Union City, NJ Chapter 16 Vehicles and Traffic

§ 16-1 Words and phrases defined.

Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle I of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

§ 16-2 Official time standard.

Whenever certain hours are named in this chapter, they shall mean either Eastern standard time or Eastern daylight saving time, as may be in current use in the City.

§ 16-3 Parking.

16-3.1. Regulations not exclusive. The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, or any other New Jersey statute or as hereinafter provided.

16-3.2. Parking prohibited during state of emergency.

a. Upon the declaration of an emergency, there shall be no parking upon the streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police, his/her designee or in his/her absence the ranking police officer, is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, fires or public celebrations dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that the EMERGENCY NO PARKING signs are being, or will be, posted shall be given the operator or owner of any vehicle which has been parked prior to the posting of the signs.

b. Whenever snow has fallen and the accumulation is such that it covers the street or highway, no vehicle shall be parked on the main traveled or major roadways or portions thereof as described in Schedule I attached to and made a part of this chapter. The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.

16-3.3. Parking prohibited at all times on certain streets. When signs are erected giving notice thereof, no person shall park a vehicle at any time upon any of the streets or parts of streets described in Schedule II attached to and made a part of this chapter.

16-3.4. Parking prohibited during certain hours on certain streets. No person shall park a vehicle on the days and between the hours specified in Schedule III attached to and made a part of this chapter.

16-3.5. Special parking provisions.

a. Stopping or parking restricted or prohibited on certain private property. Parking is prohibited at all times on certain private property owned by the Washington Urban Renewal Corporation or its successors. When signs are erected giving notice thereof, no person shall park a vehicle, unless vehicles permitted to be parked shall be properly identified, at any time in or upon the private parking area of the Washington Towers apartments located at 5th Street and Central Avenue more particularly referred to as the area to the east and north of the apartment building at 500 Central Avenue, and containing parking space for approximately 300 cars, when not authorized by the Washington Urban Renewal Corporation or its successors.

b. All night parking prohibited. It shall be unlawful for any owner, operator or corporation to park any truck, tractor, tractor trailer combination, omnibus, trailer, commuter van or any vehicle having a gross weight in excess of 4,000 pounds on any streets or parts of streets in the City between the hours of 9:00 p.m. and 6:00 a.m. The prohibition of this section shall not apply to passenger cars, station wagons or noncommercial vans, but shall apply to vehicles utilized as commercial motor vehicles as defined in N.J.S.A. 39:1-1.

c. Exceptions. The provisions of this subsection shall not apply to:

1. Vehicles of the City, fire apparatus, ambulances or vehicles engaged in the work of a public utility.

2. Vehicles actually engaged in making deliveries or rendering services in or upon the property adjacent to the street where such vehicle is parked.

3. Any recreational motor vehicle, travel trailer or house trailer, camper or boat trailer, provided that such vehicle is parked on private property and is parked in a manner so that no portion of the vehicle on the abutting property shall extend closer to the street than the front of the main portion of the building used for occupancy on the same premises, excluding any porch.

d. Violation. Any person who violates any of the provisions of this subsection shall be subject to a fine not to exceed $500 or subject to a penalty of 30 days in jail, or both.

16-3.6. Municipal parking lots. There shall be two municipal parking lots.

a. Locations.

1. Underground parking lot. The first municipal parking lot is located under the municipal building addition, having its entrance on Palisade Avenue, located near the 37th Street side of the municipal building. This municipal parking lot shall be known as the "underground parking lot."

2. Rear parking lot. The second municipal parking lot is located in the rear of the 38th Street side of the municipal building, having its entrance on the 38th Street side, behind the Police Department. This municipal parking lot shall be known as the "rear parking lot."

b. Access and use of lots. Both parking lots shall be for restricted parking only.

1. Underground parking lot. Five parking spaces shall be assigned for the use of the Mayor and members of the Board of Commissioners. All other parking spaces shall be for the use of certain City officials as assigned and authorized by the Mayor.

2. Rear parking lot. Parking spaces shall be assigned as follows:

(a) One parking space for the use of the Chief of Police.

(b) Two parking spaces for the use of two Deputy Chiefs of Police.

(c) Two parking spaces for the use of prisoner transport vehicles.

(d) Five parking spaces to be assigned by the Director of the Department of Parks and Public Property for the use of municipal maintenance vehicles.

