The following definitions shall apply in the interpretation and enforcement of this Article.
APPEARANCE
Any person conducting collection or solicitation activities shall be dressed in appropriate attire to include a uniform of the organization or reflective vest/garment.
APPLICATIONS
Applications will be considered in the order in which they are received during City Hall business hours between November first (1st) and December thirty-first (31st) of each year.
COLLECTION DATE/TIMES
Saturday between 8:00 A.M. and 2:00 P.M.
COLLECTION LOCATIONS
Main and Boyd Streets, Main and Miller Streets, and Main and East Miller Streets.
COLLECTION MONTHS
February, March, April, May, June, July, August, September, October and November.
COLLECTOR
Person making the collection over age sixteen (16) (if under age sixteen (16), must be accompanied by an adult).
INDICATOR
Organization to provide inexpensive indicator to recognize those who have made a contribution.
INSPECTION
The Police Department will be responsible for inspecting the collection locations on the collection days to insure rules/regulations are being followed.
INSURANCE
Certificate of insurance in the amount of one million dollars ($1,000,000.00) naming the City of De Soto as additional insured.
ORGANIZATIONS
Non-profit, not-for-profit, or charitable organizations.
SAFETY AND TRAFFIC INTERFERENCE
One (1) person at each intersection (unless under age sixteen (16), then must be accompanied by an adult). No chairs are to be used at the collection site.

A. 
The City Council is authorized to permit collections or solicitations by any non-profit, not-for-profit, or charitable organizations to be conducted on Main Street, subject to the following:
1. 
Collections or solicitations on Main Street will only be approved for non-profit, not-for-profit, or charitable organizations.
2. 
It will be each organization's responsibility to obtain the application from the City Clerk's office. Applications for collections or solicitations may be obtained any time during the calendar year from the City Clerk during City Hall business hours. They are to be submitted to the City Clerk only between November first (1st) and December thirty-first (31st) of each year. No requests will be accepted by the City Clerk after December thirty-first (31st) of each year.

Completed and valid applications will be considered in the order in which they are received. The City Council reserves the right to reject any application.
4. 
Collections or solicitations on Main Street are prohibited without prior approval by the City Council at its regular January meeting each year.
5. 
No organization shall receive approval for more than one (1) collection date per calendar year.
6. 
No more than fifteen (15) collection days will be allowed each calendar year. In the event there are two (2) organizations requesting the same month, two (2) collection days will be considered by the City Council. No collection dates will be approved for the months of December and January. Collections and solicitations by approved organizations on approved dates shall be conducted between the hours of 8:00 A.M. and 2:00 P.M.
7. 
The locations established for collections or solicitations on Main Street shall be restricted to the intersections of Main and Boyd Streets, Main and Miller Streets, and Main and East Miller Streets. Each organization is to limit the number of solicitors/collectors to two (2) people for each direction at an intersection (i.e., one (1) to cover the left turn lane and one (1) to cover the thru traffic). If under age sixteen (16), then the collector must be accompanied by an adult. For safety purposes, no chairs are to be used at the collection sites.
8. 
The organization shall be responsible for supervising the collection or solicitation activities in order to insure that such activities are conducted in a safe and orderly manner. By filing its application, the organization agrees to indemnify and hold the City harmless from any and all claims or liabilities arising out of or relating to the collection or solicitation activities. The organization further agrees to provide the City with a copy of their Certificate of Insurance in the amount of one million dollars ($1,000,000.00) naming the City of De Soto as additional insured. The certificate must include the endorsement.

Any person conducting collection or solicitation activities shall be dressed in appropriate attire to include a uniform of their organization or a reflective vest/garment.
10. 
Each organization shall provide an inexpensive indicator from their organization to recognize those who have made a contribution.
11. 
The Police Department will be responsible for inspecting the collection locations on the collection days to insure rules/regulations are being followed.
12. 
Any person conducting collection or solicitation activities in violation of this Section shall be guilty of a misdemeanor and shall be punished as provided in Section 100.090 of this Code.
