Cross Reference — Ord. no. 1787 adopted September 4, 1990, established a fee for a "911" emergency assistance system at $.75 per telephone line connection and $1.00 per commercial telephone line connection located within the City limits.

This Chapter consists of the rules and regulations for the operation of the Police Department of this City. To the extent that this Chapter conflicts with the provisions of the Personnel Policies, this Chapter shall prevail.

The Sullivan Police Department shall be supervised by the Chief of Police who shall be appointed by the Mayor with the consent and approval of the majority of the member of the Board of Aldermen. The Chief of Police shall be responsible for establishing standards, qualifications, rules, regulations, codes of conduct, operational procedures, departmental assignments and other departmental regulations for the Sullivan Police Department as may from time to time by him/her be deemed necessary and consistent with the personnel policies adopted by the Board of Aldermen.

A. 
The Chief of Police shall possess the following qualifications:
1. 
Be between the ages of twenty-one (21) and sixty-five (65) years of age.
2. 
Be of good moral character and shall not have been convicted of any non-traffic misdemeanor or felony.
3. 
Be a graduate from a college or university of recognized standing and accreditation with a degree of special emphasis in Police science or law enforcement; or have special training in Police administration and at least five (5) years of successful experience in Police work.
4. 
Possess a certificate issued by the Director of the Department of Public Safety under the provisions of Chapter 590, RSMo.
B. 
All applicants for the office of Chief of Police shall be interviewed by the Mayor and the Board of Aldermen of the City of Sullivan, Missouri.

The Chief of Police of Sullivan, Missouri, is hereby authorized to collect and give receipt for all bond money that is put up guaranteeing the appearance of any person who has been arrested in the City of Sullivan, Missouri, and to hold the same until the matter has been disposed of in court, at which time he/she is to refund the money to said individual if said individual has been found not guilty of the charge and in the event that said individual is found guilty of the charge and a fine has been assessed, then he/she is to deliver the money to said individual so the Clerk of the City of Sullivan can deduct the amount of the fine and court costs from said bond money and turn over the balance to the individual.

The Chief of Police shall devote his/her entire time to the discharge of his/her official duties. He/she shall not be absent from the City except in the performance of his/her official duties or when granted leave of absence by the Mayor or when off duty and he/she leaves information as to his/her destination with the Police Officer then in charge.

The Chief of Police shall appoint, discharge and discipline members of this Police Department upon the ratification and approval of the Mayor and Board of Aldermen pursuant to Section 79.240, RSMo., as amended.

A. 
The Chief of Police shall have power at all times to make or order an arrest, with proper process, for any offense against the laws of the City or of the State and to keep the offender in the City prison or other proper place to prevent his/her escape until trial can be had before the proper officer, unless such offender shall give a good and sufficient bond for his/her appearance for trial. The Chief of Police shall have power to make arrests, without process, in all cases to which any offense against the laws of the City or of the State shall be committed in his/her presence.
B. 
The Police of the City of Sullivan, Missouri, shall have power to serve and execute all warrants, subpoenas, writs or other process and to make arrests in the same manner as the Chief of Police. The Chief of Police and Police Officers shall be conservators of the peace and shall be active and vigilant in the preservation of good order within the City.

Notice must be given to the Mayor before any member of the department files a civil suit for the collection of damages sustained while on duty.

A. 
Any Police Officer of the City of Sullivan, Missouri, who has completed the basic training program as established by Chapter 590, RSMo., shall have the authority to respond to an emergency situation outside the boundaries of the City of Sullivan, Missouri, within the appropriate geographical boundaries and under such rules and regulations as shall be prescribed by the Chief of Police of the City of Sullivan, Missouri. However, before the rules and regulations regarding the subject matter of this Section shall go into effect, they shall be approved by the Board of Aldermen of the City of Sullivan, Missouri.
B. 
Emergency Situation. As used in this Section, "emergency situation" means any unforeseen combination of circumstances or events involving danger or eminent danger to human life or property which requires immediate attention.

No City Policeman shall receive or accept any gifts, gratuity or pay either in money or goods or other thing of value from any person whosoever except as may otherwise be approved or provided by ordinance or resolution.

Any Police official of the City of Sullivan, Missouri, receiving or paying out any money belonging to the City shall forthwith report the same, with proper vouchers, to the City Clerk, provided that if a fixed time for making such report is provided in some other ordinance, then such time shall govern.

A. 
The Chief of Police shall be authorized to sell all unclaimed personal property, except guns, recovered by the Police Department. Items shall be retained by the Police Department for at least sixty (60) days from the date of possession. If the property is not claimed by its owner within sixty (60) days, the Chief of Police may sell the property at public auction.
B. 
All sales of personal property shall be at public auction. The City Clerk shall cause notice of said sale to be published in the local newspaper at least seven (7) days prior to the sale.
C. 
The proceeds of said sale, after deducting the expenses of sale, shall be deposited in the General Revenue Fund of the City of Sullivan, Missouri, and shall be accompanied by an itemized list of expenses of the sale and verified list identifying the article sold, the sale price and the name of the purchaser.

All monies held by the Chief of Police of the Sullivan Police Department and unclaimed by any person, firm or corporation within ninety (90) days of the date said funds come into possession of the Chief of Police shall be paid into the Treasury of the City of Sullivan, Missouri, and remain on deposit in the General Fund until such time as the true and rightful owner thereof shall offer the satisfactory proof of ownership or shall obtain an order by a court of competent jurisdiction that said monies be paid to the owner thereof.
The Board of Aldermen of the City may by ordinance enter into a contract or agreement with any other political subdivision for the provision of Police services by one political subdivision to another on request as provided for in Section 70.815, RSMo. The terms "Chief of Police", "Police", "Police Officer" and "Police Department", as used herein, shall refer to Law Enforcement Officers of the contracting entity.