(e) One designated parking space for handicapped residents doing business in the municipal building.

c. Removal of illegally parked vehicles. Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of parking, and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

d. Parking for Commissioners. There are hereby designated five parking spaces in the municipal parking lot for the exclusive use of members of the Board of Commissioners. Each space shall be assigned and marked by proper signage restricting parking to only those members.

e. Parking for Municipal Judge. There is hereby designated one parking space in the municipal parking lot for the exclusive use of the Municipal Court Judge. This space shall be assigned and marked by proper signage, restricting parking only to the Municipal Judge.

16-3.7. Residential permit parking program.

[Added 7-1-2013 by Ord. No. 16-2013[1]]

a. Residential only parking permit. The current residential parking program shall be amended as follows, effective January 1, 2014:[2]

1. At all times, from Monday through Saturday, 24 hours per day, except on announced holidays, parking shall be permitted only for those vehicles displaying a valid residential decal, business placard or visitor hangtag.

2. A resident, for purposes of this subsection shall be defined as:

(a) Any natural person holding title to real property located within the confines of the City of Union City;

(b) Any natural person occupying on a regular basis any rental unit pursuant to a written lease either for residential or commercial purposes;

(c) For a corporation having a principal place of business within the confines of the City of Union City, its chief executive or his or her designee; or

(d) Any other person who can legally demonstrate residence within the City of Union City.

3. The Parking Authority of the City of Union City (hereinafter to be referred as the "Parking Authority") shall cause appropriate signs to be posted and updated as necessary, prohibiting all parking, except parking by the holders of permits, placards and hangtags, to be granted only under the terms and conditions found in Subsection b.2.

4. A resident motor vehicle, business motor vehicle, City employee vehicle, or temporary motor vehicle on which is displayed a valid resident decal, visitor hangtag, or business or professional parking permit as provided for herein shall be permitted to stand or be parked within the confines of the City of Union City without being limited by time restrictions or area prohibitions established pursuant to this subsection. All other motor vehicles, other than vehicles where the operator or the passenger being transported by such a vehicle is physically disabled and the vehicle displays a license or placard issued under the provisions of N.J.S.A. 39:4-205, shall be subject to the prohibitions adopted by this subsection.

b. Residential parking permit: fees; expiration. The following rules and regulations shall apply as they pertain to the resident-only parking program:

1. A resident decal of a design specified by the Parking Authority will be issued to the owner of a vehicle, where such vehicle is owned or leased by a person residing in the City of Union City, provided such vehicle is a gross weight of not more than 3.8 tons. Such permit will be issued upon payment of an administrative fee of $15. City of Union City residents 62 years of age or older will be exempt from the aforementioned administrative fee.

2. Proof of the vehicle's owner or lessee must be presented when applying for a residential decal or visitor hangtags. Without limitation, acceptable proof of entitlement to a resident decal shall be established by a minimum of two of the following:

(a) A valid New Jersey driver's license bearing a valid Union City address;

(b) A valid New Jersey motor vehicle registration for the vehicle for which the permit is sought, bearing a valid Union City address;

(c) A current motor vehicle lease, whose named lessee possesses a valid Union City address;

(d) A deed or lease evidencing a right to possess a dwelling or commercial unit within the confines of the City of Union City;

(e) A notarized letter from a landlord reflecting an address within the City of Union City;

(f) Current bank statements evidencing a valid Union City address.

3. Resident permits shall expire every third calendar year; and business permits and professional permits shall expire every calendar year, as reasonably determined by the Parking Authority. Any vehicle bearing an expired resident permit, business permit or professional permit which shall park on a street in the City of Union City shall be subject to the same penalty as a vehicle having no such permit as set forth in Subsection j.

c. Temporary permits.

1. Any owner of or lessee of any residential or commercial property in the City of Union City, which owner or lessee does not possess a valid New Jersey registration or New Jersey motor vehicle operator's license, shall not be eligible for the traditional resident permit. Any such owner or lessee, upon presentation of proof of a deed, mortgage, lease or letter from the property owner to the Parking Authority, shall receive a thirty-day temporary resident parking permit. Such permit shall issue only upon payment of an administrative fee of $10 for said thirty-day temporary permit.

