Editor's Note: The preamble to this ordinance stated: "Whereas, the Mayor and Township Council are desirous to regulate individual conduct by the creation of this new chapter and said enactment is not an attempt to conflict or preempt any provisions of the New Jersey State Code of Criminal Justice, but rather to expand these provisions so that the public is properly protected."
It shall be the purpose of this chapter to provide a means of maintaining peace, tranquility and order within the Township of Mine Hill.
Any person who shall violate any section hereof shall be subject to the penalty in § 1-3, General penalty, of the Code of the Township of Mine Hill.

Any of the following persons shall be deemed guilty of an offense against the public peace:
A. 
Any person who unlawfully fights in a public place or challenges another person in a public place to fight.
B. 
Any person who maliciously and willfully disturbs another person by loud and unreasonable noise.
C. 
Any person who uses offensive words in a public place which are inherently likely to provoke an immediate violent reaction.
D. 
Any person who intentionally disrupts any lawful assembly or meeting of persons without lawful authority.
E. 
Any person who intentionally obstructs vehicular or pedestrian traffic without lawful authority.
A. 
It shall be unlawful for any person to possess an open container of or to consume any alcoholic beverage in any public conveyance, public place, place of public assembly or private property without the express permission of the owner thereof.
B. 
It shall be a defense to a charge of violating Subsection A hereof if the actor established that his or her possession was consistent with a validly issued permit or license, if the same is available, to possess or consume alcoholic beverages in a public conveyance, public place or place of public assembly at a designated time or times in connection with a special event or series of events or observance which has been authorized by the Mayor and Council of the Township of Mine Hill.
A. 
It shall be unlawful for any person, firm or corporation to commit a trespass within this municipality upon either public or private property.
B. 
Specifically enumerated trespasses. Without constituting any limitation upon the provisions of Subsection A hereof, any of the following acts by any person, firm or corporation shall be deemed included among those that constitute trespasses in violation of the provisions of said Subsection A, and appropriate action may be taken hereunder at any time, or from time to time, to prevent or punish any violation or violations of this chapter. The aforesaid enumerated acts shall include:
(1) 
An entry upon the premises, or any part thereof, of another, including any public property in violation of a notice posted or exhibited at the main entrance to said premises or at any point of approach or entry or in violation of any notice, warning or protest given orally or in writing by any owner or occupant thereof; or
(2) 
The pursuit of a course of conduct or action incidental to the making of an entry upon the land of another in violation of a notice posted or exhibited at the main entrance to said premises or at any point of approach or entry or in violation of any notice, warning or protest given orally or in writing by any owner or occupant thereof; or
(3) 
A failure or refusal to depart from the premises of another in case of being requested, either orally or in writing, by any owner or occupant thereof.

It shall be unlawful for any person to urinate or defecate upon any property whether public, quasi-public, or private within the Township limits of the Township of Mine Hill except in such places as may be provided for such use.
