The following districts are hereby established:
A.
Zoning Map and boundaries. All areas within boundaries of Absecon
City have been assigned to a zoning district. Zoning district boundaries
established by this chapter are shown upon the Zoning Map (as amended
November 28, 1989), attached hereto and made a part of hereof, which
together with all explanatory matter thereon is declared or be a part
of this chapter. (The Zoning Map may be found on file in the City
Offices.)
B.
Boundary lines. Where uncertainty exists with respect to the boundaries
of the various districts as shown on the Zoning Map (as amended November
28, 1989), which is part of this chapter, the following rules apply:
(1)
Unless otherwise shown, the district boundary lines shall be construed
to coincide with the center lines of streets, alleys, parkways, waterways
or such lines extended.
(2)
Where the district boundaries are not otherwise indicated and where
the property has been or may hereafter be divided into blocks and
lots, the district boundaries shall be construed to be the rear or
side lines, and where the districts designated on the Zoning Map are
bounded approximately by the rear or sides lines, the rear or side
lines shall be construed to be this district unless the boundaries
are otherwise indicated on the Zoning Map (as amended November 28,
1989).

In the event of subdivided property or a question on the exact location
of any boundary line, the determination of the Planning Board shall
prevail. The Board members will be guided by a narrative description
of district boundaries on file in the City Clerk's office.
C.
Amendments.
(1)
The Absecon City Zoning Map is hereby amended to expand the C-2 Community
Business District Boundaries to include the following area: From the
center line of U.S. Route 9 (New Road) on the west, to the southerly
boundary of the railroad right-of-way to the north, to the northerly
boundary of the CR Conservation-Recreation District on the south,
to the easterly lot lines of Lot 2 of Block 216 and Lots 1, 4, 6,
8, 12, 14, 16 and 18 of Block 237 and as to Lot 11 to a line on the
east which corresponds and is equal in distance from New Road to the
rear lot lines of Lots 8 and 12. This area of expansion includes all
of Lots 1 and 2 of Block 216 and all of Lots 1, 4, 6, 8, 12, 14, 16
and 18 of Blocks 237 and the portion of Lots 11 specifically described
herein.

(2)
The Code of the City of Absecon and the Zoning Map of the City of
Absecon is hereby amended to expand the Park District and add School
and Public Buildings District to include the following area:
Beginning at a point at the intersection of westerly line of
Pitney Road and the southerly line of Crestview Avenue thence; along
the said line of Crestview Avenue to the division line of Lots 15
and 16, Block 72, thence; along said division line to the division
line of Lot 6 and Lots fronting on Crestview Avenue, thence; along
said division line to the easterly line of Tenth Avenue, thence; along
said line of Tenth Avenue to the easterly line of Highland Boulevard
to the division line of Lot 1, Block 32 and Lots, 1, 2, 3 in Block
38, thence; along said division line to the center line of 16th Avenue,
thence; along the said centerline to the centerline of Claridge Avenue
with line continuing along the rear of lots fronting on New York Avenue
to a point in the westerly line of Elberon Avenue, thence; along the
said line of Elberon Avenue to the center line of Connecticut Avenue,
thence; along the said centerline to the intersection of the four
corners of Blocks 60, 62, 63 and 64, thence; along a line from the
said four corners to a point in the westerly line of Pitney Road which
is intersected by the division line of Blocks 61 and 62, thence along
said westerly line of Pitney Road to a point and place of beginning.

(3)
The Absecon Zoning Map is hereby amended to expand the C-1 Central
Business District to include the following area:
A portion of Lot 1.01, Block 203, as shown on the current municipal
tax map of the City of Absecon and as shown on the official Zoning
Map of Absecon City. (More particularly described as follows: bounded
by New Jersey Avenue to the north, the School Public Building (SPB)
District to the east, U.S. Route 30 to the south, and Michigan Avenue
to the west.

The Absecon City Zoning Map is hereby amended to expend I/IP-Industrial
Planned Industrial District to include the following areas as shown
on the current tax map of the City of Absecon:
Block 258, Lots 1.03 and 3

Pursuant to Ordinance No. 4-2004 adopted March 4, 2004, the Absecon
City Zoning Map is hereby amended to incorporate the Redevelopment
Area which shall be designated thereon as the Downtown Redevelopment
Area. (See also Section 224-471)

The City of Absecon Zoning Map is herewith modified as follows pursuant
to Ordinance No. 23-2007 adopted December 20, 2007.
(a)
To rezone the following Block and Lot from R-2 Moderate Density
Residential Zoning District to School Public Building/Park Zoning.
The existing privately owned parcels within the zone change area at
the time of the adoption of this ordinance will retain their rights
to develop their properties in accordance with permitted uses and
bulk and area requirements of the existing R2 District without the
requirement to seek relief from the Zoning Board of Adjustment.

Creation of the Train Station Overlay District pursuant to Ordinance
No. 23-2007 adopted December 20, 2007.
The Absecon Train Station is divided into two subsections:
(a)
A train station platform area for commuter business south of
State Highway Route 30;
(b)
And the New Jersey Avenue area north of State Highway 30 for
downtown neighborhood commercial uses.

D.
Notice of Zone District Changes.
(1)
After the first reading of an ordinance which would change any zone
district in the City of Absecon City as reflected on the Zoning Map,
the City shall notify by regular first-class mail all property owners
within 200 feet of land for which there is a proposed zoning change.
This notification will be mailed at least 10 days prior to the second
reading of the ordinance.
