Any person who owns an animal of licensing age within the corporate limits of the City of Absecon shall annually apply for and procure from the Licensing Authority in the City of Absecon, a license and official tag for each animal so owned and shall place upon such animal a collar or other device with the official tag securely fastened and displayed thereto. Acceptable methods for displaying the official tag include, but are not limited to, breakaway or elastic collars.

The owner of any newly acquired animal of licensing age shall apply for and procure a license and official tag for such animal within 10 days after such acquisition or age attainment. The requirement shall not apply to a nonresident keeping an animal within the corporate limits of the City of Absecon for no longer than 90 days.

A. 
Any person who shall bring or cause to be brought into the corporate limits of the City of Absecon any animal licensed in any other state for the current year bearing an official tag and shall keep the same or permit the same to be kept within the corporate limits of the City of Absecon for a period of more than 90 days shall immediately apply for and procure a license and official tag for each animal.
B. 
Any person who shall bring or cause to be brought into the corporate limits of the City of Absecon any unlicensed animal and shall keep same or permit the same to be kept within the corporate limits of the City of Absecon for a period of time of more than 10 days shall immediately apply for a license and registration tag.

A. 
The application shall state the breed, sex, age, color and markings of the animal for which the license and registration are sought as well as the name, street and post office address of the owner and the person who shall keep or harbor such animal. In the case of cats whether or not the cat is of a long or short hair variety shall also be indicated.
B. 
The information on said application and the registration number shall be maintained for a period of three years by the Licensing Authority of the City of Absecon.

A. 
License forms and official tags shall be furnished by the municipality and shall be numbered serially and shall bear the year of issuance and the name of the municipality.
B. 
Replacement tags may be issued only on proof of loss of the original license form and official tag within the year in which the original license form and official tag were issued.

The Licensing Authority of the City of Absecon shall not grant any such license and official tag for any animal unless the owner thereof provides evidence that the animal to be licensed and registered has been inoculated with a rabies vaccine of a type approved by and administered in accordance with recommendations of the United States Department of Human Services or has been certified exempt as provided by Section 122-5 of this chapter. The rabies inoculation shall be administered by a duly licensed veterinarian permitted by law to do same.

Only one license and official tag or sleeve shall be required in the licensing year for any animal in the City of Absecon. Any valid New Jersey license and official tag issued by a New Jersey municipality shall be accepted by the City of Absecon.

Proof of licensing shall be produced by any person owning an animal upon the request of any health official, Police Officer, Animal Control Officer or other authorized person.

The following schedule is established for the licensing of animals in the City of Absecon:
A. 
For the period commencing January 1st through March 31st:
(1) 
Neutered or spayed: $7.
(2) 
Non-neutered or non-spayed: $10.
B. 
For the period commencing April 1st through December 31st:
(1) 
Neutered or spayed: $12.
(2) 
Non-neutered or non-spayed: $15.
C. 
Replacement tags as provided for in Section 122-10B shall be $2.
The above listed fees as they relate to dogs include the mandated State registration fees for same.

Annual license fees and any other money collected or received under the provisions of this chapter shall be placed in a special account separate from any of the other accounts of the municipality. The monies collected shall be used for the following purposes only: collecting, keeping and disposing of animals liable to seizure; for local prevention and control of rabies; providing anti-rabies treatment under direction of the Atlantic County Board of Health for any person known or suspected to have been exposed to rabies; and for administering the provisions of this chapter. Any unexpected balance remaining in such special accounts shall be retained until the end of the third fiscal year following and may be used for any of the purposes set forth in this section. At the end of said third fiscal year following and at the end of each fiscal year thereafter, there shall be transferred from said special accounts to the general funds of the municipality any amount then in such accounts which is in excess of the total amount paid into the special accounts during the last fiscal year next preceding.
