It shall be unlawful for any person to operate any boat, motor
or otherwise, upon the water of Absecon Creek, Absecon City, New Jersey,
at a speed in excess of four miles per hour.

The use of the word "person" shall, for the purposes of this
Article, be deemed to include persons, firms, partnerships and corporations.

A.
Any person violating any of the provisions of this Article shall,
upon conviction before the Police Justice of Absecon City or other
proper official, be punished for each offense by a fine not to exceed
$200 or by imprisonment for any term not to exceed 90 days in the
county jail or in any place provided by the municipality for the retention
of prisoners or both. The Municipal Judge, or other proper official
before whom the person is convicted of violating this article, shall
have power to impose any fine or term of imprisonment not exceeding
the maximum fixed in this article.
B.
In default of the payment of any fine imposed hereunder, any person
convicted of any violation may, in the discretion of the Municipal
Judge or other proper official by whom he was convicted, be imprisoned
in the county jail or place of detention provided by the municipality
for any term not exceeding 90 days.
