thirty (30) feet or
more apart, then every crossing of each roadway of such divided highway
by an intersecting highway shall be regarded as a separate intersection.
In the event such intersecting highway also includes two (2) roadways
thirty (30) feet or more apart, then every crossing of two (2) roadways
of such highways shall be regarded as a separate intersection.
A license issued by a State to a person which authorizes
a person to operate a motor vehicle.
The weight of the cargo of a commercial motor vehicle, in
addition to that of the chassis and body of the vehicle.

Any violation of a municipal traffic ordinance:

For which no points are assessed by the Missouri Department
of Revenue or for which the Department of Revenue is authorized to
assess from one (1) to four (4) points to a person's driving
record upon conviction, and

2.
|
That does not involve:
| |||
|
a.
|
An accident or injury,
| |||
|
b.
|
The operation of a commercial vehicle,
| |||
|
c.
|
Exceeding a speed limit by more than nineteen (19) miles an
hour, or
| |||
|
d.
|
A violation occurring within a construction zone or a school
zone.

A "minor traffic violation" shall include amended charges for
any minor traffic violation.

Any self-propelled vehicle not operated exclusively upon
tracks except motorized bicycles as defined in Section 307.180, RSMo.
Every motor vehicle having a seat or saddle for the use of
the rider and designed to travel on not more than three (3) wheels
in contact with the ground, but excluding a tractor.
A motor vehicle operated on three (3) wheels, including a
motorcycle operated with any conveyance, temporary or otherwise, requiring
the use of a third (3rd) wheel.
Any municipal ordinance violation prosecuted for which penalties
are authorized by Statute under Sections 64.160, 64.200, 64.487, 64.690,
64.895, 67.398, 71.285, 89.120 and 89.490 of the Revised Statutes
of Missouri. A "municipal ordinance violation" shall include any charge
amended form a municipal ordinance violation.

Every person who is not a resident of this State.
All signs, signals, markings and devices not inconsistent
with this Title placed or erected by authority of a public body or
official having jurisdiction, for the purpose of regulating, warning
or guiding traffic.
All signs, markings and devices, other than signals, not
inconsistent with this Title, placed or erected by authority of a
public body or official having jurisdiction for the purpose of regulating,
warning or guiding traffic.
A street where vehicles are required by law to move in one
(1) direction only.
Every person who is in actual physical control of a motor
vehicle.
A person who holds the legal title of a vehicle, or in the
event a vehicle is the subject of an agreement for the conditional
sale or lease thereof with the right of purchase upon performance
of the conditions stated in the agreement and with an immediate right
of possession vested in the conditional vendee or lessee, or in the
event a mortgagor of a vehicle is entitled to possession, then such
conditional vendee or lessee or mortgagor shall be deemed the owner.
The standing of a vehicle, whether occupied or not, otherwise
than temporarily for the purpose of and while actually engaged in
loading or unloading merchandise or passengers.
Includes any mechanical device or meter not inconsistent with this Title placed or erected for the regulation of parking by authority of Chapter 358. Each parking meter installed shall indicate by proper legend the legal parking time established by the City and when operated shall at all times indicate the balance of legal parking time, and at the expiration of such period shall indicate illegal or overtime parking.
Any space within a parking meter zone, adjacent to a parking
meter and which is duly designated for the parking of a single vehicle
by lines painted or otherwise marked on the curb or on the surface
of the street adjacent to or adjoining the parking meters.
Includes any restricted street upon which parking meters
are installed and in operation.
A permit issued by the Director of Finance authorizing the
operator of a vehicle to park in a parking meter zone without depositing
in the parking meter the specified fee thereof.
A person afoot.
Every natural person, firm, partnership, association or corporation.
Tires of rubber or other substance and fabric inflated with
air.
Every officer of the municipal Police Department or any officer
authorized to direct or regulate traffic or to make arrest for violation
of traffic regulations.
Every way or place in private ownership and used for vehicular
travel by the owner and those having express or implied permission
from the owner, but not by other persons.
The right of one vehicle or pedestrian to proceed in a lawful
manner in preference to another vehicle or pedestrian approaching
under such circumstances of direction, speed and proximity as to give
rise to danger of collision unless one grants precedence to the other.
That portion of a highway or street improved, designed or
ordinarily used for vehicular travel, exclusive of the berm or shoulder.
In the event a highway or street includes two (2) or more separate
roadways, the term "roadway", as used herein, shall
refer to any such roadway separately but not to all such roadways
collectively.
The area of space officially set apart within a roadway for
the exclusive use of pedestrians and which is protected or is so marked
or indicated by adequate signs as to be plainly visible at all times
while set apart as a safety zone.
Any designated intersection of two (2) or more public highways
or a marked pedestrian crossing of a highway or street, as set forth
in Schedule VI, Table VI-A, at which there shall have been erected
or placed a sign or marker with the words "Stop For Pedestrians".
Any motor vehicle, either publicly or privately owned, used
to transport students to and from school, or to transport pupils properly
chaperoned to and from any place within the State for educational
purposes. The term "school bus" shall not include
a bus operated by a public utility, municipal corporation or common
carrier authorized to conduct local or interstate transportation of
passengers when such bus is not traveling a specific school bus route
but is:
A space in any street lawfully designated by this Code or
by ordinance for the safety of persons going to and returning from
public, private or parochial schools.
A motor vehicle, other than a motorbus, offered for or engaged
in carrying passengers for hire over a designated route and for a
fixed fare and over the route of which the passenger has no control.
That portion of a street between the curb lines, or the lateral
lines of a roadway, and the adjacent property lines intended for use
of pedestrians.
Tires of rubber or other resilient material, other than pneumatic
tires.
The halting of a vehicle, whether occupied or not, otherwise
than for the purpose of and while actually engaged in receiving or
discharging passengers.
Complete cessation from movement.
The entire width between the lines of every way when any
part thereof is open to the uses of the public for purposes of vehicular
travel.
Every device traveling exclusively upon rails when upon or
crossing a street, other than cars or trains propelled or moved by
steam or operated on steam railway tracks.
A motor vehicle other than a motorbus or service car offered
for or engaged in carrying passengers for hire as defined by this
Section.
Every street or portion thereof on which vehicular traffic
is given preferential rights-of-way, and at the entrances to which
vehicular traffic from intersecting streets is required by law to
yield rights-of-way to vehicles on such through street in obedience
to either a stop sign or a yield sign, when such signs are erected
as provided in this Title. Through streets correspond to the functional
classification definitions of Interstate, principal arterial, minor
arterial, major arterial, major collector, minor collector by East-West
Gateway Council of Government.
Any motor vehicle designed primarily for agricultural use
or used as a traveling power plant or for drawing other vehicles or
farm or road building implements and having no provision for carrying
loads independently.
Pedestrians, ridden or herded animals, vehicles, streetcars
and other conveyances either singly or together while using any street
for purposes of travel.
Any device, whether manually, electrically or mechanically
operated, by which traffic is alternately directed to stop and proceed.
Any vehicle without motive power designed for carrying passengers
or property on its own structure and for being drawn by any vehicle,
except those running exclusively on tracks, including a semi-trailer
or vehicle of the trailer type so designed and used in conjunction
with any vehicle that a considerable part of its own weight rests
upon and is carried by the towing vehicle.
Any mechanical device on wheels designed primarily for use
or used on highways, except motorized bicycles, vehicles propelled
or drawn by horses or human power, or vehicles used exclusively on
fixed rails or tracks, or cotton trailers or motorized wheelchairs
operated by disabled persons.
