There is hereby created a City Planning Commission for the City of Mission.

The Planning Commission shall consist of nine (9) members, one (1) of whom may be a non-resident of the City of Mission. At least one (1) member shall be from each ward.

The Mayor, with the consent of the Council, shall appoint the members of the Planning Commission. Members shall be appointed for terms of two (2) years each except as otherwise herein provided. Vacancies shall be filled by appointment for the unexpired term only. The number of members may not be reduced unless a vacancy exists or unless the reduction takes effect at the end of a term. Members of the Planning Commission shall be appointed at the first (1st) regular meeting of the Governing Body in December. Members shall serve without compensation.

Meetings shall be scheduled as determined in the Planning Commission's bylaws, rules and regulations.

Officers shall be elected as determined in the Planning Commission's bylaws, rules and regulations.

The Commission shall adopt bylaws for the transaction of business and hearing procedures. Unless otherwise provided, no action by the Planning Commission shall be taken except by a majority vote of the membership thereof. The Commission may employ such persons deemed necessary and make contract for such services as the Commission requires. The Commission from time to time may establish subcommittees, advisory committees or technical committees to advise or assist in the activities of the Commission.

A record of all proceedings of the Planning Commission shall be kept.

The Governing Body shall approve a Planning Commission budget and make such allowances to the Planning Commission as it deems proper, including funds for the employment of such employees or consultants as the Governing Body may authorize and provide and shall add the same to the general budget. Prior to the time that monies are available under the budget, the Governing Body may appropriate monies for such purposes from the General Fund. The Governing Body may enter into such contracts as it deems necessary for the purposes of this act and may receive and expend funds and monies from the State or Federal Government or from any other source for such purposes.

At least once each year, the Planning Commission shall review or reconsider the comprehensive zoning plan or any part thereof and may propose amendments, extensions or additions to the same.

The violation of any provision of this Title or failure to comply with any of its requirements (including violations of conditions and safeguards established in connection with grants of variances or special exceptions) shall be deemed to be a public offense and any person, firm, association, partnership or corporation convicted thereof shall be punished by a fine not to exceed five hundred dollars ($500.00) or by imprisonment for not more than six (6) months for each offense or by both such fine and imprisonment and, in addition, shall pay all costs and expenses involved in the case. The City of Mission, Kansas, shall further have the authority to maintain suits or actions in any court of competent jurisdiction for the purpose of enforcing any provisions of this Title and to abate nuisances maintained in violation thereof; and in addition to other remedies, institute injunction, mandamus or other appropriate action or proceeding to prevent such unlawful erection, construction, reconstruction, alteration, conversion, maintenance or use or to correct or abate such violation or to prevent the occupancy of the building, structure or land. Each day any violation of this Title shall continue shall constitute a separate offense.