2. Upon expiration of the initial temporary permit, a holder of such permit may reapply to the Parking Authority for one additional thirty-day permit pursuant to the terms specified in Subsection c.1. The subsequent thirty-day resident parking permit shall be reissued only upon payment of the administrative fees specified in Subsection c.1.

d. Daily visitor parking permit hangtags. Visitor hangtags of a design specified by the Parking Authority will be issued to any resident of the City of Union City who meets the following qualifications and requirements:

1. A resident who would be eligible for a Parking Permit pursuant to the qualifications outlined in Subsection a, provided no other person in the same household has been issued a resident parking permit.

2. Daily visitor parking permit hangtags may be purchased from the Parking Authority individually for $1 per daily permit or as book of 30 daily permits for $25. Visitor hangtags shall not be resold, transferred or assigned. Visitor hangtags are for use by visitors only, while visitors are actively visiting the households to which the hangtags are issued. Use of a visitor permit other than as permitted by this subsection will constitute a violation of this subsection and may result in issuance of a summons or revocation of the applicant's privilege to obtain additional visitor permits for a period of one year, or both.

3. All daily visitor parking permit hangtags are to be displayed prominently in the front windshield where they are easily visible and fully readable from the exterior of the vehicle.

4. Daily visitor parking permit hangtags shall not be required on announced legal holidays.

e. Business permits.

1. Business establishments located in the City of Union City may obtain a business parking permit for any nonresident employee or business owner of such business establishment who commutes into Union City for purposes of fulfilling his or her obligations to such business.

2. "Union City business establishment" shall be deemed to include, without limitation, the City of Union City and all its government agencies, Board of Education, Parking Authority and day-care centers.

3. All requests for business permits shall be made in writing on a form designated by the Parking Authority and shall be executed by the owner, CEO or responsible officer of the employer (or a director, in the case of the City of Union City, or the business manager or secretary, in the case of the Union City Board of Education, or the Chief of Police or his or her designee, in the case of the Union City Police Department).

4. The Parking Authority shall be entitled to obtain periodic verification of all relevant information and shall have the authority to invalidate or not renew any business permit issued pursuant to this subsection if the information indicates that nonentitlement is appropriate.

5. The nonresident business owner or employee shall pay a fee of $50 for a business permit. All fees shall be paid to the Parking Authority. Business permits shall be valid for a period of one calendar year. All fees collected by the Parking Authority pursuant to this subsection shall be subject to the veto of the Board of Commissioners.

f. Exceptions. The restrictions contained herein shall not apply to the following categories of vehicles under the following circumstances:

1. Service and delivery vehicles. Service and delivery vehicles bearing commercial license plates and/or the name and address of a commercial business may park without a resident permit, business permit or visitor hangtag, provided said vehicle is in the actual performance of its duties or rendering the required service, not to exceed four hours.

2. Contractors. Contractors may park in resident parking areas only after having made application to the Parking Authority and having provided written documentation from the Union City Building Department that such work is known, approved and ongoing. The fee associated with such permits shall not exceed $15 per day and may only be used Monday through Friday, 7:00 a.m. to 6:00 p.m.

3. Emergency vehicles. Emergency vehicles and public service, telephone and other utility vehicles may park without a resident permit, business permit or visitor hangtag during the time required to render assistance to persons, complete needed repairs and/or effectuate improvements to any facility under their control within the area.

4. Nonprofit institutions or corporations. As is reasonably determined by the Parking Authority, such institution or corporation which maintains an office in the City of Union City may be issued resident parking permits for vehicles which are registered in the name of the nonprofit entity and which are housed in the City of Union City, without charge, pursuant to Subsection a.2(c). The issuance of such permit shall be subject to appropriate and periodic verification as to the continued qualification for the same as reasonably determined by the Parking Authority.

g. Authority.

1. The Parking Authority shall have the authority to formulate and promulgate rules and regulations consistent with this subsection to effectuate the purposes set out in the preamble of this subsection.[3]

2. All fees to be collected pursuant to this subsection shall be set by the Parking Authority in its reasonable discretion and subject to the veto of the Board of Commissioners.

3. A schedule of all applicable fees set pursuant to this subsection shall be available for public inspection during regular business hours at the office of the Parking Authority and at the office of the City Clerk.

h. Adjoining communities.

