No person, business, or organization shall engage in an outdoor special event without first obtaining a permit.

The necessity in the public interest for the provisions and prohibitions hereinafter contained and enacted is declared as a matter of legislative determination and public policy, and it is further declared that the provisions and prohibitions hereinafter contained and enacted are in pursuit of and for the purpose of securing and promoting the public health, comfort, convenience, safety, welfare and prosperity and the peace and quiet of the Village and its inhabitants.

When used in this chapter, the following term shall have the following meaning:
OUTDOOR SPECIAL EVENT
Includes all land uses which provide entertainment, activities and services partially or wholly outside of an enclosed building. Such activities often have the potential to be associated with nuisances related to noise, lighting, dust, trash, and late operating hours. At a minimum, examples of such outdoor special events include the following: outdoor festivals, street fairs, outdoor beer gardens, private outdoor parties on public property, private outdoor receptions on public property and public parties on private property.

At least 14 days prior to the proposed outdoor special event, the applicant shall file a complete application with the Village Clerk. Outdoor special event permit applications may be filed simultaneously for multiple special events which occur within 365 days of the date of filing.
Following receipt of the complete application(s), the Village Clerk shall schedule a meeting with the applicant and a three-person reviewing committee comprised of the Village President, the head of the Parks department, and the head of the Police Department to review the application(s). The aforementioned reviewing committee shall review the application(s) in accordance with the rules and regulations outlined in this section.
A. 
The general application shall include the following information: date, location, and duration of the outdoor special event; anticipated attendance; activities at the proposed outdoor special event (indicating if the activities will be potential noise generators, i.e., is loud music to be involved); and if food and beverages (alcoholic and nonalcoholic) are to be served.
B. 
Activities shall not obstruct pedestrian or vehicular circulation, including vehicular sight distances, and shall be described in the application. Where appropriate, the reviewing committee may require the provision of a site plan, indicating access, parking, and emergency services.
C. 
Adequate parking, drinking water, and toilet facilities shall be provided and shall be described in the application.
D. 
Proposed hours of operation shall be described in the permit application. If the subject property where the outdoor special event is to be held is located adjacent to a residential area, activities may be limited to daylight hours.
E. 
Adequate provisions for crowd control shall be made and shall be described within the application.
F. 
Adequate provision for clean-up and trash control shall be made and shall be described within the permit application.
G. 
Signage shall comply with the requirements for temporary signs in Section 17.62.070 and shall be described in the application.
The reviewing committee may take final action on the application(s) at the time of the initial meeting with the applicant, or may continue the proceedings. The review committee may approve the permit application(s) as originally proposed, may approve the permit application(s) with modifications, or may deny approval of the permit application(s).
When the reviewing committee takes action on the permit application(s), it shall notify the Village Clerk of its conclusion, and a permit(s) shall be furnished to the applicant upon approval of the application. The reviewing committee's approval of a requested permit application shall be considered the approval of a unique request and shall not be construed as precedent for any other proposed permit applications. No permit under this section shall at any time be used by any person other than the one to whom it is issued.
If the outdoor special event is to be held in one of the Village's public parks, a park permit shall be secured, and the appropriate park permit fees shall be paid, in conjunction with the review and approval of an outdoor special event permit.

An outdoor special events permit shall not be required for private parties on private property.

Fees for such licenses shall be set from time to time by resolution of the Village Board.

Permits issued under the provisions of this chapter may be revoked or suspended by the reviewing committee for either of the following reasons:

Misrepresentation or incorrect statement contained in the application for the permit:

Conducting the licensed business in an unlawful manner or in such manner as to constitute a breach of the peace or a menace to the health, safety, or general welfare of the public.

Any person who shall violate the provisions of this chapter or who shall fail to obtain the permit as required shall be subject to a penalty as provided in Chapter 1.08 of this Municipal Code.
