Findings. There exists in the northwest section of the City of Absecon,
a large tract of vacant, undeveloped and generally wooded City-owned
land; and the Planning Board of the City of Absecon, as part of its
2006 Reexamination of the Absecon Municipal Master Plan, has expressed
a desire to retain such land for open space. The City Council of the
City of Absecon concurs with the Planning Board in its desire to maintain
open space within the City of Absecon; and the owner of the lands
in question, it is the opinion of City Council that the most effective
mechanism to achieve the aforementioned goal is for the City not to
sell the subject lands for development purposes. The City Council
desires to insure that all property owners who would be affected by
any change in policy as relates to the subject lands are fully informed
as to any such changes.

From the effective date of Ordinance No. 27-2007, adopted on December
20, 2007, and for the next 10 years thereafter, the City of Absecon
is prohibited from selling or building upon the following land in
the City of Absecon:

In the event the City Council of the City of Absecon seeks to
amend or rescind this chapter in any way or through any manner, the
City of Absecon shall notify all property owners within 200 feet of
these properties by certified mail, return receipt requested, of the
intent to amend this chapter. Said notice shall notify the property
owners of the date, time and place of the meeting where any amendment
to this chapter will be discussed.
