The Fire Department for the City shall consist of a Chief, Assistant Chief, officers, and such other personnel as recommended by the Chief with the approval of the City Manager.

The Fire Department shall have charge of its equipment. The department shall as often as practicable thoroughly test its condition and to keep same in good working order. Upon arrival at any fire, the members present shall take all necessary actions to extinguish the fire as quickly as possible with the least possible damage. The department will take all reasonable steps necessary to prevent the spread of fire and damage to property.

A. 
The City hereby declares its intent to become a member of MFFCIT and to participate thereof upon approval of the Board of Trustees of MFFCIT.
B. 
The Mayor is hereby authorized and directed to sign all documents necessary or expedient for the City to participate in the MFFCIT, including Trust/Pool Agreement and Bylaws, agreeing to adhere to the rules of said documents, and to be bound together with other members thereby.
C. 
The City staff are hereby authorized and directed to provide such assistance as may be necessary to carry out the intent of this Section.

For the purpose of training, Fire Department personnel shall meet at the fire station on Monday of each week at 7:00 P.M., and at such other times as they may be called together by the Chief.

The Fire Chief shall be appointed by and shall serve at the pleasure of the City Manager.

The Fire Chief shall have command of the Fire Department. The Chief shall exercise, taking care that each member is properly trained and drilled in the manner of discharging the duties assigned. The Fire Chief shall have charge and custody of all fire stations and property of the City under control of the Fire Department. He/she shall take care that such property is kept in good condition and repair, ready for immediate use. He/she shall attend all fires, as far as practicable.

The Fire Chief shall promulgate such rules and regulations as necessary for the operation of the Fire Department and not in conflict with the City Code, law or other established rules and regulations. The department's rules and regulations are subject to the City Manager's approval.

The Fire Chief shall appoint all members of the Fire Department subject to the approval of the City Manager. The members of the Fire Department serve at the pleasure of the Fire Chief.

The members of the Fire Department shall be in good physical condition and shall possess a valid State drivers license. The members shall be certified by the State of Missouri as Firefighter One within one (1) year of appointment and have a high school diploma or its equivalent.

Whenever an alarm of fire is sounded, each member of the department shall report promptly to the assigned place. The member is to remain on duty so long as required or until relieved from duty by the proper official.

When, in the judgment of the Chief of the Fire Department and with the City Manager's approval, he/she needs an Assistant Chief, he/she may appoint some competent person whose authority and responsibilities shall be the same as that of the Chief in his/her absence.

In the absence of the Fire Chief or when, for any reason, he/she is unable to discharge the duties of his/her office, the Assistant Fire Chief shall perform all duties and shall have the required authority of the office.

The use of the City Fire Department's equipment, including trucks and other equipment owned, leased or controlled by the City, is hereby restricted to use within the corporate limits; provided, that such firefighting equipment may be used to assist other municipalities, individuals, institutions or corporations, upon being so authorized or as authorized by the Fire Chief or City Manager or their representative.

The property belonging to the Fire Department shall not be loaned or hired to any person whatever, unless authorized by the City Manager or the Fire Chief or their representative.

The Fire Chief or his/her duly authorized representatives, as may be in charge at the scene of a fire or other emergency involving the protection of life and/or property, is empowered to direct such operations as may be necessary to extinguish or control any suspected or reported fires, leaks, or other hazardous conditions or situations or of taking any other action necessary in the reasonable performance of their duty. The Fire Chief may prohibit any person, vehicle or object from approaching the scene and may remove or cause to be removed from the scene any person, vehicle or object which may impede or interfere with the operations of the Fire Department. The Fire Chief may remove or cause to be removed any person, vehicle or object from hazardous areas. All persons ordered to leave shall do so immediately and shall not re-enter the area until authorized to do so by the Fire Chief or his/her designee.

It shall be unlawful to interfere with, attempt to interfere with, conspire to interfere with, obstruct or restrict the mobility of, or block the path of travel of any Fire Department emergency vehicle in any way, or to interfere with, attempt to interfere with, conspire to interfere with, obstruct or hamper any Fire Department operation.

