The plat of the Eldon Cemetery located on the north half of
the east half of the southeast quarter of the southwest quarter of
Section 28, Township 42, Range 15, Miller County, Missouri, is hereby
accepted and that the same is hereby set apart to be used by the public
for cemetery purposes, subject to the rules, regulations and control
of the Board of Aldermen of said City, and that the streets and alleys
(therein) are hereby dedicated to the public as such, and that the
Mayor and City Clerk are directed to execute and file and record said
plat with the recorder of Miller County, Missouri.

The plat of an addition to the Eldon Cemetery located on the
northwest quarter of the southeast quarter of the southwest quarter
of Section 28, Township 42, Range 15, the same being within a distance
of three (3) miles of the City of Eldon, be and the same is hereby
accepted and approved, and said addition is hereby set apart to be
used exclusively for cemetery purposes subject to the rules, regulation
and control of the Board of Aldermen of said City.

The streets, alleys and drives in said addition as marked out
and designated on said plat are hereby dedicated to the public for
public use as such.

A pauper field shall be located in the extreme northwest corner
of Block 5 in the addition to the Eldon Cemetery and approximately
thirty-two (32) grave sites shall be designated in this field.

All full lots in the Eldon Cemetery shall be divided into eight
(8) grave sites each, and part lots shall be divided according to
number of graves each will accommodate.

A.
The financing of said Eldon Cemetery shall be as follows:
1.
Adult Or Child Grave Sites. The purchase price of each adult
or child grave site shall be four hundred fifty dollars ($450.00)
of which fifty dollars ($50.00) shall be placed in the endowment fund
for the perpetual care of the Eldon City Cemetery sites. The amount
shall be used for any appropriate cemetery expense. The selling of
grave sites on weekends, holidays or after 4:30 P.M. on regular business
days shall require an additional fee of fifty dollars ($50.00).
2.
Infant Grave Sites. The purchase price of an infant grave site
[no larger than one-quarter (1/4) of the regular grave site] in the
designated area for infant graves shall be one hundred fifty dollars
($150.00) of which fifty dollars ($50.00) shall be placed in the endowment
fund for the perpetual care of the Eldon City Cemetery sites. The
amount shall be used for any appropriate cemetery expense. The selling
of grave sites on weekends, holidays or after 4:30 P.M. on regular
business days shall require an additional fee of fifty dollars ($50.00).
3.
Grave Opening Fees. Grave opening fees shall not be accepted
in advance of the opening. Grave opening fees shall be invoiced to
the funeral home providing the burial service, after the grave is
opened for occupancy, with a five-day net payment period. Fees for
grave openings shall be as follows:

Holidays shall be defined as municipally recognized and celebrated

4.
The grave site fee and the grave opening fees must be paid to
the City Deputy Collector before any grave is opened. Any purchaser
must pay the grave site fee at the time of the purchase.
5.
The endowment fund portion of the grave site fee referred to
above shall be maintained separate and apart from other City funds
except that income from the corpus of said trust fund may be used
by the City of Eldon for the purpose of upkeep and maintenance of
the Eldon Cemetery. Said funds may be invested in time deposits, United
States Government bonds or similar investments authorized by law for
investment of municipal funds.
6.
A minimum forty-eight-hour notice is required for opening and
closing a grave. An emergency burial grave opening and closing of
less than a forty-eight-hour notice will be permitted with an assessed
additional two-hundred-dollar fee. Any emergency burial grave opening
must be approved by the City Administrator.
7.
An agreement for the City to invoice any funeral home providing
a burial service at the Eldon Cemetery shall be signed by a representative
of said funeral home and must be kept on file at City Hall.

A.
The
following requirements shall be set out for all City of Eldon cemeteries:
1.
Concrete box or vault. Any grave site opened for
occupancy shall be equipped with a concrete box or a vault of same
or better quality as the concrete box. No grave shall be occupied
until said box or vault has been installed, except for graves of individuals
in potter's field, infants and cremations.
2.
City to sell and locate grave site. In order that
grave sites be properly located, it shall be a requirement before
opening a grave that one (1) or more City employees accompany the
funeral director or family to assist in properly locating the grave
site. All grave sites shall be sold by the City of Eldon Cemetery
Sexton or his/her designated representative.
3.
City to regulate grave openings. The City shall
designate and regulate who opens graves in the City of Eldon cemeteries.
4.
Notification of funeral. Funeral directors shall
notify the City of a pending funeral immediately upon being contracted
by the family of the deceased.
5.
Grave depth and size. All adult graves shall be
at least five (5) feet in depth and large enough in length and width
to accommodate the concrete box or vault. Baby graves and cremation
graves shall be at least three (3) feet in depth.

A.
An
owner of grave site(s) in the Eldon cemeteries may transfer ownership
either by gift or by sale to another party. The following steps shall
be used in the transfer of grave sites:
1.
Provide the City Clerk with a notarized letter stating the intention
to dispose of the site(s) and the manner of disposition desired.
2.
Submit the original deed for said site(s) to the City Clerk for disposition.
3.
Owners may designate in the letter to have the City sell the site(s)
for them. Sites offered to the City for resale shall not be given
special selling considerations by the City.
4.
It shall be the responsibility of the owner to have the site(s) free
of any unpaid fees prior to disposition.
5.
The City shall remit monies to seller upon payment by the purchaser
of said site(s).

A.
The following forms of collection for fees associated with the sale
of grave sites shall be utilized:
1.
A deed for the site(s) purchased shall be issued to the purchaser
of a grave site upon full payment of the grave site fee.
2.
The purchaser may make installment payments upon credit approval
by the City Clerk. Said installment payments shall be not less than
fifty dollars ($50.00) per month and shall be paid monthly until paid
in full. All accounts outstanding after ninety (90) days shall accrue
interest at the rate of ten percent (10%) per annum until paid in
full.

Graves may be decorated with one (1) flower arrangement throughout
the year except Memorial Day weekend at which time there is no limit
on the number of flowers allowed on the graves. Permanent attachments
to the grave stones intended for holding flower arrangements shall
be allowed. Any plantings shall first be approved by the City. All
memorial decorations will remain on the graves for a period of two
(2) weeks. At the end of the two (2) week period, all arrangements
but one (1) shall be removed and discarded. Notice of said removal
of decorations shall be in the Eldon Advertiser prior to Memorial
Day.

Any portion of this Chapter that becomes invalid shall not void
any other portion of said Chapter.