1. In the event that any community adjoining or abutting the City of Union City shall institute or shall have instituted an ordinance, resolution, or other policy enforcing a residents-only parking program applicable to any street, the center line of which serves as the boundary between the City of Union City and the adjoining or abutting community, that in exchange for reciprocal provisions in the ordinance of the adjoining or abutting community, those vehicles displaying a valid resident or visitor permit issued by the adjoining or abutting community shall have the privilege of parking on that portion of the boundary street under the jurisdiction of Union City, should the like privilege be extended to vehicles displaying a valid City of Union City resident decal or visitor hangtag, allowing same the privilege of parking on that portion of the boundary street under the jurisdiction of the adjoining or abutting community.

2. Pursuant to this subsection, the Corporation Counsel shall evaluate any ordinance, resolution or other policy enforcing resident-only parking passed by any adjoining or abutting community and present to the Board of Commissioners its opinion as to substantial compliance with the terms of this subsection. The Board of Commissioners shall then exercise its discretion in determining whether such ordinance, resolution or policy shall be sufficiently reciprocal to extend such privileges as provided by this subsection. Further, the Corporation Counsel shall be authorized to conduct discussions with any community adjoining or abutting the City of Union City to assist in negotiations to effect such ordinances as may be necessary or such modifications to existing ordinances of the abutting or adjoining communities to render same to be substantially reciprocal to the terms of this subsection.

i. Reciprocity with the Township of Weehawken.

1. Those vehicles bearing valid resident parking permits or visitor hangtags issued by the Township of Weehawken shall be permitted to park such vehicles on the portions of those streets under the control of the City, in accord with the terms of this subsection and any rules and regulations implementing this subsection as are applicable to vehicles bearing valid City of Union City parking permits or visitor hangtags, as designated on the schedule below:

(a) Palisade Avenue, from the southwest intersection of 27th Street to the northwest intersection of 20th Street.

(b) Park Avenue, from 32nd Street to 49th Street.

2. Those vehicles not bearing a valid parking permit or visitor hangtag issued by the Township of Weehawken or the Weehawken Parking Authority, and/or by the City of Union City or an approved agency thereof, found parked on those portions of the streets designated above shall be subject to any or all of the penalty provisions of the resident parking program, pursuant to this subsection.

j. Violations and penalties.

1. Any vehicle parked on a street in the City of Union City without a valid and current resident parking permit, temporary permit, business permit or daily visitor hangtag shall be subject to a fine not to exceed $60.

2. The Parking Authority may refuse to issue a parking permit to any person or persons where it finds that the applicant purposely provided false information on an application thereof.

3. It shall be unlawful and a violation of this subsection for a person holding a valid parking permit issued pursuant hereto to permit the use of such permit on any motor vehicle other than that for which the permit was issued. Anyone in possession of a parking permit who misuses or allows the misuse of a permit is subject to a fine of $100 for the first offense and a fine of $200 for any subsequent offense.

4. It shall be unlawful and a violation of this subsection for a person to copy, reproduce or otherwise bring into existence a facsimile or counterfeit parking permit or permits. A violation of this subsection shall be a disorderly persons offense. The person committing the aforementioned act shall also be subject to a penalty of $750 for the first offense and a fine of $1,200 for each subsequent offense, and/or imprisonment for not more than five days. A person committing the aforementioned act may also be sentenced to community service for up to 30 days for each such violation.

5. In the event that a Union City resident is issued a summons for a violation of the resident parking program, that resident may, at the time scheduled for hearing in the Municipal Court:

(a) Produce evidence that the person has in fact been issued a valid resident parking permit. Such person or persons shall be afforded a single, one-time affirmative defense to the alleged violation, regardless of the date upon which the said permit was issued.

(b) Upon presentation of sufficient evidence that the person was a resident at the time of the alleged offense, the person may request an adjournment of the matter from the court for a reasonable period of time during which time the person may make an application to the Parking Authority for a resident parking permit. The person may then present the resident parking permit at the time of the adjournment hearing date which shall provide an affirmative defense to the alleged violation.

(c) The aforementioned affirmative defense offered to the City resident for a violation of the resident parking program shall be limited to one violation of the resident parking program and shall be unavailable for subsequent violations.

