The following codes are hereby adopted, providing minimum standards to safeguard the health and welfare of all persons through properly designed, acceptably installed and adequately maintained water wells: the Illinois State Water Well Construction Code of the Illinois Department of Public Health and the Illinois State Water Well Pump Installation Code of the Illinois Department of Public Health, except such portions of said codes as may herein or hereafter be expressly deleted, modified or amended by duly adopted ordinances of the Village.
Three copies of the Illinois Water Well Construction Code and three copies of the Illinois Water Well Pump Installation Code shall be kept on file at all times in the office of the Village Clerk.
A. 
Wherever the term "municipality" appears in the Illinois State Water Well Construction Code or the Illinois State Water Well Pump Installation Code, it shall mean the Village of Bannockburn.
B. 
Wherever the term "administrative authority" or "Plumbing Inspector" appears in the Illinois State Water Well Construction Code or the Illinois State Water Well Pump Installation Code, it shall mean the Bannockburn Building and Zoning Commissioner, the Bannockburn Water and Sewer Commissioner, their duly designated representatives and such other person or persons as may be appointed and authorized by the Village to carry out the provisions of the codes.

A. 
The Illinois Water Well Construction Code (77 Ill. Adm. Code Part 920) is hereby expressly amended to read as follows:
Section 2.1. Permits. Before construction of a water well, a permit shall be obtained from the Water Commissioner of the Village of Bannockburn and the Illinois State Department of Mines and Minerals. Applications for a Village permit shall be submitted on forms supplied by the Village Clerk.
Sections 5.3 and 5.3.1. Delete entirely.
Sections 8 through 8.5. Delete entirely and substitute:
Section 8.1. No well type other than a drilled well shall be installed in the Village of Bannockburn.
B. 
The Illinois Water Well Pump Installation Code (77 Ill. Adm. Code Part 925) is hereby expressly amended to read as follows:
Section 3.2.1. Notification to Village. Prior to the installation of a water well pump or equipment, the contractor shall notify the Commissioner that the installation is to be made.
Every application filed pursuant to this Part 2 for a permit covering the installation, modification or repair of a water well shall contain a covenant by the owner of the premises that he or she, and his or her successors in interest, shall not urge or assert the existence of such well, or the permit therefor, in opposition to the installation of a water main to serve such premises or as a reason for reducing any assessment for the cost thereof or as justification for any failure to abandon such system or device and attach to the public water system.
