A. 
Except as otherwise specifically provided in other codes and regulations, the following shall apply to the construction of fences:
1. 
Fencing for safety purposes shall be required wherever dwellings or manufactured homes are built or installed on lots abutting major streets in these regulations or railroad right-of-way.
2. 
All fences and walls shall be constructed with the finished surface facing outward from the property. Any posts or support beams shall be inside the finished surface or designed to be an integral part of the finished surface.
3. 
No fence shall be constructed which will constitute a traffic hazard.
4. 
No fence shall be constructed in such a manner, or be of such design, as to be hazardous or dangerous to persons or animals.
5. 
No person shall erect or maintain any fence which will materially damage the adjacent property by obstructing the view, shutting out the sunlight, hindering ventilation, tend to depreciate the value, interfere with the comfortable enjoyment of life or which fence shall adversely affect the public health, safety and welfare or essentially interfere with the comfortable enjoyment of life or use of property or tend to depreciate the value of property of others.
6. 
No fence, except fences erected upon public or parochial school grounds or in public parks and in public playgrounds, shall be constructed of a height greater than four (4) feet in the front yard or six (6) feet elsewhere. Fences in residential areas which are located in front of the residence must be at least one-third (1/3) open. (The front of the residence is the area between the front of the house and the street to which the house is addressed.)

A. 
Minimum fence property line setbacks are as follows:
1. 
Front Yard. No fence shall be constructed within twenty-five (25) feet of any roadway, right-of-way line.
2. 
Side Yard. No fence shall be constructed within two and five-tenths (2.5) feet of either side property line.
3. 
Rear Yard. No fence shall be constructed within five (5) feet of any rear property line that adjoins any utility or alley easement. If no easement exists, the rear property line setback is two and five-tenths (2.5) feet.
4. 
On Corner Lots. The side yard setback, on street side, shall be twenty (20) feet.
5. 
Fence Height. Fence height shall be no more than six (6) feet.

A. 
In order to protect the residents in Section 520.010(5), fences shall be kept and maintained in good, sound and presentable condition at all times.
B. 
Fences not so maintained shall be deemed a nuisance and the property owner will be given ten (10) days to correct such nuisance.
C. 
If the nuisance is not abated pursuant to the written notice, a citation will be issued.
D. 
The City Code Enforcement Officer may authorize removal of such fence. The order shall provide twenty (20) days minimum for such removal.
E. 
Such orders shall be appealable to the Board of Aldermen.

No person shall erect, construct, alter, replace or enlarge a fence or wall without obtaining a permit from the Code Enforcement Officer or designee. The permit fee shall be fifty dollars ($50.00).

A. 
The fence permit application shall include a site plan which adequately represents the premises and contains the dimensions to physical features which are easily located on the premises.
B. 
The application shall also include the type of fencing material to be used, height of fence, setbacks, spot survey, and a picture or drawing of the proposed fence.
C. 
If a front yard fence or a fence near a public right-of-way is proposed, then the site plan shall include the location of the edge of the street pavement, curb or sidewalk in relation to the fence.
D. 
The applicant shall also provide a notice of the application to the abutting property owners by delivery of a copy of the application to them, requiring a signature and providing a copy to the Code Enforcement Officer.