6. Any vehicle parked on a street in the City of Union City without a valid resident permit, temporary permit, business permit or visitor hangtag will have a two-hour grace period, after which the vehicle will be subject to being ticketed and towed.

k. Payment of sums to Parking Authority. The Union City Parking Authority shall receive from the City of Union City the sum of $8 for each summons written in the City for violation of Subsection j.1 of the within subsection and a sum equal to 50% for each summons written in the City for violation of Subsections j.2 and j.3. Said sums shall be paid to the Parking Authority only for those parking violations where the applicable fine has been collected by the City of Union City Municipal Court and paid to the City of Union City.

l. Repealer. All ordinances or parts of ordinances inconsistent with the provisions of this subsection are hereby repealed to the extent of such inconsistency.

m. Severability. All provisions of this subsection are severable, and if any portion of this subsection shall be held to be invalid, the remaining portions of this subsection shall not be invalidated.

n. When effective. This subsection shall be effective upon passage, approval and publication in accordance with law.

o. Codification. This subsection shall be part of the Union City Revised Ordinances as though codified and fully set forth therein. The City Clerk shall have this subsection codified and incorporated in the official copies of the Union City Ordinances.

p. Implementation. This subsection shall take effect at the time and in the manner as provided by law.

q. Authority to issue summonses. The Parking Authority and the Union City Police Department shall have the power and the authority to issue summonses for violations of this subsection; provided, however, that in the case of a summons issued for misuse of a resident permit, such summonses shall be issued by the Municipal Court of the City of Union City.

r. Enforcement. Enforcement of this subsection and further rules and regulations as may be promulgated from time to time shall be under the jurisdiction of either the Union City Parking Authority and/or the Union City Police Department, as determined by the Director of Public Safety.

16-3.8. 

Permitted parking in front of private driveways.

[Added 2-4-2003]

(a) In general. In accordance with N.J.S.A. 39:4-138.3 et seq., parking of motor vehicles in front of private driveways shall be permitted in the following instances; provided, however, that there is not otherwise space for parking within the driveway, that such parking is entirely within and parallel to the street, is not otherwise prohibited and does not interfere with the safe and normal flow of traffic:

(1) Whenever both the motor vehicle and driveway involved are owned by the same person;

(2) Whenever the motor vehicle is owned by a member of the same household as the owner of the private driveway; or

(3) Whenever the owner of the private driveway authorizes the parking of a motor vehicle in front of the private driveway.[4]

16-3.10. 

Parking of commercial vehicles. Commercial vehicles may park on any street within the City of Union City, subject to the restrictions of Section 16-3.11.

16-3.11. Notwithstanding the provisions of Section 16-3.10 above, no commercial vehicle may park on any City streets between the hours of 9:00 p.m. and 7:00 a.m. unless the commercial vehicle can meet all of the conditions set forth in Section 16-3.8 of this chapter.

§ 16-4 Traffic restrictions.

16-4.1. Limiting the use of streets to a certain class of vehicle. Trucks over four tons' gross weight are excluded from streets or parts of streets described in Schedule V, attached to and made a part of this chapter, except for the pickup and delivery of materials.

16-4.2. One-way streets designated. The streets or parts of streets designated in Schedule VI, attached to and made a part of this chapter, are hereby designated as one-way streets in the direction indicated.

16-4.3. Through streets. Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described in Schedule VII, attached to and made a part of this chapter, are hereby designated as through streets. STOP signs shall be installed on the near right side of each street intersecting the through street except where YIELD signs are provided for in the designations.

16-4.4. Stop intersections designated. Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections described in Schedule VIII, attached to and made a part of this chapter, are hereby designated as stop intersections. STOP signs shall be installed as provided therein.

16-4.5. Left turns.

a. No person shall make a left-hand turn on South Marginal Highway at Pleasant Avenue.

b. No person shall make a left-hand turn on South Bergenline Avenue at 49th Street.

16-4.7. Traffic control signals.

a. Traffic control signals shall be installed and operated at certain intersections as specified in Schedule IX, attached to and made a part of this chapter. Such installations shall be in accordance with the provisions of N.J.S.A. 39:1 et seq., and shall conform in design and be maintained in operation as authorized by the Department of Transportation.

b. A resolution will be adopted setting forth the Traffic Control Signal Maintenance Program Regulations.

