There is hereby created a Commission on Human Rights whose duties it shall be to investigate written complaints charging discriminatory housing practices and seek conciliation of such complaints. An investigation of any complaint shall commence within forty-five (45) days of receipt of complaint. If conciliation efforts fail, the Commission shall hold fair and impartial hearings according to rules adopted by the Commission. All parties involved are to be given five (5) days' written notice of the hearings and may appear with legal counsel and shall have the right to present proof and cross-examine witnesses in all matters relating to the complaint and subsequent related occurrences. After holding hearings, the Commission shall make findings of fact and issue recommendations to the City Manager for the City Manager's review and consideration. The Commission may recommend that the City Attorney file a civil suit to enjoin the violation, together with appropriate action. This Section is in addition to and not in lieu of the Section regarding penalties.

The Human Rights Commission shall consist of three (3) members who shall be appointed by the Mayor, with approval of the Council, within fifteen (15) days after a complaint has been received in accordance with this Article. Members shall be residents of the City of Richmond Heights, registered voters and at least twenty-one (21) years of age. The Chairman of the Commission shall be elected by the members.

In case no Human Rights Commission is appointed by the City Council, then the City Council shall assume all the duties and responsibilities set forth in Section 235.050.

A. 
Upon receipt of the report of the Human Rights Commission, the City Council shall review the matter and take such action as it deems appropriate by entering an order to cease and desist, or such other appropriate order, and shall cause such order to be served on all parties.
B. 
The City Council shall, in cases where it enters a cease and desist order, certify such case to the City Attorney and the City Prosecuting Attorney of the City of Richmond Heights for appropriate action.
