A.
It
is declared to be necessary to establish a parking meter program:
To protect the public safety and welfare, to regulate the use of the
streets of the City by motor vehicles, to prevent the obstruction
and unfair use of the streets for private purposes, to ensure equal
rights in the use of the streets to all persons entitled thereto,
to regulate the privilege of parking vehicles in the streets in parking
meter zones, to prevent the abuse of such privilege, and to establish
parking meter fees for such privilege and for recouping and defraying
the costs of said program.
B.
The
regulations contained in this Chapter shall be deemed to be in addition
and supplementary to the regulations now in force and effect with
reference to the regulation of traffic and parking in the spaces controlled
by parking meter zones as herein provided for or hereafter created.

For the purposes of this Chapter, the following terms shall
have the following meanings, only indicated otherwise by context:
Any device, including a parking pay station, located adjacent
to or near any parking space regulated by this Chapter and which
A parking meter that regulates one (1) or more parking spaces
and that establishes and publishes the lawful time permitted for parking
privileges by either indicating same on the face of the device or
by providing a proof of payment receipt, to be displayed on the driver
side window or dashboard, indicating such information.
Any person who parks a vehicle in violation of this Chapter,
and any person or entity who is the registered owner or the lessee
of a vehicle parked in violation of this Chapter. As provided in Section
304.120, RSMo., no liability shall be imposed on an owner when the
vehicle is being permissively used by a lessee if the owner provides
the City with the name, address, and operator's license number of
the lessee at the time the violation occurred.

There is established in the City of University City designated
parking meter zones which shall include the following streets or parts
of streets:
Zone A
Parking lot No. 1: Second parking stall from entrance, on the
western half of the parking lot at 6320 Delmar Boulevard.
Zone B
Limit Avenue: Both sides from Delmar Boulevard south to the
alley.
Zone C
North and South Boulevard: Both sides from Gannon Avenue to
a point one hundred fifty (150) feet south of the south line of Gannon
Boulevard.
Zone D
Delmar Boulevard: Both sides from Sgt. Mike King Drive to the
east City limits.
Enright Avenue: The south side from Westgate Avenue to the east
City limits.
Forsyth Boulevard: North side thereof from a point seventy-five
(75) feet of the west line of Lindell Boulevard to a point ninety-eight
(98) feet to the west. And, north side thereof from a point twenty-two
(22) feet of the east line of Lindell Boulevard to a point thirty-six
(36) feet to the east.
Gannon Avenue: The south side from the alley east of North and
South Boulevard to the alley west of North and South Boulevard.
Kingsland Avenue: Both sides from Loop South to Washington Avenue.
Leland Avenue: East side thereof from Delmar Boulevard to Loop
South.
Loop South: South side from Kingsland Avenue to Leland Avenue.
Melville Avenue: Both sides from Delmar Boulevard to a point
two hundred and twenty-five (225) feet south thereof.
Parking Lot No. 6: Northwest corner of the intersection of Lindell
Boulevard and Forsyth Boulevard.
Westgate Avenue: Both sides from Delmar Boulevard to Enright
Avenue.
Westgate Avenue: Both sides from Delmar Boulevard to the alley
south thereof.
Zone E
Parking Lot No. 1: South side of Delmar Boulevard, at 6320 Delmar
Boulevard, except for those spaces in Zone A.
Parking Lot No. 2: Parking Garage at 6319 Delmar Boulevard.
Parking Lot No. 3: North side of Delmar Boulevard, west of 6639
Delmar Boulevard.
Zone F
Parking Lot No. 5: Southeast corner of the intersection of Kingsland
Avenue and Loop South (Post Office).

In parking zones established by Section 358.030, it is unlawful for a vehicle to park in excess of the time indicated in the following zones:
Zone A: Fifteen (15) minute limitation.
Zone B: Four-hour limitation.
Zone C: One-hour limitation.
Zone D: Two-hour limitation.
Zone E: Three-hour limitation.
Zone F: Eight-hour limitation.
A.
Vehicles parked beyond the maximum time indicated in Section 358.030 shall be ticketed. Tickets are subject to late fees based on non-payment. Fourteen (14) days after non-payment, ticket amounts double from the initial fine. Citations remained unpaid after forty-five (45) days from the issuance date shall triple from the initial fine. After forty-five (45) days of non-payment, tickets are subject to receive a summons to appear in Municipal Court.
B.
Vehicles
that accrue four (4) or more unpaid tickets may be booted. If the
vehicle is booted, it will remain so for three (3) days. Within the
three (3) days, violators shall appear at the Violations Bureau and
pay the amount due for all unpaid citations along with a fifty dollar
($50.00) boot fee. The Violations Bureau will receive the payment
and prepare boot release papers that are turned over to the City Police
Department for the release of the boot. If the citations are not paid
within the three (3) days, the vehicle is towed. To release the vehicle
from the tow company, violators must still pay the unpaid citations
and boot fee and obtain release from the City Police Department.

Other parking meter zones may be established from time to time;
and when so established, this Chapter shall apply to them and to the
parking meters installed therein; and they shall be operated, maintained
and policed as provided in this Chapter.

