As used in this Chapter, the following terms mean:
ANIMAL CONTROL OFFICER
A person designated by the City of Sullivan as a Law Enforcement Officer to enforce the provision of this Chapter and all ordinances pertaining to health and nuisances.
ANIMAL SHELTER
Any premises designated by City administrative authority for the purpose of impounding and caring for animals held under authority of this Chapter.
ANIMALS
Any living creature, domestic or wild.
AT LARGE
Off the premises of the owner and not under the control of the owner or a member of his/her immediate family, either by leash or otherwise.
CIRCUS
A non-resident variety show which features performing animals.
EUTHANIZE
To put to death in a humane manner.
EXPOSED TO RABIES
When bitten by, or fought with, or has come in close contact with a dog or other animal shown to be infected with the rabies virus as determined by standard laboratory testing.
HUMANE OFFICER
Any person designated by the Humane Society as a Law Enforcement Officer and who qualifies to perform such duties under the laws of the State of Missouri.
HUMANE SOCIETY
Any organization for the prevention of cruelty to animals or children incorporated under the laws of the State of Missouri.
IMPOUNDING
The apprehending, catching, trapping, netting, tranquilizing, confining of, if necessary, the destruction of any animal by the Animal Control Officer, a veterinarian or by any employee or agent of the City.
KEEPING AND HARBORING
Any person who shall allow any animal to habitually remain or to lodge or to be fed within his/her home, store, yard, enclosure or place shall be deemed and considered as keeping and harboring said animal.
KENNEL
Any person, partnership or corporation engaged in the business of breeding, buying, selling or boarding dogs and cats or engaged in the training of dogs for guard or sentry purposes.
NOT UNDER REASONABLE CONTROL
A dog shall be deemed to be not under reasonable control when such dog not being upon the premises of its owner, if not with or under the control of its owner, the owner's agent or some member of the owner's family or when such dog commits damage to the person or property of anyone other than its owner, except when the dog is in defense of its owner, his/her family or property.
OWNER
Any person, partnership or corporation owning, keeping or harboring animals.
PERSON
An individual, partnership or company or corporation.
PET SHOP
Any person, partnership or corporation engaged in the business of breeding, buying, selling or boarding animals of any species.
PIT BULL DOG
Any and all of the following dogs:
1. 
The Staffordshire Bull Terrier breed of dogs.
2. 
The American Staffordshire Terrier breed of dogs.
3. 
The American Pit Bull Terrier breed of dogs.
4. 
Dogs which have the appearance and characteristics of being predominately of the breeds of the dogs known as Staffordshire Bull Terrier, American Pit Bull Terrier or American Staffordshire Terrier.
REASONABLE CONTROL
As used herein is deemed to be when such dog is on the premises of its owner or when such dog is not on the owner's premises with and under control of its owner, his/her agent or some member of the owner's family.
RESTRAINT
An animal shall be deemed to be under restraint if on the premises of its owner or if accompanied by a responsible person and under that person's control.
THEATRICAL EXHIBIT
Any exhibition or act featuring performing animals.
VACCINATE
The injection by a veterinarian or his/her authorized agent of a specified dose of anti-rabies vaccine into the body of a dog, cat or susceptible animal, such vaccine having the U.S. Government license number approval stamped on the label of the vaccine container.
VETERINARY HOSPITAL
Any establishment maintained and operated by a licensed veterinarian for the boarding of animals or the diagnosis and treatment of diseases and injuries of animals.
ZOOLOGICAL GARDEN
Any park or zoo operated by a person or private corporation.

The Animal Control Officer shall have the powers of arrest and authority necessary to enforce the provisions of this Chapter and any ordinances dealing with a nuisance or health violation.

The Chief of Police shall supervise the activities of the Animal Control Officer. The Chief of Police and members of the Police Department shall have authority to enforce the provisions of this Chapter.

Fees for animal control services such as vaccinations, incineration, humane destruction, boarding and adoption, shall be as set out in Section 160.040 of this Code.

A. 
It shall be unlawful for any person to permit any dog or other animal, whether vaccinated or not, to run at large or to go off the premises of its owner unless such dog or other animal is under restraint or control as defined in this Chapter.
B. 
In a prosecution charging a violation of this Chapter, proof that a dog or other animal was running at large in violation of this Chapter, together with proof that defendant named in the complaint was at the time described in the complaint the person who owned such dog or other animal, shall constitute a prima facie presumption sufficient for conviction that the owner was the person who permitted such animal to run at large.
C. 
The provisions or prohibitions of Subsection (A) shall not apply to bloodhounds or other dogs used for tracking in conjunction with Police activities, to dogs of the Canine Corps of a Police force of any municipality, Missouri State Highway Patrol, of any Federal law enforcement agency nor of any branch of the armed forces of the United States while being used to conduct official business or while being used for official purposes.

The entire area embraced within the corporate limits of the City is hereby designated as a bird sanctuary. No person shall trap, hunt, shoot or attempt to shoot or molest in any manner any bird or wild fowl or to rob bird nests or wild fowl nests. If starlings or similar birds or found to be congregated in such numbers in a particular locality that they constitute a nuisance or menace to health or property, in the opinion of the proper authorities of the City, the City may take such action as is necessary to dispense with the nuisance or menace to health or property.

No person or persons shall permit any geese, ducks, chickens, turkeys and all other domestic fowls to run at large. The owner or owners, keeper or possessors of same shall keep such fowls, geese, ducks, chickens and turkeys on the premises of such owner, keeper or possessor of same.
