A. 
All so-called "garage sales" or other sales involving the offering for sale of multiple items of personal property on property occupied as a residence shall be subject to the following rules and regulations:
1. 
No person shall advertise, conduct, carry on or permit any garage, patio, yard or rummage sale on the grounds of or within any dwelling, within the City, on consignment.
2. 
Two (2) signs of a size no larger than eighteen (18) by twenty-four (24) shall be allowed to be displayed on the property of the premises where the garage sale, yard sale or estate sale is being conducted. No other signage is permitted, including those signs defined as Bandit or Snipe signs. Such signs shall be erected no more than three (3) days prior to the sale and removed at the end of the last day upon which the sale is held.

Not more than five (5) such sales per calendar year shall be held at the premises if occupied by the same family or any member of such family, nor shall more than one (1) of any such five (5) sales be held within one thirty (30) day period.
4. 
Any sale conducted pursuant to these provisions shall be confined to a period not to exceed two (2) days.

Any person conducting a sale shall be required to obtain a permit from the City. Applications for such a permit may be obtained at the De Soto City Hall and shall be accompanied by a permit fee in the amount of two dollars fifty cents ($2.50).
6. 
Any person violating any of these provisions shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined a sum of thirty-nine dollars fifty cents ($39.50) for a first (1st) offense, forty-nine dollars fifty cents ($49.50) for a second (2nd) offense and seventy-four dollars fifty cents ($74.50) for a third (3rd) offense. Each day during which any violation continues or exists shall be deemed to be a separate violation.

Applications for such permit may be obtained from De Soto City Hall and shall be accompanied by a permit fee in the amount of two dollars fifty cents ($2.50).

The provisions of this Chapter shall not apply to or affect persons selling goods pursuant to an order of process of a court of competent jurisdiction or persons acting in accordance with their powers and duties as public officials.

Any person violating any of the provisions of this Chapter shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined a sum not to exceed one hundred dollars ($100.00). Each day during which any violation of this Chapter continues or exists shall be deemed to be a separate violation.