16-4.8. No right turns. No person shall turn a vehicle to make a right turn when facing a steady red (STOP) indication at any of the locations specified in Schedule XI, which is attached to and made a part of this chapter, whenever an official sign is present prohibiting such a turn on the red signal.

16-4.9. Loading zones. The locations described in Schedule XII, attached to and made a part of this chapter, are hereby designated as loading zones.

16-4.10. Bus/commuter vehicle stops.

a. Locations. The locations described in Schedule XIII, attached to and made a part of this chapter, shall be designated as the only areas within the City that buses or any other commuter vehicles, as licensed and/or regulated by the New Jersey Department of Transportation, shall stop for the purpose of loading and unloading commuters. These locations shall have installed the appropriate signage and markings, as provided by law.

b. Exceptions. The only exception permitted and in accordance with the New Jersey Transit Request-A-Stop program, passengers may request to disembark at areas not designated as "Bus/Commuter Vehicle Stop" areas only between the hours of 8:00 p.m. and 4:00 a.m.

c. Bus stop length. The bus stops lengths shall be as follows:

	Near side: 90 feet plus the distance from the curbline to the end of the curb return, property line or crosswalk to the total length of 105 feet.
	Far side: 85 feet plus the distance from the curbline to the end of the curb return, property line or crosswalk to the total length of 105 feet.
	Mid-block (no intersection on either side of roadway): Standard length is 135 feet.

d. 

Locations.

(1) Parking is hereby permitted in the bus/commuter vehicle stops listed in Schedule XIII between the hours of 10:00 p.m. and 6:00 a.m. the following day, except as follows:

(a) Parking shall not be permitted in the bus stops listed in Schedule XIII on 30th and 31st Streets; exempt; and

(b) Except as otherwise provided herein with respect to Bergenline Avenue, parking shall be permitted in the bus stops listed in Schedule XIII on Bergenline and New York Avenues, north of Route 495, only between the hours of 11:00 p.m. and 6:00 a.m. the following day. Further, parking shall be permitted in the bus stops along Bergenline and New York Avenues, south of Route 495, between 10:00 p.m. and 6:00 a.m. the following day. Notwithstanding the foregoing, parking shall not be permitted in the bus stops listed in Schedule XIII on Bergenline Avenue between 30th Street and 47th Street at any time.

(2) Any unoccupied vehicle parked or standing in a bus/commuter vehicle stop at any time other than that permitted by this section shall be deemed a nuisance and a menace to the safe and proper regulation of parking and operation of buses and commuter vehicles.

(3) Any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable cost of the removal and storage which may result from such removal before regaining possession of the vehicle.

16-4.11. Pursuant to N.J.S.A. 39:4-140, the intersections described in Schedule XIV, attached to and made a part of this chapter, are hereby designated as stop intersections. Four-way STOP signs and PEDESTRIAN signs shall be installed at the intersections listed in Schedule X.

16-4.12. It shall be unlawful to park or operate any type of vehicle in a manner that will in any way block or obstruct access to curb cuts located on any sidewalk or walkway or any other public place throughout the City of Union City.

16-4.13. Pedestrian crosswalks.

a. 

There should be installed a marked pedestrian crosswalk at the intersection of Park Avenue and 39th Street at the northwest corner.

(1) No operator of a vehicle shall fail to yield the right-of-way to pedestrians in or at the marked pedestrian crosswalk at the intersection of Park Avenue and 39th Street.

(2) Any person violating this section shall be liable to the penalties set forth in Section 16-6 of this chapter.

b. There shall be installed a marked pedestrian crosswalk at the intersection of Park Avenue and 41st Street at the northwest corner.

1. No operator of a vehicle shall fail to yield the right-of-way to pedestrians in or at the marked pedestrian crosswalk at the intersection of Park Avenue and 41st Street.

2. Any person violating this section shall be liable to the penalties set forth in Section 16-6 of this chapter.

c. There shall be installed a marked mid-street pedestrian crosswalk at 900 22nd Street and in-street signs marking the pedestrian crosswalk which shall conform to the current Manual on Uniform Traffic Control Devices.

1. No operator of a vehicle shall fail to yield the right-of-way to pedestrians in or at the marked pedestrian crosswalk in 22nd Street.

2. Any person violating this section shall be liable to the penalties set forth in Section 16-6 of this chapter.

§ 16-5 Washington Park Towers regulations.

