The purpose of this Chapter is to provide a procedure for the filing of petitions for the placement of street barricades to retard the speed of motor vehicles in specified portions of streets to enhance the safety of pedestrians and to provide for a mechanism for temporarily barricading a street for certain neighborhood, civic and community events.

Residents of a street who desire that street barricades be placed at a specified street location may submit a petition to the City Clerk for that purpose. To be considered by the Board of Aldermen, the petition must contain the signatures of all residents whose homes are within two hundred (200) feet, measured along the street, from the proposed location of the street barricades.

The City Clerk shall verify that any petition submitted contains the required signatures. After such verification has been made, the City Clerk shall send a notice of a hearing to be held by the Board of Aldermen to consider such petition to all residents whose homes are within five hundred (500) feet, measured along the street, from the proposed location of the street barricades. The notice shall be sent at least fifteen (15) days prior to the hearing.

The Board of Aldermen shall consider any petition filed in accordance with Section 240.020 at a regular monthly meeting of the Board of Aldermen. The Board of Aldermen shall approve or disapprove any such petition based on testimony of residents to whom notices were sent pursuant to Section 240.030, information from the Police Department on traffic conditions regarding the proposed location and the best interests of the neighborhood and the City as a whole. The decision of the Board of Aldermen shall be final.

If approved by the Board of Aldermen, two (2) barricades, each ten (10) feet in length will be placed by the City on opposite sides of the street at the location specified in the petition approximately twenty (20) to thirty (30) feet apart. Such placement shall be a permanent location of the barricades and it shall be unlawful for any person to move such barricades for any purpose. If such barricades are moved to another location, the City shall have the right to remove such barricades. No parking will be permitted on the street within thirty (30) feet of either barricade. Barricades will be furnished by the City and will remain the property of the City.

Barricades may be placed on streets only during the period of April first (1st) through October thirty-first (31st), commencing within ten (10) days after approval of a petition therefor in accordance with this Chapter. Approval of a petition to place barricades shall be effective only for the calendar year during which approval was given.

A. 
All requests by any individual, neighborhood, civic or community organization for the temporary closure of any City street for the purpose of conducting a neighborhood, civic or community event shall be directed to the Mayor and Chief of Police for action upon each such request at least one (1) week before the party and on an application form provided by the City.
B. 
The temporary closure of any City street, under the circumstances hereinbefore described, may be authorized by the Mayor and Chief of Police and without the necessity of any formal action on the part of the Board of Aldermen. However, prior to any such closing, the person(s) seeking the street closure shall have circulated a petition before the party to every household where ingress or egress to their homes would be blocked. The petition must include each address which would be blocked and must give the date and opening and closing times of the party and include a space for each householder to show his or her consent or dissent for the event to be held. The petition shall be submitted along with the application.
C. 
If, in the opinion of the Mayor and Chief of Police, the temporary closure of the City street will adversely affect or unreasonably endanger the public health, safety or welfare, then the application shall be denied.
D. 
All requests that are granted will be subject to a deposit which may be applied to the cost of replacing lost, stolen or damaged barricades and other such equipment.
E. 
No temporary closure of any City street under this Section shall exceed four (4) hours duration.
F. 
It shall be the responsibility of the applicant(s) for such street closing to immediately remove any barricades and/or signage placed by order of the Police Chief, which barricades and/or signage shall be picked up by the City from the applicant's residence.
