A. 
All persons occupying or maintaining any premises within the City where refuse and recyclable materials are created, produced or accumulated shall maintain, at a suitable place upon such premises, approved refuse or recycling containers for receiving and holding all refuse and recyclable materials produced, created or accumulated on such premises. Solid waste containers shall be maintained in good condition, free of holes and fissures, and shall be equipped with securely fitting covers. Said containers shall be kept closed at all times.
B. 
No person shall accumulate, store or require the storage or handling of solid waste or recyclable materials in such a manner so as to promote the propagation, harborage or attraction of bacteria or vermin or so as to create a nuisance or hazard to public travel, health or safety. As such, garbage shall not be stored by a person for more than seven days, exclusive of holidays.
C. 
Any uncontained accumulation of solid waste on any premises is hereby declared to be a nuisance and is prohibited.
Solid waste and/or recycling containers shall be placed at curbside for the scheduled collection. During no other time and for no other purpose shall said containers be placed or left upon any sidewalk, street or public place.
No person shall place any solid waste container at the location designated for collection by the City more than 24 hours prior to said collection. After collection has been completed and the containers emptied by the City, the property owner or occupant must remove the empty containers from the street within 24 hours of the day of collection.
A. 
Failure to remove any solid waste or recycling containers within 24 hours of the day of collection is deemed a violation of this article. Each continuing day of noncompliance with the provisions of this article shall constitute a separate violation.
B. 
Any owner or occupant who violates this article shall be liable for a fine of $25 for each violation.
C. 
The imposition of the monetary penalties set forth herein shall not preclude the City from seeking any other remedy, including but not limited to money damages and injunctive relief, as may be allowed by law.