16-5.1. Parking in designated areas. All vehicles must park only in designated areas and between the lines provided.

16-5.2. Handicapped parking. All stalls shall be 12 feet wide and signed with R7-8, RESERVED PARKING sign and penalty plate, in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.

16-5.3. Permit parking. All lots have parking by permit only.

16-5.4. Parking time limited. No person shall park a vehicle for longer than the time limit indicated upon any of the streets or parts of streets described:

16-5.5. Reserved parking. Parking Lot A has reserved parking as indicated on the site plan. All vehicles must be properly identified.

16-5.7. Tow away. Any vehicle parked or standing so as to obstruct or impede a normal flow of traffic, block entrances or exitways, loading zones, oil fills, any grass area, pedestrian walkway or present in any way a safety or traffic hazard may be removed by towing the vehicle at the owner's or operator's expense.

16-5.8. Stop intersections. The following intersections are hereby designated as stop intersections. STOP signs shall be installed as provided therein:

16-5.10. Speed limits.

a. The speed limits for both directions of traffic in the parking lots shall be 15 miles per hour.

b. The speed limits for both directions of travel on all roads shall be 15 miles per hour for their entire length.

c. Regulatory and warning signs shall be erected and maintained to effect the above-designated speed limits authorized by the Department of Transportation.

16-5.11. Installation of signs. All signs, posts or other necessary materials shall be installed and paid for by the applicant. Work shall be checked by the Police Department to ensure installations meet state and federal specifications, and all signing shall conform to the current Manual on Uniform Traffic Control Devices.

16-5.12. Violations and penalties. Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of this section or any supplement thereto shall be liable to a penalty of not more than $101 or imprisonment for a term not exceeding 15 days, or both.

§ 16-6 Violations and penalties.

16-6.1. General penalty. Unless another penalty is expressly provided by New Jersey Statute, a person convicted of a violation of this chapter or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days, or both.

16-6.2. Specific penalties. The following penalties shall supplement the Violations Bureau Schedule of Penalties.

Three dollars of the penalties listed in the specific penalties, above, shall be dedicated by rider to the Union City Parking Authority for uses as established by the Authority. One dollar shall be dedicated to the state pursuant to law. The remainder shall be issued to the City. These increases proposed shall be subject to all applicable state and local approvals.

§ 16-7 School zones.

The following school zones will have a speed limit of 15 miles per hour:

a. Washington School on 39th Street from New York Avenue to Bergenline Avenue and on 40th Street from New York Avenue to Bergenline Avenue and on New York Avenue from 39th Street to 40th Street and on Bergenline Avenue from 39th Street to 40th Street.

b. Roosevelt School on Roosevelt Street from Hudson Avenue to Palisade Avenue and on 46th Street from Hudson Avenue to Palisade Avenue and on Palisade Avenue from Roosevelt Street to 46th Street and on Hudson Avenue from Roosevelt Street to 46th Street.

c. Robert Waters School on 29th Street from Summit Avenue to Central Avenue and on 28th Street from Summit Avenue to Central Avenue and on Summit Avenue from 28th Street to 29th Street and on Central Avenue from 28th Street to 29th Street.

d. Edison School on 4th Street from Central Avenue to West Street and on 8th Street from Central Avenue to West Street and on Central Avenue from 4th Street to 8th Street and on West Street from 4th Street to 8th Street.

e. Jose Marti School on 18th Street from Summit Avenue to West Street and on 21st Street from Summit Avenue to West Street and on Summit Avenue from 18th Street to 21st Street and on West Street from 18th Street to 21st Street.

i. Colin Powell Elementary School on New York Avenue from 15th Street to 16th Street and on Palisade Avenue from 15th Street to 16th Street and on 15th Street from New York Avenue to Palisade Avenue and on 16th Street from New York Avenue to Palisade Avenue.

j. Emerson Middle School on Bergenline to Palisade Avenue from 18th Street to 19th Street and on New York Avenue from 18th Street to 19th Street and on 18th Street from Palisade Avenue to New York Avenue and on 19th Street from Palisade Avenue to New York Avenue.

k. Union Hill Middle School on Hudson Avenue from 38th Street to 39th Street and on Park Avenue from 38th Street to 39th Street and on 38th Street from Hudson Avenue to Park Avenue and on 39th Street from Hudson Avenue to Park Avenue.
