This chapter is intended to create and establish a Park and Recreation Board for the Township of West Manheim. This Board will advise the Board of Supervisors on all matters pertaining to parks, open space, and recreation lands and programs and the operation and maintenance of such lands in West Manheim Township.
It is the mission of the Park and Recreation Board to advise the Board of Supervisors in order to foster a meaningful and satisfying program of leisure and recreational activities and events for the residents of this Township in a manner that will preserve the Township's natural and historic resources for the enjoyment of future generations; and to develop and provide educational and recreational activities, programs, partnerships and special events to further enhance the quality of life for residents of the Township.
A. 
There is hereby created and established in West Manheim Township, County of York, Commonwealth of Pennsylvania, an advisory board to be known as the "West Manheim Township Park and Recreation Board," consisting of a minimum of seven members and a maximum of nine members, who shall serve without compensation.
B. 
The members shall be appointed by the Township Board of Supervisors, each for a term of five years, which term shall expire on December 31, except that the terms of the members first appointed shall be staggered so that two vacancies shall occur on December 31, 2013, two on December 31, 2014, one on December 31, 2015, and two on December 31, 2016.
C. 
Each vacancy caused by reasons other than by expiration of the term shall be filled in the same manner as the original appointment and shall be for the remaining, unexpired term of the member. Each member shall serve until December 31 of the year in which the member's term is scheduled to expire or until a new appointment has been made in accordance with the requirements of this section. The Chairman of the Park and Recreation Board shall promptly notify the Board of Supervisors of any vacancies in the Board and may nominate candidates for the open position. Any such vacancy may be filled by the Board of Supervisors for the unexpired term.
D. 
The Board of Supervisors shall designate one or more members of the Board of Supervisors to serve as nonvoting liaisons to the Park and Recreation Board.
A. 
The Park and Recreation Board shall meet at a convenient time as soon as possible after the first Monday in January of each year and at such time shall organize as a Board by electing a Chairperson, a Vice Chairperson, and a Secretary, who shall serve for a period of one year. The Park and Recreation Board shall have the power to adopt rules and regulations for the conduct of its business not inconsistent with the provisions of state and local laws and as provided for in § 36-6 below.
B. 
The Park and Recreation Board shall meet monthly or as often as shall be required to perform its duties. The Board shall conduct all meetings as public meetings in accordance with the requirements of the Pennsylvania Sunshine Law.[1]

C. 
All actions of the Park and Recreation Board shall require concurrence of a majority of voting members of the Board.
A. 
The Park and Recreation Board Secretary shall keep minutes of all meetings for review and approval by the Board members. Copies of the approved minutes shall be provided to the Township Secretary on a timely basis for distribution to the Board of Supervisors.
B. 
The Park and Recreation Board shall submit an annual report to the Board of Supervisors no later than March 1 of each year. The report shall include a listing of the significant activities of the Board during the prior year and comments and recommendations with respect to the management and operation of recreation programs and park and open space places within West Manheim Township, including an analysis of park, recreation and open space areas and programs, as well as maintenance and operations.
C. 
The Board shall not have authority to enter into any contracts or to incur any obligations binding upon West Manheim Township.
A. 
The Park and Recreation Board, in cooperation with other advisory bodies designated from time-to-time by the Board of Supervisors, shall advise and make recommendations to the Board of Supervisors with respect to the planning, design, management, operations, improvement and activities of park, recreation and open space lands and programs in West Manheim Township.
B. 
The Park and Recreation Board may adopt bylaws with the approval of the Board of Supervisors.
C. 
The Park and Recreation Board shall promote activities and programs that enhance the use and enjoyment of the park, recreation and open space lands in the Township.
D. 
The Park and Recreation Board shall participate in the initiation, review and recommending development of recreation areas and park facilities to the Board of Supervisors for approval and funding.
E. 
The Park and Recreation Board shall recommend to the Board of Supervisors, by September 1, a budget for equipping, operating and maintaining recreation places and facilities in the Township.
F. 
The Park and Recreation Board shall not have the power to amend, adopt, alter, repeal or change any rules and regulations that govern the use of the park(s) by the public that have been adopted by the Board. Only the Board of Supervisors shall have the power to adopt rules and regulations for the operation of the parks and recreation places in the Township.