Parking spaces shall be designated in parking meter zones by
lines or markings painted upon the curb, the street adjacent to or
near the parking meter, or the parking area controlled by the meter.
It is unlawful for any motor vehicle to park across such lines or
markings or to park a vehicle in such a position that it shall not
be entirely within the space designated by such lines or markings.

A.
For the purpose of defraying the cost to the City of purchasing and installing parking meters and of regulating, supervising and policing the exercise of the privilege of parking in parking meter zones, there is established a parking fee for the parking zones enumerated in Section 358.030, in the following amounts, for the privilege of parking a vehicle in a parking space, which fee shall be paid by depositing a coin or coins in the parking meter adjacent to the parking space in which a vehicle is parked:

B.
It is unlawful for any person not having a parking permit issued
pursuant to this Chapter to park a vehicle in any parking space without
there having been deposited in the parking meter the money to pay
the fee imposed by this Chapter. If the timing device shows that the
time for which the fee is paid has expired, and if a vehicle is parked
in a parking space adjacent to such meter, then this shall be prima
facie evidence that the fee required by this Chapter for the privilege
of parking such a vehicle in such space has not been deposited in
the parking meter, unless, however, the vehicle has a parking permit
issued under this Chapter. Each meter shall designate the type of
coin to be deposited.
C.
When the City's authorized attendant is on duty at the Municipal
Parking Garage, Parking Lot No. 2 on Zone E, a flat fee of five dollars
($5.00) will be imposed on each vehicle upon entering the parking
garage, excluding vehicles parked under a permit issued according
to this Chapter. This flat fee of five dollars ($5.00) increases from
four dollars ($4.00). The current rate generates seventy-five thousand
dollars ($75,000.00) revenue annually. This increase would generate
additional of approximately eighteen thousand dollars ($18,000.00)
per year based on the same volume of usages. The flat fee will be
applied by the following schedule:

It is unlawful to deposit or cause to be deposited in any parking
meter any slug, device or substitute for any United States coin provided
for and authorized to be deposited by this Chapter.

It shall be the duty of the City Manager to designate some person
or persons to make regular collections of the money deposited in parking
meters and to deliver the money to the Director of Finance. Such person
or persons making such collections shall be employees of the City
and shall be bonded for the faithful accounting for the money handled
by them.

A.
It is unlawful for any person to cause, allow, permit or suffer any vehicle registered in his/her name or operated or controlled by him/her to be upon any street or right-of-way, public parking lot, or public parking garage within a parking meter zone in any parking space adjacent to where a parking meter is showing a signal indicating that the fee has not been paid, and such space is illegally in use between the hours of 8:00 A.M. and 8:00 P.M. of any day, Sundays and legal holidays excepted, for Zones A through F as provided in Section 358.030.
B.
Parking meters shall be adjusted so as to show legal parking during
the period for which payment has been made, as provided in this Chapter,
and to show when the period expires for which payment has been made,
and the parking thereafter in such parking space is illegal; provided,
however, that nothing in this Section shall apply to a vehicle holding
a parking permit issued under this Chapter.

It is unlawful for any unauthorized person to open or for any
person to deface, injure, tamper with or willfully break, destroy
or impair the usefulness of any parking meter installed pursuant to
this Chapter or to hitch any animals thereto.

The Director of Finance is authorized to issue permits to applicants
authorizing the parking of vehicles in parking meter Zones D and F
without the necessity of depositing parking fees as required in such
parking meters. Parking permits for Zone D shall be issued only to
a certain vehicle and the motor vehicle license number shall be furnished
to the Chief of Police by the Director of Finance. Parking permits
for Zone F shall be issued to an individual or business and will be
transferable. The cost of each permit shall be thirty dollars ($30.00)
per month or twenty dollars ($20.00) per month for any applicant who
is issued ten (10) or more parking permits for a given month, payable
on or before the first (1st) day of each month or payable in advance
for any succeeding twelve (12) month period, or parts thereof.

A.
The
City Manager or his/her designee is authorized to install and maintain
parking meters along the streets and in other public areas where the
parking of motor vehicles is not prohibited in the parking meter zones
established by this Chapter, as is necessary to carry out the purpose
and provisions of this Chapter. In exercising such authority, the
City Manager or designee shall consider the following criteria:
1.
The physical dimensions of the area where public parking is desired;
2.
The availability of public parking spaces in the affected area;
3.
The current and projected estimates of public parking demands in
the affected area;
4.
The parking needs of residents, businesses and others in the affected
area;
5.
The extent of traffic congestion, illegal parking and related health
and safety hazards in the affected area; and
6.
The proximity of public transportation to the affected area.
B.
In
the parking meter zones established by this Chapter, parking meters
shall be installed within or near the curb, on the adjacent street,
or on another area adjacent to or near the regulated parking spaces,
and each space shall be regulated by either one (1) meter or by a
parking pay station capable of regulating one (1) or more spaces.
The meters in the parking zones shall be set to operate upon the deposit
of the prescribed fees in the form of monies of the United States.
C.
Each
of such meters shall designate the type of money to be deposited and
be arranged so as to show or display a signal, or to print a proof
of payment receipt, indicating when the time limit for which the fee
has been paid in that space has expired.