A person shall not, without proper authorization from the Fire Chief or person in charge of said Fire Department emergency equipment, cling to, attach himself/herself to, climb upon or into, board or swing upon any Fire Department emergency vehicle, whether the same is in motion or at rest, or sound the siren, horn, bell or other sound-producing device thereon or to manipulate or tamper with or attempt to manipulate or tamper with any levers, valves, switches, starting devices, brakes, pumps, or any equipment or protective clothing on or a part of any Fire Department emergency vehicle.

It shall be unlawful for any person to damage or deface, or attempt, or conspire to damage or deface any Fire Department emergency vehicle at any time or to injure, or attempt to injure or conspire to injure Fire Department personnel while performing departmental duties.

A. 
It shall be unlawful to obscure from view, damage, deface, obstruct or restrict the access to any fire hydrant or any Fire Department connection for the pressurization of fire suppression systems, including fire hydrants and Fire Department connections that are located on public or private streets and access lanes.
B. 
If upon the expiration of the time mentioned in a notice of violation obstructions or encroachments are not removed, the Fire Chief shall proceed to remove the same. Cost incurred in the performance of necessary work shall be paid from the municipal Treasury on certificate of the Fire Chief and with the approval of the City Manager; and the legal authority of the municipality shall institute appropriate action for the recovery of such costs.

A person shall not use or operate any fire hydrant intended for use of the Fire Department for fire suppression purposes unless such person first secures permission for such use from the Fire Chief and City's Water/Sewer Department. This Section shall not apply to the use of such hydrants by a person employed by, and authorized to make such use by, the City's Water/Sewer Department or to another fire department while engaged in training drills or fire suppression within such fire shall be within the City or without.

The Fire Chief shall recommend the location or relocation of new or existing fire hydrants and the placement or replacement of inadequate water mains located upon public property and deemed necessary to provide an adequate fire flow and distribution pattern. A fire hydrant shall not be placed into or removed from service until approved by the Fire Chief.

All new and existing oil storage plants, lumberyards, amusement or exhibition parks, and educational or institutional complexes and similar occupancies and uses involving high fire or life hazards and which are located more than one hundred fifty (150) feet from a public street or which require quantities of water beyond the capabilities of the public water distribution system shall be provided with properly placed fire hydrants. Such fire hydrants shall be capable of supplying fire flows as required by the Fire Chief and shall be connected to a water system in accordance with accepted practices. The Fire Chief shall designate and approve the number and location of fire hydrants. The Fire Chief may require the installation of sufficient fire hose and equipment housed in accordance with the approved rules and may require the establishment of a trained fire brigade when the hazard involved requires such measures. Private hydrants shall not be placed into or removed from service until approved by the Fire Chief.

A person shall not obstruct, remove, tamper with or otherwise disturb any fire hydrant or fire appliance required to be installed or maintained under the provisions of the Fire Prevention Code except for the purpose of extinguishing fire, training or testing purposes, recharging or making necessary repairs, or when permitted by the Fire Chief. Whenever a fire appliance is removed as herein permitted, it shall be replaced or reinstalled as soon as the purpose for which it was removed has been accomplished. Defective and non-approved fire appliances or equipment shall be replaced or repaired as directed by the Fire Chief.

A person shall not sell, trade, loan or give away any form, type or kind of fire extinguisher which is not approved by the Fire Chief, or which is not in proper working order, or the contents of which do not meet the requirements of the Fire Prevention Code. The requirements of this Section shall not apply to the sale, trade or exchange of obsolete or damaged equipment for junk when said units are permanently disfigured or marked with a permanent sign identifying the unit as junk.

A person or persons shall not erect, construct, place or maintain any bumps, fences, gates, chains, bars, pipes, wood or metal horses or any type of obstruction in or on any street within the boundaries of the City. The word "street", as used in this Chapter, shall mean any roadway accessible to the public for vehicular traffic including, but not limited to, private streets or access lanes, as well as all public streets and highways within the boundaries of the City.

This Chapter shall take effect and be in full force from and after its approval as required by law. The Chief of the Fire Department is directed to establish an orderly procedure, subject to approval of the City Manager, for inspection of existing buildings and premises in order to implement the terms of this Chapter and the Code adopted herein.
